ZONING BOARD OF APPEALS

MINUTES

 

September 13, 2005

 

 

The meeting was called to order at 7:35 P.M. by Chairman Maggie Schmidt.  Those present were Ed Malis, Nilda Burke, Kurt Vanderhorst, Chip Ellms, Maggie Schmidt, alternate Audrey Ketchum, and Attorney Bob VanVranken.

 

Ed made a motion to approve the minute of the meeting and the public hearing from July 2005 and Kurt seconded the motion.  All were in favor.

 

Maggie distributed a notice to the Board of a local farm tour that will be held on September 24, 2005. 

 

There will be a public hearing following tonight’s meeting.  The Board will be hearing case #05-05, Ron Szcerba, who wants a variance to subdivide his property for a building lot, with 40’ of road frontage.

 

Maggie reminded the Board about the NYS Planning Federation Conference that will be held at the Prime Center in Saratoga Springs.  Registration is October 9th and the conference is being held October 10th, 11th, and 12th.  The pre-registration fee for the full conference is $95.00; late on-site registration feel for the full conference is $140.00 and the fee for one day of the conference is $85.00.  Maggie encouraged everyone to attend if their schedules allow.  If someone wants to go and hasn’t registered yet, they can pay the fee and then have the town reimburse them.  Kurt and Audrey said they didn’t receive any information from the Planning Federation on the conference and Maggie said she will check to make sure they are on the list to receive mailings.  Ed stated he will be out of town and unable to attend. 

 

There is a hearing next month and everyone on the Board has the application.  The applicant’s request is to make one lot into two.  Maggie pointed out that the application is for two variances because subdividing the lot will make both frontages substandard and will make the new house won’t meet the zoning ordinance guidelines for side yard setbacks. 

 

There was a discussion regarding J&L Services on Swaggertown Road.  This was a variance that was granted by the Board earlier in the year.  The applicant wants to put in a septic system and it meets all requirements except the town’s zoning on side yard setbacks.  The Board will discuss the matter with Dave LaFountain to see if they can come up with a suggestion to the applicant. 

 

Maggie asked the Board if they are interested in seeing what the Planning Board approves and they said yes.  Maggie said she receives them and she will bring them to the meetings for the Board to review if they wish.

 

Nilda made a motion to adjourn the meeting and Ed seconded it.  All were in favor.
