A Public Hearing of the Town Board of Charlton, Saratoga County, New York was held at 7:15 pm at the Charlton Town Hall, and called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Lippiello, Councilman Salisbury, Councilman Verola and Supervisor Grattidge, Town Clerk Brenda Mills, Town Attorney VanVranken.

 

The purpose of this Public Hearing was to hear all interested parties on a proposed Local Law entitled “A LOCAL LAW AUTHORIZING A PARTIAL EXEMPTION FOR REAL PROPERTY TAXES FOR REAL PROPERTY OWNED BY PERSONS WHO RENDERED MILITARY SERVICE TO THE UNITED STATES DURING THE COLD WAR PERIOD SEPTEMBER 2, 1945 - DECEMBER 26, 1991”.

 

Attorney VanVranken read the Legal notice that was published August 1, 2008 in the official newspaper, The Daily Gazette.  The Legal Notice was placed on the sign board at the Charlton Town Hall and also on the Charlton Bulletin Board.  Legal Notice read:

TOWN OF CHARLTON

 

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Charlton at a regular Meeting held on August 11, 2008 duly adopted, subject to permissive referendum, a Local Law, an abstract of which is as follows:

 

LOCAL LAW NO. 2 OF 2008

 

A LOCAL LAW AUTHORIZING A PARTIAL EXEMPTION

FOR REAL PROPERTY TAXES FOR REAL PROPERTY

OWNED BY PERSONS WHO RENDERED MILITARY

SERVICE TO THE UNITED STATES DURING THE COLD WAR

PERIOD SEPTEMBER 2, 1945 - DECEMBER 26, 1991

                                             

            Be it enacted by the Town Board of the Town of Charlton, Saratoga County, New York, as follows:

 

Section 1.  Title and Authority. 

 

            This local law shall be known as the “Local Law Authorizing a Partial Tax Exemption for Real Property Taxes for Real Property Owned by Persons who Rendered Military Service

to the United States during the Cold War Period September 2, 1945 - December 26, 1991”.  It is adopted pursuant to the authority of Article 2, Article 3 and Article 10 of the New York State Municipal Home Rule Law.

 

Section 2.  Purpose. 

 

            The Town Board of the Town of Charlton recognizes that the purpose of the local law is to grant a partial exemption from real property taxation to the extent of fifteen percent (15%) of the assessed value up to Twelve Thousand and no/100 Dollars ($12,000.00) of assessed value of qualified residential real property which is owned by a Cold War veteran who is a qualified owner, or in the case of a Cold War veteran who is a qualified owner and who received a compensation rating from the United States Veteran’s Administration or from the United States Department of Defense because of a service related disability, to the extent of the product of the assessed value of such qualified residential real property multiplied by fifty percent (50%) of the Cold War veteran’s disability rating up to an assessed valuation of Forty Thousand and no/100 Dollars ($40,000.00) of assessed value, in accordance with the requirements of Section 458-b of the Real Property Tax Law.

 

Section 3.  Permissive Referendum

 

            This Local Law is subject to permissive referendum as set forth in Section 24(h) of the New York State Municipal Home Rule Law.

 

Section 4.  Repeal. 

 

            Any other Local Law, or ordinance or resolution inconsistent herewith is hereby repealed.

 

Section 5.  Effective Date. 

 

            This Local Law shall take effect forty-five (45) days after its adoption and upon filing with the New York State Secretary of State.

Supervisor Grattidge gave privilege of the floor to the public and Board Members to speak on this subject.  Hearing none, the meeting was adjourned at 7:19pm.
