A Public
Hearing of the Town Board of Charlton, Saratoga County, New York was held at
7:15 pm at the Charlton Town Hall, and called to order by Supervisor Grattidge.
Present: Councilman Gardner, Councilman Lippiello,
Councilman Salisbury, Councilman Verola and Supervisor Grattidge, Town Clerk
Brenda Mills.
Town
Attorney VanVranken arrived at 7:19pm.
Others
Present: Zoning Administrator Dave
LaFountain, Water Superintendent John Morgan.
The purpose of this Public Hearing
was to hear all interested parties on a proposed Local Law entitled “Local Law
Authorizing an Increase to the Salary of Appointed Town Clerk Brenda Mills for
Fiscal Year 2008 Pursuant to Section 27 of the New York State Town Law”.
Supervisor
Grattidge read the Legal notice that was published March 14, 2008 in the
official newspaper, The Daily Gazette.
The Legal Notice was placed on the sign board at the Charlton Town Hall
and also on the Charlton Bulletin Board.

PUBLIC NOTICE IS HEREBY GIVEN, that the Town Board of the Town of
Charlton will hold a public hearing concerning a proposed local law providing
for an increase to the salary of appointed Town Clerk Brenda Mills for Town
fiscal year 2008 and which hearing will be held on the 31st day of
March, 2008 at 7:15p.m. at the Town Hall of the Town of Charlton, 784 Charlton
Road, Charlton, New York, at which time and place all persons desiring to be
heard thereon will be heard.

law is on file and available at the Town Clerk’s Office.

LOCAL LAW NO. 1 OF 2008
A LOCAL LAW
AUTHORIZING AN INCREASE TO THE
SALARY OF APPOINTED
TOWN CLERK BRENDA MILLS
FOR FISCAL YEAR 2008
PURSUANT TO
SECTION 27 OF THE NEW
YORK STATE TOWN LAW
Be it enacted by the Town Board of the Town of
Charlton, Saratoga County, New York, as follows:
Section 1. Title and Authority.
This local law shall be known as
the “Local Law Authorizing an Increase to the Salary of Appointed Town Clerk
Brenda Mills for Fiscal Year 2008 Pursuant to Section 27 of the New York State
Town Law”. It is adopted pursuant to
the authority of Article 2, Article 3 and Article 10 of the New York State Municipal
Home Rule Law.
Section 2. Purpose.
The Town Board of the Town of
Charlton recognizes that the Appointed Town Clerk has been required to provide
additional services than those originally anticipated at the time of the Town
Clerk’s appointment on December 10, 2007 and the establishment for fiscal year
2008 salary for such Town Clerk as approved by the Town Board on January 14,
2008. The Town Board wishes to fairly
and adequately compensate the Town Clerk for the necessary services required to
be provided to the residents of the Town of Charlton by the Town Clerk and for
fiscal year 2008.
Section 3. Payment.
The Appointed Town Clerk’s
salary is currently set at $25,477.00 for fiscal year 2008. The Town Board hereby amends the 2008 annual
salary for Appointed Town Clerk Brenda Mills in the increased amount of
$3,000.00 and for a new annualized total salary of $28,477.00. Authority for this action by the Town Board
is based on Section 27 of the New York State Town Law.
Section 4. Fund Transfer
The Town Board hereby authorizes
the transfer of the sum of $3,000.00 from Town Account No. A-1990.4 -
Contingent Account to Town Account No. A-1410.10 - Town Clerk, Department Head
Account.
Section 5. Permissive Referendum
This Local Law is subject to
permissive referendum as set forth in Section 24(h) of the New York State
Municipal Home Rule Law.
Section 6. Repeal.
Any other Local Law, or
ordinance or resolution inconsistent herewith is hereby repealed.
Section 7. Effective Date.
This
Local Law shall take effect forty-five (45) days after its adoption and upon
filing with the New York State Secretary of State.
Supervisor
Grattidge gave an opportunity for the public to speak. Support was received from Mr. LaFountain and
Mr. Morgan.
The Town
Board unanimously gave support of the increase in pay, and thanked the Town
Clerk for taking on additional duties to help with the checks and balances of
the bookkeeping process.
After
everyone had the opportunity to speak who wished, a motion was made by
Councilman Verola and seconded by Councilman Salisbury, that the meeting be
closed.
The meeting
was adjourned at 7:22pm.
