The Agenda meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30 pm at the Charlton Town Hall, called to order by Deputy Supervisor Lippiello.

 

Present:  Councilman Lippiello, Councilman Salisbury, Councilman Verola, and Town Attorney Robert VanVranken.

 

Absent:  Supervisor Grattidge and Councilman Gardner

 

Deputy Supervisor Lippiello announced that this meeting is to set the Agenda for the Regular Meeting of the Town Board on Monday, December 10, 2007.

 

ABSTRACT OF CLAIMS

 

A motion was made by Councilman Verola seconded by Councilman Salisbury authorizing the town clerk to prepare abstract 122 claims no. 1878-1921 totaling $216,551.41 as audited by the Town Board.  Approved

The following Town Board Meeting minutes will be approved at the December 10, 2007 meeting

Deputy Supervisor Lippiello announced the following items:

 

     The Town Board will hold a workshop meeting on December 12, 2007 at 7:00pm to discuss the Organizational Resolutions for 2008.  The Town Board will also meet with a representative from the Office of Court Administration.

 

The Town Board will bring a resolution forward at the December 10th meeting appointing a Town Clerk.  The Town Board conducted interviews on November 14th.

 

The Town Board received a report on Sales Tax and ˝ years Mortgage Tax.

 

The Town Highway Superintendent had rejected the sand bids.  A resolution for re-bid would be presented.

 

Councilman Verola stated that the Town Historian purchased three books for the Historian’s Office.  She would like to be reimbursed for the expense.  The cost for the books total $67.50.  She will not have enough in her budget.

 

Technology Advisory Board Member George Eggleston stated that the Constables purchased a new computer.  They will need to contact John Kelley to down load an antivirus protection for the computer.  Deputy Supervisor Lippiello questioned why he would not contact Craig Jones.  Mr. Eggleston stated that Mr. Kelley does this as a freebee.

   RESOLUTION NO.151

 

 

November 26, 2007

 

 

                    A RESOLUTION AUTHORIZING THE TOWN HIGHWAY

SUPERINTENDENT TO PREPARE BID SPECIFICATIONS

               AND ADVERTISE FOR BIDS TO PROVIDE THE

TOWN WITH ICE CONTROL SAND

                     

            WHEREAS, in order to meet its obligations to the residents of the Town of Charlton, the Town Highway Department needs to have available screened sand for the purpose of ice control, and

 

            WHEREAS, the Town Highway Superintendent has the necessary expertise to prepare bid specifications in order to assure that the quantity and quality of ice control sand will be available to the Town Highway Department during the period December 1, 2007 - May 1, 2008 as may be needed to meet Town Highway Department obligations, and

 

            WHEREAS, the Town Board did receive two bids on November 12, 2007 as a result of the public notice requesting such bids, and which bids were either incomplete or unacceptable to the Town Highway Superintendent, requiring this additional resolution.

 

NOW, BE IT RESOLVED, that the Town Highway Superintendent is hereby authorized to prepare bid specifications necessary to obtain ice control sand in sufficient quantity and of sufficient quality to meet the needs of the Town Highway Department for the period December 1, 2007 - May 1, 2008, and

 

            BE IT FURTHER RESOLVED, that the Town Highway Superintendent is hereby authorized to advertise for sealed bids for such ice control sand, which bids shall be received by no later than 1:00 p.m. on Wednesday, December 26, 2007 and that such bids will be opened at 7:30 p.m. during the agenda meeting of the Town Board held on December 26, 2007.

A RESOLUTION AUTHORIZING THE SUPERVISOR TO

EXECUTE AGREEMENTS NECESSARY TO PROVIDE

TEMPORARY HEAT

FOR THE NEW TOWN HALL

 

 

            WHEREAS, the Town Board received a memorandum (attached) dated November 26, 2007 from the Town’s Owners Representative Tony Ward requesting temporary heat for the New Town Hall Building in attempt to reduce the moisture in the building.

 

BE IT RESOLVED, that the Supervisor is hereby authorized to enter into any agreements necessary to provide temporary heat to the New Town Hall as referenced in attached memorandum.

   RESOLUTION NO.153

 

 

 November 26, 2007

 

 

A RESOLUTION AUTHORIZING THE AWARD OF AN

ADDITIONAL MOLD REMEDIATION CONTRACT FOR THE

NEW TOWN HALL EMERGENCY ACTIONS

 

 

            WHEREAS, the Town Board did on September 12, 2007, terminate the Agreement between the Town Board and Schmidt & Schmidt, Inc. as General Contractor with respect to the New Town Hall project, and

 

            WHEREAS, the Town did direct its professional advisors, including Architect Vosburgh, Owners Representative Ward and Special Counsel Joel Howard to develop an emergency plan in order to preserve and protect the resources of the Town of Charlton, and

 

            WHEREAS, the Town Architect has prepared necessary documentation to receive bids for emergency mold remediation based on evaluations of the New Town Hall existing structure as presented to the Town Architect, and

 

            WHEREAS, the Town Architect has received several bids for mold remediation, the lowest being from EDGECO Environmental, Inc. in the sum of $10,125.00, and

 

            WHEREAS, the Town Architect analyzed the EDGECO Environmental, Inc. bid in terms of compliance with the recommended treatment of current mold issues involving portions of the New Town Hall structure and has further compared the EDGECO bid with those of two other bidders presenting substantially higher bid prices for the same remedial activities, and

 

            WHEREAS, the Town Board did accept the recommendation of the Town Architect with respect to the New Town Hall mold remediation bid from EDGECO Environmental, Inc., and

 

            WHEREAS, the Town Board has been recently advised by the Town Architect that additional mold remediation is necessary and as explained on the Architect’s facsimile letter of November 26, 2007, a copy of which is attached hereto and made a part hereof as if more fully set forth herein, and

 

            WHEREAS, the Town Architect recommends that the Town Board accept the proposal from EDGECO Environmental, Inc. dated November 26, 2007, a copy of which is attached to this resolution and made a part hereof as if more fully set forth herein.

            NOW, THEREFORE, BE IT RESOLVED, that the Town Board does hereby accept the recommendation of the Town Architect with respect to the New Town Hall additional mold remediation bid from EDGECO Environmental, Inc. and hereby directs the Supervisor and the Town Architect to take whatever steps are necessary to execute the appropriate documentation and to coordinate the completion of the additional mold remediation as soon as is practicable.
