Town Board Special Meeting

November 14, 2007

The Special meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at Town Hall 784 Charlton Road, Charlton, NY 12019 called to order by Supervisor Grattidge.

 

Present:  Supervisor Grattidge, Councilman Lippiello, Councilman Gardner, Councilman Salisbury, Councilman Verola and Town Clerk Heather Scribner

 

Absent:  Town Clerk, Heather Scribner

 

The Town Board conducted interviews for the position of Town Clerk.  Four people were interviewed, Brenda Mills, Donald Morrell, Ginny DeCapria and Kimberly Caron.  Attached is a review sheet from the Records Advisory Board.  No decisions were made at that time.

 

RESOLUTIONS

 

A motion made by Councilman Lippiello seconded by Councilman Verola that Resolution No. 150 A RESOLUTION AUTHORIZING ARCHITECT J. PAUL VOSBURGHTO NOTIFY LENZ HARDWARE, INC., ON BEHALF OF THE

TOWN BOARD, THAT CERTAIN PRIME CONTRACTOR WORK NEEDS TO BE COMPLETED WITHIN THREE DAYS OF SUCH NOTIFICATION be approved:

 

Roll call vote:  Councilman Gardner: Aye, Councilman Lippiello: Aye, Councilman Salisbury: Aye, Councilman Verola: Aye, Supervisor Grattidge: Aye  Approved

 

 

Supervisor Grattidge stated that unfortunately he would have to leave the meeting.

 

The meeting was adjourned at 9:15pm.

                                                           RESOLUTION NO.150

 

 

                                                               November 14, 2007

 

 

                     A RESOLUTION AUTHORIZING ARCHITECT J. PAUL VOSBURGH

TO NOTIFY LENZ HARDWARE, INC., ON BEHALF OF THE

TOWN BOARD, THAT CERTAIN PRIME CONTRACTOR WORK

NEEDS TO BE COMPLETED WITHIN THREE DAYS OF SUCH NOTIFICATION

 

 

 

            WHEREAS, the Town Board has received written communication from Architect J. Paul Vosburgh dated November 13, 2007, and regarding certain matters involving prime contractor Lenz Hardware, Inc., a copy of which letter is attached hereto and made a part as if fully set forth herein, and

 

            WHEREAS, Architect Vosburgh has advised the Town Board that Lenz Hardware was to commence excavation for a propane tank, commencing on Monday, November 12, 2007, and which to the date of this resolution has not begun, and

 

            WHEREAS, the general conditions of the contract for construction provides a remedy as outlined in Article 2.4.1 regarding a situation where a contractor fails to complete required contract work, which provision includes a written notice from the owner received seven calendar days prior to the commencement of the contract work, and

 

            WHEREAS, acting at the request of and in a representative capacity for the Town Board, Architect Vosburgh notified Lenz Hardware, Inc. on October 30, 2007 to commence the excavation necessary to put in place a certain propane tank, and

 

            WHEREAS, as set forth in the aforementioned November 13, 2007 letter from Architect Vosburgh, prime contractor Lenz Hardware, Inc. has failed to commence such work, and

 

            WHEREAS, Architect Vosburgh has indicated that a second notice from the Town to correct such deficiencies should be provided Lenz Hardware, Inc., indicating that this prime contractor had three calendar days to commence the aforementioned excavation work set forth in the agreement between the Town Board and Lenz Hardware, Inc.

 

            NOW THEREFORE, BE IT RESOLVED, that the Town Board affirms and ratifies that the notice provided by Architect J. Paul Vosburgh to Lenz Hardware, Inc. on October 30, 2007 was undertaken by the Architect as the delegated representative of the Town and in full compliance with Section 2.4.1 of the General Conditions of the Contract for Construction, and

 

            BE IT FURTHER RESOLVED, that the Architect is hereby authorized to provide a second notice, acting in his capacity as the delegated agent of the Town, and requesting that such excavation work be commenced within three calendar days of receipt of such notification, and to further advise Lenz Hardware, Inc. what other actions will be taken by the Town Board if the prime contractor does not commence such work within the required time period.
