The Public Hearing of the
Town Board of Charlton, Saratoga County, New York held at 7:00 pm at the
Charlton Town Hall, called to order by Supervisor Grattidge.

Councilman Salisbury, Councilman Verola and Supervisor Grattidge;

read the Legal notice which was published in the official newspaper, The Daily
Gazette. The Legal Notice was placed on
the sign board at the Charlton Town Hall and also on the Charlton Web site. Legal Notice read:
PUBLIC HEARING
TOWN OF CHARLTON
PUBLIC NOTICE IS
HEREBY GIVEN, that the Town Board of the Town of Charlton will hold a
public hearing concerning a proposed local law FOR STORMWATER MANAGEMENT,
EROSION AND SEDIMENT CONTROL, AND A PROPOSED LOCAL LAW TO PROHIBIT ILLICIT
DISCHARGES, ACTIVITIES AND CONNECTIONS TO MUNICIPAL SEPARATE STORM WATER
SYSTEMS, on the 29th day of October, 2007 at 7:00 p.m. at the Town
Hall of the Town of Charlton, 784 Charlton Road, Charlton, New York, at which
time and place all persons desiring to be heard thereon will be heard.
A copy of said proposed new laws are
on file and available at the Town Clerk’s Office.

Supervisor Grattidge stated
that an article was placed in the town’s Town Board Newsletter notifying
residents of the proposed legislation.
Town Engineer Mike McNamara
stated that there are two legislations presented, as required by New York
State, which are attached hereto. The
Town of Charlton began with a Storm Water Management Program (MS4) in the year
2003.
The proposed local laws are
directly adopted from the model ordinances that the state has prepared. Mr. McNamara stated that the first proposed
law basically states someone can’t go out and directly dump any type of
pollutant into a ditch or storm sewer.
It also allows the town to disconnect any connection that exists right
now or any pollutants that may be getting in to the storm sewer. The town conducted several test at Alplaus
Kill and the area located by Charlton Heights School for pollutants. All tests have come back drinking water
quality.
Mr. McNamara stated that the second proposed law is related to any
development activity during construction, such as top soil, trees and vegetation. Mr. McNamara stated that there is a
threshold of 1 acre to do a plan. At 5
acres it would be required to more exhaustion. For example; inspections every
week or every time it rains.
Mr. McNamara stated that the
Town Planning Board put together a committee and spent time reviewing the Storm
Water Ordinance. They did have some
suggestions and comments of what they would have liked to see in the law. However, being a state mandate, the state
puts a negative incentive called a gap analysis. If the town where to put together their own, the town would have
to prove that it is better than what the state came up of.
A recommendation was made by
Mike McNamara, Saratoga County Coordinator Blue Niles and Town Attorney Robert
VanVranken to pass the model legislation for now.
Everyone was given a change
to speak who wished Supervisor Grattidge adjourned the meeting was adjourned at
7:03pm.
