County, New York held at 7:30pm at the Charlton Town Hall, called to order by
Supervisor Grattidge.

Report for October 9, 2007 Town Board Meeting
For the month of October I
attended 5 Town meetings and 9 County meetings.

SUPERVISORS
ANNOUNCEMENTS
Supervisor Grattidge
announced the following:
Supervisor Grattidge
attended a meeting at Saratoga County regarding the issuance of New York State
Driver’s License to illegal aliens. The
Saratoga County Board of Supervisors is in support of their County Clerk Marchione
who is opposing the new policy and has petitioned the Governor to rescind his
order.
A budget workshop meeting is
scheduled for October 10th and 17th at 7:00pm.
Harmony Hall has scheduled a
pie festival on October 14th from 1:00pm – 3:00pm.
An informational workshop on
the Farmland Protection grant will be held on October 23rd at
6:30pm. A copy of the grant application
is available at the Town Clerks Office.
Supervisor Grattidge stated
that the Town Clerk Heather Scribner has posted notice of public hearings for
the three fire districts regarding their 2008 proposed budgets. The meetings will be on October 16th
at 7:00pm located at their prospected districts.
A presentation of town
records was given by Town Clerk Heather Scribner. Ms. Scribner stated that the
town is participating in NYS Archives month.
SUPSERVISORS COMMUNICATIONS:
Supervisor Grattidge received a letter from the CDTA bus
transportation. The letter included an
attached route schedule. All routes are
within the Saratoga Springs City.
The town received notice from the Town of Bethlehem stating that
the town could participate in an electronic recycling day. Supervisor Grattidge stated that the town
wasn’t given enough notice to participate.
There would have been fees involved and coupons to give out.
The town received a letter from DEC regarding Flood Map
Modernization Program. Councilman
Gardner attended a meeting at the county and gave input and reviewed the flood
map where there would be potential flooding.
Supervisor Grattidge stated that he would sign the attached notice,
which indicates that the town has reviewed the map and is comfortable with the
flood map areas as presented.
Supervisor Grattidge asked the Saratoga County Emergency Coordinator to
review the flood map. He was comfortable with the map.
Supervisor Grattidge received a letter from the Army Corp. of
Engineers Water Shed Study of the Mohawk River Water Shed. The report is available at the Town Clerks
Office.

COMMITTEE REPORT
TOWN CLERK
The Town Clerk submitted a written report for September.
Town Clerk Heather Scribner stated that the Town Clerks Office
is looking for photos of residents pet dogs.
The photos will be displayed in the Town Clerks Office. A reminder was made that all dogs’ owners
are required to obtain a license for their dogs.
Town Clerk Heather Scribner thanked her deputies Tina Bublak and
Sue York for all their time spent on preserving the towns Burial Permits. A lot of time was spent on ironing each
permit as they were not in good condition.

The Town of Charlton
Planning Board last met on Monday, September 17, 2007 at Town Hall. There was a Public Hearing, three
subdivisions and one lot line change were discussed, and resolution 2007-12 was
made to approve the Bliss/Van Guilder lot line change.
1)
Gracey/Van Guilder (237-1-21.1) . . . At the August
meeting, Duane Rabideau of Van Guilder Associates came before the Planning
Board to present an application for a 2 lot subdivision on Root Road which
proposes to divide 14.53 acres owned by Kathryn Franze Gracey. The Public Hearing was held at the September
meeting and deliberation continues.

Gutto (225-1-66.1) At the March 19th meeting, Carmen Gutto came before
the Planning Board for a pre-application conference to discuss a 2 lot
subdivision of Kathryne Gutto’s 54 acre parcel which borders Division Street
and Route 67. The plan did not provide
for adequate road frontage on Route 67 and Mr. Gutto was referred to the ZBA to
apply for an area variance. The ZBA
granted Mr. Gutto an area variance, at their April 10th meeting,
which allows the existing driveway cut onto Division Street to be the only road
frontage for the parcel to be created with the existing house. The Public Hearing was held July 16th
and deliberation continues.
3)
Heflin/Durst
(255-1-40.1,41, 43.1, 43.2, 43.3) . . . In June, 2005, Dean Durst came before
the Planning Board to discuss his preliminary application for a 23 lot
subdivision on Swaggertown Road. At the
request of the applicant, the application was placed on hold in March, 2006
while issues regarding the extension of the water district were addressed as
well as allowing time to prepare the detailed engineering required by the
Planning Board. At the April 16th
meeting, the new maps received on 04/09/2007 were distributed. The Engineering escrow account has been
funded and deliberations resumed in September.

Bliss/Van Guilder (247-2-3)
. .Phyllis Bliss came before the Planning Board in June for a
pre-application conference for a proposed lot line change to add north side
setback to her parcel, located on Stage Road, from land to be purchased from
Gregory Tarte. Duane Rabideau of Van
Guilder Associates prepared and presented the survey map and application at the
September meeting, and the Planning Board granted the lot line change with
resolution 2007-12.
ZONING
A report was submitted, a copy is available at the Town Clerks
Office.
CONSTABLES
Councilman Gardner reported
that during the month of August the Constables had 26 Patrols, 3 Complaints, 11
911 calls drove 1856 miles, issued 22 tickets, 0 accidents, 0 I.E.D. and 1 EMT
calls/Fire District Assistance.

In addition to the written
report, Foreman Emerich stated the Highway Department has finished helping the
Town of Malta with their paving through the Shared Highway Services in return
for the use of their sweeper.
Currently, the highway crew is helping the Town of Galway for a few
days.
WATER
Councilman Lippiello stated Water Superintendant John Morgan is
working on the damage from lighting that was done to the electrical at the
water tank. Superintendant Morgan
requested for a meeting with the Town Board to discuss several problems which
have occurred over the years.
Supervisor Grattidge stated that Superintendant Morgan is meeting
tomorrow with the Town Board at a budget workshop. We can schedule a meeting from there.
PARK COMMITTEE
Chairman George Eggleston stated the Park Committee will be
working with the Highway Department to reconstruct the warming shelter at Elmer
Smith Park. The Park Committee is
looking into working on the gazebo at Gideon Hawley Park.
HISTORIAN
Historian Laura Linder stated that her intern Amanda Lanne had
helped put together a presentation picture tour of the Historic District.
Historian Linder received two books date from the 1800’s, School
District #1 and School District #2 which have been donated to the town. Historian Linder stated the books are in
excellent condition. Both fugitive
documents were found at the Schenectady City Hall. Historian Linder stated that she would clean the books up before
placing them with the towns other archives.

TECHNOLOGY ADVISORY
BOARD
Chairman John Tasse presented the Town Board with a
recommendation;
TAB Recommendation to the
Charlton Town Board to Obtain a New Accounting System
The TAB strongly recommends
that that the computers of the Town of Charlton should be migrated from the
current accounting system to a new, modern and up-to-date system. The current
system:

Is old and outdated
-
Is cumbersome to use
-
Is not usable with VISTA, the
latest Windows operating system – new Windows computers will all have VISTA as
their operating system
-
Does not meet state municipal
accounting requirements
-
Does not meet basic security
principals for individual access to the system

Is reliant on specific
platforms that are not always available to the Town Clerk
-
Will not function with a
server
-
Is becoming “buggy” according
to the Town Clerk and will likely need
development work to correct the bugs

functionality for tax administration

municipal accounting practices

Vulnerability depends on the
continued good health of one person
The main advantage of the
current system appears to be that it is perceived to be inexpensive compared
with a new system, but there are hidden costs associated with its
continued use, including significant numbers of hours spent resolving
issues/problems.
For
comparison purposes, the Williamson package would initially cost about $6,500,
plus installation and training and the annual support contract is $1,200, which
is only $200 more than the cost of the current system annual support. With the
hidden costs previously mentioned, the current system annual costs are probably
more.
The
TAB would like permission to explore other systems. The TAB STRONGLY recommends
that it be allowed to obtain quotes to implement the purchase and use of a new
system, now. The TAB believes that the risks associated with the continued use
of the current system make it imperative that this process be started ASAP. The
development process for the 2008 Town budget is underway now, and while migration
to a new system can be initiated at any time, it would be cleanest to implement
it at the start of the new fiscal year. The current system and new system could
be operated in parallel for some period of time until all bugs (if any) are out
of the new system and users feel familiar enough with the new system to be
comfortable with its use.
HISTORIC DISTRICT COMMISSION
Historian
Laura Linder spoke on behalf of the Historic District Commission, the
Commission members will be attending a conference, Preservation 360 in Saratoga
Springs on October 19th -21st. Deputy Historian Mitchell and Intern Amanda Lange will be also
attending.

A motion was made by Councilman
Gardner to search for and purchase a new municipal software to replace our
current MAPS software, this motion is based on a recommendation from first our
Finance Committee 2006 and now from our Technology Advisory Board tonight. This motion addresses concerns to frailty of
the current system and its inability to work with Microsoft Vista operating
system, given the fact that the system does not permit proper access controls
and separation of duties. I strongly
request the Town Board members to take the following action. That they again support the establishment of
a subcommittee made up of the Finance Committee, Town Clerk, Technology
Liaison, Selected members from each committee along with Town Supervisor, Town
Bookkeeper and Town Clerk to search for and purchase a new municipal accounting
software system, using funds in a contingency fund A-1990.4 for its purchase.
A discussion was held by the Town
Board Members. Councilman Lippiello
stated that he would like to see the documentation before making a
discussion. Councilman Verola stated
that at the time, when the Town Board met with Williamson Law, the software
they were looking into was for the Town Clerk and Highway Department. I think
it would be a good idea to look into new software programs. Supervisor Grattidge stated that he has no
problem with looking into software programs.
I think at this point, Councilman Gardner is asking for an authorization
to spend the money. Councilman Verola
stated that’s where she is confused.
She believes we are trying to do too much in one resolution. Supervisor
Grattidge stated that he would like to have enough time to review the
Technology Boards report. The
Supervisor oversees the system which handles the finances, before he can make a
discussion he will need to understand what we are talking about. Supervisor Grattidge stated that the Town
Board doesn’t need a resolution to look into software. After further discussion, a decision was
made by Councilman Gardner to withdraw his motion based upon the Town Board
members would like to review the information presented.
COUNCILMAN REPORTS
Councilman Verola stated that the Historic District
Commission and Historical Society’s joint meeting was very successful. It was incredibly informative and well
received by the town.
Councilman Lippiello stated that he also enjoyed the
meeting held by Historic District Commission and Historical Society. The speaker was amazing. He thanked Councilman Verola for getting out
the Town Board Newsletter.
Councilman Salisbury stated that this month he attended
one of the Ballston Lake library meetings.
Councilman Gardner stated that he also attended the
Historic District Commission and Historical Society’s meeting. It was excellent.
PRIVLAGE OF THE FLOOR
Mr. Tasse a resident asked, in
reference tonight’s resolution transferring funds for legal fees, is the town
currently being sued by Mr. Schmidt for the New Town Hall issues. Supervisor Grattidge stated no, at this time
no legal actions that have taken place along those lines. Earlier in the year the town incurred
additional legal expenses over the normal quarterly payments for work that had
been done connected to the town hall. A
transfer was needed tonight to get account back up. A suggestion by Councilman Verola was made for the Town Board to
have a meeting explaining where the town is at with the New Town Hall
Project. Supervisor Grattidge stated
that a report was generated during the summer, a project neutral was brought
into the job to evaluate the job. The
report is available at the Town Clerks Office and on the web site. The report gave a road map leading up to
declaring a default on the General Contractor.
Currently the town is working with the bonding company where Mr. Schmidt
had the bond with. The Town Board had to authorize an emergency contract to
enclose the building to protect the building, to protect our assets. Supervisor Grattidge stated that the Town
Board is waiting to hear from the bonding company which direction to go. Councilman Verola stated that if everything
goes the way it is supposed to, the emergency repair cost will be covered by
the bond.
Water Superintendent John Morgan
stated he will be shutting the water off at the New Town Hall site to avoid
broken pipes.
Ms Pepper a resident stated, talking
about public communication, a lot of rumors are out there regarding the New
Town Hall. The method of reading it on
the web site doesn’t reach a large population.
As far a communication, the Assessor’s office sign on door says 7:00pm –
9:00pm Tuesday night. We were told the
reason why the Assessor is not here is because he couldn’t find a place to
park. The person who was in the office
left while the office was supposed to be open.
This is how town residents are treated.
Everyone was given a chance to speak
who wished.

discuss potential litigation regarding the New Town Hall Project.

RESOLUTION ESTABLISHING A HALLOWEEN NIGHT CURFEW
WHEREAS, the Town Board has determined
that it is in the best interest of the residents of the Town of Charlton to
establish a curfew for the evening of Halloween, in order to assure the health
and safety of its residents.
NOW BE IT RESOLVED, that the Town
Board hereby determines that a curfew shall be in effect commencing at 9:00
p.m. on Wednesday, October 31, 2007 and continue until 7:00 a.m. on Thursday,
November 1, 2007, during which curfew period no child under the age of 18 years
shall be anywhere other than the property or residential dwelling of such
child’s parents, unless so accompanied by the child’s parent or guardian.

WHEREAS,
a local law entitled “Stormwater Management and Erosion & Sediment
Control”, being proposed Local Law No. 2 of 2007, a copy of which is attached
hereto, was introduced on April 30, 2007 by a member of the Town Board of the
Town of Charlton, and
WHEREAS,
a local law entitled “Local Law to Prohibit Illicit Discharges, Activities and
Connections to Municipal Separate Storm Sewer System(s)”, being proposed Local
Law No.3 of 2007, a copy of which is attached hereto, was introduced on April
30, 2007 by a member of the Town Board of the Town of Charlton, and
WHEREAS,
the Town Board desires to hold a public hearing with respect to the adoption of
said Local Laws.
NOW,
THEREFORE, BE IT RESOLVED that a public hearing be held by the Town Board with
respect to the adoption of the aforesaid Local Laws at 7:00 p.m. on October 29,

CHARLTON ANNUAL BUDGET FOR 2008
WHEREAS, under provisions of the New
York State Town Law, the Town Board of the Town of Charlton is required to
conduct a public hearing with respect to the consideration of the Town’s annual
budget, and
WHEREAS, the Town Board hereby
determines that the annual budget public hearing for the year 2007 shall be
held at the Town Hall on Monday, October 29, 2007.
NOW BE IT RESOLVED, that the Town
Board will meet at the Town Hall on October 29, 2007 at 7:10 p.m., at which
time and place it shall consider comments from residents of the Town of Charlton
concerning proposals with respect to the annual Town budget for the year 2008,
and
BE IT FURTHER RESOLVED, that the

RESOLUTION AUTHORIZING THE SUPERVISOR TO
EXECUTE AGREEMENTS
NECESSARY TO PROVIDE
FIELD OFFICE
FACILITIES AND PORTABLE TOILETS
FOR THE NEW TOWN
HALL WORK SITE
WHEREAS, the Town Board did by
Resolution No. 135 and dated September 24, 2007, accept the recommendation of
the Town Architect with respect to the New Town Hall emergency enclosure
contract bid and did direct the Supervisor and the Town representatives to take
whatever steps necessary to execute documentation with Rosch Brothers, Inc. to
complete certain structural items with respect to the New Town Hall, and
WHEREAS, in order to provide
necessary field office facilities and portable toilets for the emergency
general contractor and the other New Town Hall prime contractors, the Town has
received a quote from Quik Space for a field office facility necessary to meet
the needs of contractors providing services to the New Town Hall, a copy of
which Quik Space proposal is attached to this resolution, and
WHEREAS, the Town has also received
a proposal from Charlton Septic Service to provide portable toilet facilities
for the New Town Hall project at a cost of $100.00 per month.
NOW, THEREFORE, BE IT RESOLVED, that
the Supervisor is hereby authorized to enter into any agreements necessary to
accept the offer of Quik Space to provide portable office facilities at a rate
of $210.00 per month for a six month period, together with delivery and pick up
charges of $107.50 each and to further enter into any agreement necessary to
accept the offer of Charlton Septic Service to provide portable toilet
facilities at the rate of $100.00 per month.

SUPERINTENDENT TO
PREPARE BID SPECIFICATIONS

FOR BIDS TO PROVIDE THE

WITH ICE CONTROL SAND
WHEREAS, in order to meet its
obligations to the residents of the Town of Charlton, the Town Highway
Department needs to have available screened sand for the purpose of ice
control, and
WHEREAS, the Town Highway
Superintendent has the necessary expertise to prepare bid specifications in
order to assure that the quantity and quality of ice control sand will be
available to the Town Highway Department during the period October 1, 2007 -
May 1, 2008 as may be needed to meet Town Highway Department obligations.
NOW BE IT RESOLVED, that the Town
Highway Superintendent is hereby authorized to prepare bid specifications
necessary to obtain ice control sand in sufficient quantity and of sufficient
quality to meet the needs of the Town Highway Department for the period October
1, 2007 - May 1, 2008, and
BE IT FURTHER RESOLVED, that the
Town Highway Superintendent is hereby authorized to advertise for sealed bids
for such ice control sand, which bids shall be received by no later than 1:00
p.m. on Monday, November 12, 2007 and that such bids will be opened at 7:30
p.m. during the regularly scheduled meeting of the Town Board held on November
12, 2007.

RESOLUTION AUTHORIZING THE TOWN ARCHITECT
TO
PREPARE BID SPECIFICATIONS FOR MOLD
REMEDIATION TO THE
NEW TOWN HALL
WHEREAS, the Town did direct its
professional advisors, including Architect Paul Vosburgh, Owners Representative
Anthony Ward and Special Counsel Joel Howard to develop an emergency plan in
order to preserve and protect the resources of the Town of Charlton and as
authorized by the Town Board on September 12, 2007 in Resolution No. 132, and
WHEREAS, the Town Architect has
prepared a Notice to Bidders, specifications and proposed AIA contract for mold
remediation to the New Town Hall, and
WHEREAS, these documents have been
distributed by the Architect to mold remediation companies, advising that bids
should be received by 2:00 p.m. on Thursday, October 25, 2007 by delivery to
the Town Clerk of the Town of Charlton, and
WHEREAS, the Town Board desires to
also publicly notice this bid request by publication in the Daily Gazette, the
Town designated newspaper, and which notification should be made as soon as is
practicable.
NOW BE IT RESOLVED, that the Town Clerk
is hereby requested to advertise for mold remediation bids in the Daily
Gazette, with publication to be as soon as possible and with the bids to be
received by no later than 2:00 p.m. on Thursday, October 25, 2007 by delivery
to the Town Clerk of the Town of Charlton.
