County, New York held at 7:30pm at the Charlton Town Hall, called to order by
Supervisor Grattidge.
Present: Councilman Gardner, Councilman Lippiello,
Councilman Salisbury, Councilman Verola, Supervisor Grattidge and Heather

Supervisor Grattidge lead the pledge of Allegiance.

A motion was made by Councilman Lippiello seconded by

SUPERVISORS REPORT
Supervisors Report for September 10, 2007 Town Board Meeting
For the month of August I attended 6 Town meetings and 9
County meetings.
Some of the highlights of the month:
Attended numerous meetings concerning the New Town Hall
project delay in schedule
Attended training for the Reverse 911 System
Marched in the Ballston Spa Bicentennial Parade
Attended the Saratoga County Honor Our Deceased Veterans
program and presented a Town Proclamation in honor of Maurice B. Suits
SUPERVISORS
ANNOUNCEMENTS
Supervisor Grattidge announced the following:
There will be a NYS DOT Land Use & Transportation
Connection Planning Conference on October 3rd.
The NYS Department of Agriculture and Markets announces its
release of grant application.
The NYS Department of State announces funding for Shared
Municipal Services Incentive Grant Program.
The Town Board will hold Budget workshop meetings on October
3rd at 3:00pm, October 10th and October 17th
at 7:00pm. Supervisor Grattidge stated
that the Town Board will meet on October 10th with those wishing to
discuss their 2008 budget.
Supervisor Grattidge announced that the Records Advisory
Board will be displaying preserved records at the October Town Board Meeting.
SUPSERVISORS
COMMUNICATIONS:
Supervisor Grattidge stated that the Town Board received a
letter from Harry Stoll concerning the noise from the off road recreational
vehicles. It is asked that the town start discussing Local no. 1 of 1996. Supervisor Grattidge read the letter.

Attorney VanVranken stated that the town has a contact
person for the property owners.
Attorney VanVranken suggested producing a follow up letter from Attorney
VanVranken to Attorney Sutton. The
letter could simple state that the town received another complaint. Attorney VanVranken stated that the second
response could be to move forward with a Local Law violation.
Councilman Gardner stated that the complaint comes to the
Town Board, we are the legislative end of this government, and the law is on
the books. If the people have a complaint
they should file it with the appropriate people. That would be the constables.
Councilman Verola stated that the Town Board is not the enforcement end
of this Local Law. Councilman Gardner
stated that they should make a formal complaint through the proper
sources. Councilman Verola stated that
the Town Board makes the laws we don’t enforce them. Attorney VanVranken stated that the Town Board received a formal
complaint. The Town Board has some
reason to respond. The response could
be, file a claim. Attorney VanVranken
stated that the violation of this fine if convicted is no more than
$100.00. Supervisor Grattidge stated
that as these complaints came in we have made copies to the Constables and
Zoning Administrator. Councilman
Gardner stated that he believes that this complaint is not a Zoning issue. Attorney VanVranken stated that the Local
Law states that any violator may be sited by any Peace Officer or served with
notice to appear upon complaint shall appear in the Town Justice Court in the
time of complaint. Councilman Verola
stated this would be the Constables.
Councilman Gardner stated that a notice needs to get back to the
petitioner. The Town Board is not the
law enforcement. Attorney VanVranken
stated that the letter the Town Board received is an allegation of the
law. Attorney VanVranken suggests
informing Attorney Sutton that another letter of complaint was received. A
notice can be written to the plaintiff that they received their ordinance if
you are not satisfied, you have a process.
That would be to call the Town Constables and file a complaint. Attorney VanVranken stated that this
complaint could be resolved neighbor to neighbor. Councilman Gardner stated that the Town Board can’t keep talking
about this, it needs to be resolved.
The Town Board agreed to have Attorney VanVranken write a
letter to Mr. Stoll stating the process.
He will also write a letter to Attorney Sutton notifying him that the
Town Board has received another complaint.
Attorney VanVranken stated that he clearly understands what the Town
Board wants and will copy the Town Board with the letters.
DEPARTMENT &
COMMITTEE REPORT
ENVIRONMENTAL
CONSERVATION COMMISSION (ECC)
Chairman Marv Schorr stated that there is no new business to
report. Supervisor Grattidge stated
that the town received a bill for the Hazardous Waste Collection Day. The cost of the event totaled $6,772.57
although the town will receive a 50% state reimbursement. Chairman Schorr stated that the state offers
this funding on a yearly basis. He
would like to see the Hazardous Waste Program done each year, at least enough
times where the town could see it declining.
The Town of Clifton Park participates each year with two neighboring
towns. They are on their 13th
year. Chairman Schorr stated that prior
to the recent collection it was five years ago. The town budgets for it each year. The problem is getting the Town of Milton to participate. They are the biggest contributors. Chairman Schorr stated that this year’s
collection day ran very smoothly.

The Town of Charlton Planning Board last met on Monday,
August 20, 2007 at Town Hall. There
was a Public Hearing, three subdivisions were discussed, and resolution 2007-11
was made to approve the Markham subdivision.
Markham
(236-1-122) Owner Stephen
Markham applied to the Planning Board for a 2 lot subdivision of a 19+ acre
parcel on Cook Road. A couple of years
ago, before a lot line change, this land existed as 2 separate parcels. The Public Hearing was held August 20th
at 7:45 PM and the subdivision was approved with resolution 2007-11.
Gutto
(225-1-66.1) At the March 19th
meeting, Carmen Gutto came before the Planning Board for a pre-application
conference to discuss a 2 lot subdivision of Kathryne Gutto’s 54 acre parcel
which borders Division Street and Route 67.
The plan did not provide for adequate road frontage on Route 67 and Mr.
Gutto was referred to the ZBA to apply for an area variance. The ZBA granted Mr. Gutto an area variance,
at their April 10th meeting, which allows the existing driveway cut
onto Division Street to be the only road frontage for the parcel to be created
with the existing house. The Public
Hearing was held July 16th and deliberation continues.
Gracey/Van Guilder
(237-1-21.1) . . . At the August meeting, Duane Rabideau of Van
Guilder Associates came before the Planning Board to present a new application
for a 2 lot subdivision on Root Road which proposes to divide 14.53 acres owned
by Kathryn Franze Gracey. The Public
Hearing was scheduled for September 17th at 7:45 PM.
Heflin/Durst
(255-1-40.1,41, 43.1, 43.2, 43.3) . . . In June, 2005, Dean Durst came before
the Planning Board to discuss his preliminary application for a 23 lot
subdivision on Swaggertown Road. At the
request of the applicant, the application was placed on hold in March, 2006
while issues regarding the extension of the water district were addressed as
well as allowing time to prepare the detailed engineering required by the
Planning Board. At the April 16th
meeting, the new maps received on 04/09/2007 were distributed. Since the August report, the Engineering
escrow account has been funded.
Councilman Verola stated that a refund for an application
fee was requested by Elaine Nigriny.
Councilman Verola stated that the town should send a letter to Ms.
Nigriny stating that application fees are not refundable. It is clearly stated in the application
forms. Councilman Verola and Planning
Board Clerk Susan York will draft the letter.
ZONING
A report was submitted, a copy is available at the Town Clerks
Office.
Zoning Administrator Dave LaFountain gave an update
regarding a situation on Waite Road.
Mr. LaFountain stated that numerous unregistered vehicles were found on
site. Also found was a building that
was built without a permit. At this
point the property owner was issued 3 notices of complaints. Mr. LaFountain stated that he inspected the
property today and most vehicles were gone.
Councilman Gardner raised a question if the town can keep an eye on the
property once they become compliance to ensure that this doesn’t occur
again. Attorney VanVranken stated that
it would prudent to send a letter giving an evaluation as to where it stands
and indicate that the Zoning Administrator will be looking at the property
every six months.
CONSTABLES
Councilman Gardner reported that during the month of August
the Constables had 31 Patrols, 3 Complaints, 6 911 calls drove 2095 miles,
issued 31 tickets, 0accidents, 0 I.E.D. and 0 EMT calls/Fire District
Assistance.

Highway Foreman, Mike Emerich
WATER
Councilman Lippiello stated that the Water Tower was hit by
lightning causing the light to blow located at the top of the tower. It was replaced by a temporary light. Warren
Electric will be replacing the temporary light with a new the light. Damage was caused to the telemetry that
signals the pumps turn on and off.
Since then Superintendent Morgan and his assistant have been running the
pumps manually. A new telemetry is
scheduled to come in over the weekend.
To avoid freezing during winter a few pipes that are exposed
to the surface on Stage Road will need lowering. Councilman Lippiello stated that drainage behind the pump house
is still giving problems.
Superintendent Morgan will have someone drain line half way up the hill
to bring the water down.
Councilman Lippiello stated that Superintendent Morgan and
Assistant Russell have been working many hours to keep the water going. Supervisor Grattidge stated that he received
a call regarding water coming out of the out flow. That is one way to tell that the tank is full.
RECORDS ADVISORY
BOARD
Chairman Heather Scribner stated that the Records Advisory
Board met last month and discussed displaying town records for archives
month. Also discussed were burial
permit records and the need for preservation.
Currently the Town Clerks Office is working on pressing folded burial
permit records and placing them in archival sleeves along with indexing
them. Chairman Scribner stated that
some of the permits date back to the early 1800’s and are fading.
Chairman Scribner stated that she is working on the next
grant project.
HISTORIAN
Historian Laura Linder announced the following events:

Historian Linder and Deputy Historian Dorothy Mitchell
attended the Deceased veterans Ceremony at the Saratoga County.
Historian Linder stated that she judged costumes at the
celebration of the Ballston Bicentennial on August 27th.
Historian Linder stated that she will be representing the
Town of Charlton at the NYS Archives Diner at Long Fellows Restaurant.
Councilman Verola encouraged all members of the Town Board
to attend the October 3rd Historic District Commission Meeting.

COUNCILMAN REPORTS
Councilman Gardner stated that he attended a meeting regarding
the reverse 911 system. He had attended
a county meeting related to flooding.
Councilman Gardner stated that he doesn’t foresee any issues with
flooding for Charlton.
Councilman Verola stated that she attended several meetings
regarding the New Town Hall. Councilman
Verola asked that the Highway Department to open their own account with Scotia
Motors rather than it coming through on the invoice as Water Department. Highway Foreman Mike Emerich will take care
of it.
Councilman Lippiello stated that he has nothing else to add.
Councilman Salisbury stated he has attempted to make telephone
calls to the audit company who will review the National Grid bills to verify
any over payments. They have been
missing each others calls.
PRIVLAGE OF THE FLOOR
George Eggleston
asked the Town Board to give an overview of the Town Hall Project. Supervisor Grattidge stated that the Town
Board is in the process of talking to the contractors bonding company. The Town Board is at the point of making a
very major decision made this week.
Historian Linder
thanked the Town Board for supporting Amanda Lanne as an intern to the Historians
Department. Ms. Lanne introduced
herself. She said she is a graduate of
the Burnt Hills Ballston Lake High School class of 2002. Ms. Lanne is currently in the Graduate
program at SUNY Albany. Ms. Lanne
stated that her interests are in Historic Preservation.
Ed Snyder stated
that he would like to have the speed reduced on North Division Street. The street is presently unmarked which makes
the speed limit 55. Mr. Snyder stated
that there is a lot of motorcycle activity but most of all there is a camp
ground located at the end of the street.
Mr. Snyder stated that with many travelers who are out of state may not
protect the area as if it were their own.
There have been many cars that have gone off the road. The motorcycle speed is off the wall. One motorcyclist was clocked going the speed
of 70. There are new residents with
children which raise safety concerns.
Mr. Snyder stated that the street runs straight and has acted as a drag
strip. Mr. Snyder inquired about the
process of speed reduction. Supervisor
Grattidge asked Mr. Snyder to send the Town Board a formal letter requesting
for a speed limit reduction. In the
past, it has helped when other neighbors sign the letter. Supervisor Grattidge
suggests sighting the number of school bus stops and number of families. Upon submission, the Town Board would ask
the Highway Department and possibly the Constables to give an evaluation. At that point a request for survey of speed
would be forward to the Saratoga County Public Works. The Public Works then will pass it to the NYS Department of
Transportation. The NYS DOT will come
out and survey and give judgment whether the stretch of road warrants a speed
reduction. Supervisor Grattidge
suggested to Mr. Snyder not to include a specific speed limit. Supervisor Grattidge stated that the town is
not allowed to set its speed limit because of the size of the town.
Everyone was given
a chance to speak who wished.

by Councilman Verola seconded by Councilman Gardner to enter into an executive
session to discuss potential litigation regarding the New Town Hall
Project. They will also discuss a
personnel issue.

SUPERINTENDENT TO PREPARE BID
SPECIFICATIONS
AND ADVERTISE FOR BIDS TO PROVIDE
THE
TOWN WITH ICE CONTROL SAND
WHEREAS, in
order to meet its obligations to the residents of the Town of Charlton, the
Town Highway Department needs to have available screened sand for the purpose
of ice control, and
WHEREAS,
the Town Highway Superintendent has the necessary expertise to prepare bid
specifications in order to assure that the quantity and quality of ice control
sand will be available to the Town Highway Department during the period October
1, 2007 - May 1, 2008 as may be needed to meet Town Highway Department
obligations.
NOW BE IT
RESOLVED, that the Town Highway Superintendent is hereby authorized to prepare
bid specifications necessary to obtain ice control sand in sufficient quantity
and of sufficient quality to meet the needs of the Town Highway Department for
the period October 1, 2007 - May 1, 2008, and
BE IT
FURTHER RESOLVED, that the Town Highway Superintendent is hereby authorized to
advertise for sealed bids for such ice control sand, which bids shall be
received by no later than 1:00 p.m. on Tuesday, October 9, 2007 and that such
bids will be opened at 7:30 p.m. during the regularly scheduled meeting of the
Town Board held on October 9, 2007.

Public History at the State University of New York at Albany, to serve as an
intern for 20 hours per week for the 2007-2008 academic year, and
WHEREAS,
attached to this resolution is a detailed memorandum from the Town Historian to
Councilwoman Sandra Verola describing the content of such program, the
credentials of the intern and the projects to be worked on during the said
academic year, and
WHEREAS,
the appointment of such intern will provide substantial additional services to
complete the work of the Town Historian and which services will be provided on
a voluntary basis and at no cost to the Town.
NOW BE IT
RESOLVED, that the Town Board hereby appoints Amanda L. Lanne as voluntary
intern to the Office of Town Historian for the Town of Charlton, for the period
September 10 – May 31, 2008 and which intern services shall be provided on a
voluntary basis.

Introducing Amanda
Lanne, Intern in Public History
The Office of Town Historian is very pleased and excited to
have a graduate student in Public History at the State University of New York
at Albany serving as an intern for twenty hours a week for the 2007-2008
academic year. Amanda L. Lanne began her internship September fifth and will be
with us through May earning required credits for her degree and gaining
numerous experiences she may add to her resume.
Amanda is a graduate of St. Michael’s College, Burlington,
Vermont, with a degree in History. Her courses during her first year studying
Public History included Introduction to Public History, History of American
Architecture, Readings in U.S. History, and Museum Studies. Research projects
were focused on the Saratoga Automobile Museum and Dutch barn architecture.
Amanda has had a lifelong interest in history, and first
became acquainted with Charlton’s history in elementary school at Charlton
Heights. In Burnt Hills-Ballston Lake High School she started helping at the
annual Memorial Day decoration of veterans’ graves in Charlton cemeteries, and
has returned to help for five years. She is particularly interested in historic
homes and architecture, and looks forward to becoming more aware of various
aspects of professions in history.
This internship will be a wonderful and beneficial
opportunity for both Amanda and the Town of Charlton. Projects to be worked on
include:
Programs taking place in Charlton for NY State Archives
Month
Help prepare a PowerPoint presentation for the October 3
Charlton Historical Society program in conjunction with the Charlton Historic
District Commission. It will be a photographic tour of the historic district
with narration of informational and instructive comments on architectural
features and preservation of its homes and other buildings by Julian Adams of
the NY State Department of Parks, Recreation and Historic Preservation.
Resurvey the Charlton Historic District with the Charlton
Historic District Commission and the NY State Department of Parks, Recreation
and Historic Preservation.
Assist in preparing records, including computer files, of
the Town Historian’s Office for move to new town hall
Assist Town’s Records Advisory Board in conservation of
town’s Burial Permits File
Update photo and clippings files
Map graves of veterans in cemeteries of Charlton
Assist with Saratoga County Green Infrastructure Plan
Help plan town and county Explore 400 Hudson/Champlain
Quadracentennial events
Dutch Barn Survey
Help form new Charlton History Committee according to
Charlton Comprehensive Plan
Attend Association of Public Historians of NY State,
regional and county meetings along with two annual history conferences
Attend Local Government Records Management Workshops
Help County with Charlton section of publication of a
directory of historic site markers
Help design new historic site marker for Charlton on West
Charlton hamlet
Monthly reports to Town Board
Attend meetings of Town Board, Charlton Historical Society,
Charlton Historic District Commission, Records Advisory Board, Party in the
Park Committee, etc.
Assist with annual Charlton history class for Charlton
Heights fourth grades
Annual Memorial Day and Founders Day activities, e.g.,
marking veteran’s graves, Party in the Park, parade
Amanda is the daughter of Chris and Cindy Lanne of Scotia.
In addition to her studies, she is Acquisitions Assistant for SUNY Press of
Albany.

FOR
ADDITIONAL ENGINEERING SERVICES
WHEREAS,
the town established account A-1440.4 –Engineering – Contractual which is used
for engineering escrows, in order to meet obligations of additional engineering
service escrows a transfer of funds is necessary.
NOW BE IT
RESOLVED, that the Town Board hereby authorizes the transfer of the sum of
$2,500.00 from Town Account No. A-1990.4 - Contingency to Town Account No.
A-1440.4 - Engineering Contractual for additional engineering services.
