Agenda Meeting

The Agenda meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30 pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Lippiello, Councilman Salisbury, Councilman Verola, Supervisor Grattidge and Town Attorney Robert VanVranken.

 

Supervisor Grattidge announced that this meeting is to set the Agenda for the Regular Meeting of the Town Board on Monday, September 10, 2007.

 

ABSTRACT OF CLAIMS

 

A motion was made by Councilman Verola seconded by Councilman Gardner authorizing the town clerk to prepare abstract 116 claims no. 1655-1674 totaling $40,550.01 as audited by the Town Board.  Approved

A motion was made by Councilman Verola seconded by Councilman Lippiello authorizing the town clerk to prepare abstract 7708 claims no.704-707 totaling $2301.47 as audited by the Town Board.  Approved

Councilman Verola referred to a telephone bill from Corner Stone.  Councilman Verola stated that while she was  reviewing the town’s vouchers she found some unusual long distance phone calls on the Corner Stone bill.  A call was made to Florida and to Poughkeepsie.  Supervisor Grattidge stated that the calls to Poughkeepsie were made to the Town Hall Architect’s cell phone.  Councilman Verola stated that none of the charges were large amounts of money.

 

Supervisor Grattidge announced that the Town Hall will be closed Labor Day September 3rd.

 

Supervisor Grattidge received a notice from the Town Clerk stating that the town will not hold a Primary Election Day.

 

Supervisor Grattidge stated that the Saratoga Board of Supervisors announces a free concert at the Saratoga Performance Arts Center on September 21st by the United States Army Field Band and Soldiers Chores.  Tickets are available through the Town Clerks Office at free of charge.

 

Supervisor Grattidge attended the Saratoga County Deceased Veterans Ceremony.  The County asked each town to select a deceased veteran from their town.  The Town of Charlton honored Maurice Suits.  Supervisor Grattidge stated that it was a very nice program.  Town Clerk Heather Scribner will place the program flyer with the record of Proclamation Honoring Maurice Suits.

Supervisor Grattidge discussed a situation which occurred on Jenkins Road with a number of unlicensed dogs.   Animal Control Officer Lee Bramer stated that he received a call last Thursday evening and at the time the Town of Ballston Animal Control Officer was on the scene, he was unable to be present.  Mr. Bramer stated he has since then visited the owner of the dogs and feels that there doesn’t seem to be animal cruelty involved.  Mr. Bramer stated at that time he found out that one of the dogs had a litter of puppies.  The dogs were unlicensed.  Mr. Bramer stated that the owner had thought she had received a NYS license for all the dogs when she received an AKC purebred license.  Mr. Bramer stated that the license from the NYS Department of Agriculture and Market is different.  All dogs must have a NYS dog license.  The dog owner came right into the Town Clerks Office to licensed all 6 adult dogs.  Mr. Bramer stated that he has visited the dog owner’s home, they were not home.  He saw two dogs out side.  Nothing appeared unusual.  Mr. Bramer stated that he was told by the Officer who issued the fine that there were other animals.  Mr. Bramer stated that the dogs now are vaccinated and licensed.  At this time there is not anything in the Zoning Ordinance that he require of the dog owner.

 

Supervisor Grattidge stated that the Local Law of 1978, addressing dog’s issues could be one of the items the Zoning Ordinance Review Committee (ZORC) could review.  Councilman Verola stated that the  ZORC Committee has already reviewed and researched the Local Law and has recommendations.  The Town Board discussed the issues of how many dogs residents should be allowed to have.  Councilman Verola stated that she doesn’t think that the town can put a limit on it as long as they are licensed.  Supervisor Grattidge stated that the in this situation the Officer felt that the women was endangering the welfare of her children.  Councilman Gardner stated that he doesn’t think on a town level we can do anything.  It would be at a county or stated level.  Councilman Verola stated that she has seen homes without animals that are dangerous for children.  Where do we draw the line.  Councilman Gardner stated we have to cautious of what the issue is here.  There are a number of people who have another of animals who take care of them fine.  It is a lot of maintenance and a lot of care.  Councilman Lippiello stated that the issue is with the condition of where the children are living.  Supervisor Grattidge suggested that the ZORC bring forward any of their recommendations and also ask Lee Bramer to provide any Agriculture and Markets law guidance he may have to update Local Law of 1978.  Mr. Bramer stated that he has not seen any where in the Agriculture and Markets Law regarding how many dogs people can have.

 

Supervisor Grattidge announced that the Planning Board will hold a public hearing on September 17th at 7:45pm on the lands of Franze located on Sweetman Road and Root Road.

 

Supervisor Grattidge stated that he received a letter from Attorney William Keniry concerning law suits the town has been served with.  As he deals with the Article 78 it is not part of his retainer. 

 

Supervisor Grattidge stated that it was asked of the Town Clerk concerning a refund regarding Elaine Nigriny’s subdivision application.  Supervisor Grattidge stated that it was addressed a few meetings ago that there will be no refund.  Supervisor Grattidge stated that the town’s application fees are non-refundable.

 

Supervisor Grattidge stated that he received a letter from the Zoning Board of Appeals Chairman asking not to be reappointed as Chairman next year.  She will be resigning from the Zoning Board of Appeals as of December 31, 2007.

 

Supervisor Grattidge stated that the Secretary to the Zoning Board of Appeals would be resigning as Secretary on December 31, 2007.

 

Supervisor Grattidge received a notice from the Department of Agriculture stating that they have postponed the Farmland protection grant applications.  Supervisor Grattidge received a quote from Beham Associates to provide services in preparing the grant application.   The town also received a quote from ELAN Planning.

 

Supervisor Grattidge stated that the sales tax has improved last month.  The mortgage tax is disbursed twice a year.  There are monthly notices of what they think is coming.  Supervisor Grattidge stated that he believes we will be over what was budgeted.

 

Supervisor Grattidge received an email from National Grid to review the towns National Grid account.  Supervisor Grattidge stated that he spoke to Councilman Salisbury regarding an independent audit on electric service.  Councilman Salisbury stated that he would ask the company to negotiate the fee of what ever the company recovered, rather than spreading it out over a two year span.  Councilman Salisbury stated that he has thought about it and feels that we may be charged more money.

 

Supervisor Grattidge stated that Councilman Lippiello inquired about putting CoAx cable wire into the New Town Hall in the event to have cable available.  Supervisor Grattidge stated that the town will be using the Town Hall for an emergency shelter.  The cable wire was not included in the original plan.  Supervisor Grattidge stated that he has spoken with the Electrician running CoAx at the time of running other wiring in the building is fairly easy.  The cable T.V. is available to municipalities at no charge.  Councilman Verola suggested to run the wire to the main meeting room.  Councilman Lippiello stated that Time Warner Cable Company will supply the cable wire.

 

Supervisor Grattidge stated that for the September 10, 2007 meeting the following resolution will be prepared;  Authorizing the Highway Superintendent to prepare bid specifications to provide the Town with Ice Control Sand.

 

Supervisor Grattidge stated that he would be preparing a Proclamation for Harmony Fire Department, Galway Ambulance and Constable Ken Almay who assisted with CPR on a baby who that was delivered at home a year ago.  A helicopter was flown in and the baby was taken to Albany Med.  The baby is now doing fine.  Supervisor Grattidge stated that it would be on the Agenda for October.

 

 

COUNCILMAN REPORTS

 

Councilman Verola stated that she would like the Town Board to work on establishing a Policy for Cell Phone use.  Councilman Verola researched the Employee Handbook and it does not deal specifically to cell phones.  The policy could include replacement of cell phone, when it can be replaced and conditions.  Councilman Verola would research information. 

 

The Town Board discussed the use of pagers.  Highway Foreman Mike Emerich stated that cell phones do not work in all areas.  Foreman Emerich stated that the way the pagers are used for example is when the cell towers are down.  Foreman Emerich stated that he and the Superintendent can contact one another in the event of any emergency situations.   The new cell phones that the Supervisor Grattidge and I use do not need cell towers they act as Walkee Talkee’s, although the range is for up to maximum 6 miles.  A pager can be used anywhere.  Foreman Emerich stated that the Highway crew has pagers.  It works well when they are called in unexpectedly.

 

Councilman Lippiello stated he has met with Water Superintendent John Morgan and Jim Mitchell of EDP Engineering to discuss the painting of the water tower and addressing low water pressure at the North end of town when the tower is out. This problem occurred while doing the last project.  Mr. Mitchell is looking into a few possibilities of temporary hookup.  Councilman Lippiello stated that Water Superintendent will be meeting at the end of September with and inspector regarding the painting of the water tower.

A motion was made by Councilman Verola seconded by Councilman Gardner to enter into an executive session to discuss potential litigation of contractual issues with the New Town Hall Project.

The Town Board reconvened from Executive Session at 9:26 p.m. followed were two resolutions pertaining to the Town Hall Project.

       August 27, 2007

 

 

                    A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS

               FOR ADDITIONAL ENGINEERING SERVICES

                     

                     

           

            WHEREAS, the town established account A-1440.4 –Engineering – Contractual which is used for engineering escrows, in order to meet obligations of additional engineering service escrows a transfer of funds is necessary.

 

            NOW BE IT RESOLVED, that the Town Board hereby authorizes the transfer of the sum of $2,000.00 from Town Account No. A-1990.4 - Contingency to Town Account No. A-1440.4 - Engineering Contractual for additional engineering services.
