The Regular meeting of the Town Board of Charlton, Saratoga
County, New York held at 7:30pm at the Charlton Town Hall, called to order by
Supervisor Grattidge.
Present: Councilman Gardner, Councilman Lippiello,

Supervisor Grattidge lead the pledge of Allegiance.
APPROVAL OF MINUTES
A motion was made by Councilman Lippiello seconded by Councilman

SUPERVISORS REPORT
Supervisors Report read for August
2007:
For the month of July I attended 6 Town meetings and 5
County meetings.
Some of the highlights of the month:

Attended numerous meetings concerning the New Town Hall
project delay in schedule

Met with a representative from the Red Cross to discuss future
emergency planning
SUPERVISORS
ANNOUNCEMENTS
Supervisor Grattidge stated that on Saturday August 18th
the Village of Ballston will be celebrating their Bicentennial with a Parade
and Family Fun Day at the Fair Grounds.
The Highway Department will represent the town by providing a float
carrying Charlton’s Fife and Drum Corp.
Supervisor Grattidge announced that the Saratoga County Office
of Emergency Services will offer training on the reverse 911 system. Supervisor Grattidge asked Councilman Gardner
and Lippiello to attend. The system was
currently used by the Town of Waterford where calls were sent out to residents
to boil water. The system worked well.
The NYS of Environmental Conservation announced a flood map
modernization program Saratoga County.
Supervisor Grattidge stated that he has been working with Paul Lent,
Saratoga County Emergency Service Coordinator to see what the implementations
are. ECC Chairman Marv Schorr asked how
the flood map differs from the FEMA flood maps. Councilman Gardner stated that it is an update. Supervisor Grattidge stated that new flood
maps will be issued as part of the new GSI compatible county wide mapping
format.
Supervisor Grattidge stated that the Architect for the Town Hall
project has passed on information from Clune Electric information regarding
additional work to the emergency generator.
This is to isolate the elevator on a separate circuit and enabling the
Town Hall to run in the event of a power outage.
Supervisor Grattidge received communication from National
Grid. National Grid will be doing
upgrades to their existing transmission lines.
Supervisor Grattidge stated that the National Grid will be in the area
of Charlton Road and Lasher Road.
Supervisor Grattidge passed on correspondence from ELAN
planning. ELAN planning is in
reference to the Department of Agriculture Grant. The grant application will be available sometime in August. Supervisor Grattidge suggested on seeing
what the grant seminar will be like through the Saratoga County and go from
there. Then make a decision on whether
to have ELAN planning assist with the grant.
Supervisor Grattidge received a letter from Eva Butler, Chairman
of the Assessment Review Board. The
letter read: (see attachment 2)
Supervisor Grattidge announced that the final equalization rate
for the Town of Charlton is 70%.
Supervisor Grattidge stated that the Supervisor’s Office has
sent out a memorandum to all departments requesting 2008 budget requests.
DEPARTMENT &
COMMITTEE REPORT
ENVIRONMENTAL
CONSERVATION COMMISSION (ECC)
Chairman Marv Schorr stated that the Town of Charlton had a
successful Hazardous Waste Collection Day.
That day approximately 500-600 vehicles participated in the event. The Town of Charlton had about 90
vehicles. The day went flawless. Chairman Schorr stated that he received
several calls on how great the program was.
Supervisor Grattidge stated that he speaks for the entire Town Board on
how much the volunteers from the ECC are appreciated. Chairman Schorr stated that he appreciated the help of the Town
Board putting pressure on other towns to be included in the program.
ZONING ORDINANCE
REVIEW COMMITTEE
Chairman Schorr stated that the committee is putting together a
list of changes to the Zoning Ordinance that were recommended prior to the
Comprehensive Plan. The committee
worked through the existing Zoning Ordinance and not too many changes were made. The first meeting will be sometime in
September. Chairman Schorr will provide
a list to the Town Board of suggested changes.
Supervisor Grattidge stated that the cell tower local law should be
brought forward for review. Chairman
Schorr stated that he would like to meet with the Zoning Administrator to
review the list of items.
TOWN CLERK
Town Clerk submitted report for July:
Town Clerk Heather Scribner stated that she had met with the NYS
Archives Regional 4 Officer to discuss future grants for the Town of Charlton. Town Clerk Scribner stated that they
discussed resubmitting a grant application which was denied last year. The grant would include a computer server
for the Town of Charlton and software for records. Town Clerk Scribner stated that she would be working with the
Technology Committee on the computer aspect.

The
Town of Charlton Planning Board last met on Monday, July 16, 2007 at Town
Hall. There was a Public Hearing,
three subdivisions were discussed, and resolution 2007-10 was made to deny the
Nigriny-Durst application.
1)
Gutto
(225-1-66.1) At the March 19th
meeting, Carmen Gutto came before the Planning Board for a pre-application
conference to discuss a 2 lot subdivision of Kathryne Gutto’s 54 acre parcel
which borders Division Street and Route 67.
The plan did not provide for adequate road frontage on Route 67 and Mr.
Gutto was referred to the ZBA to apply for an area variance. The ZBA granted Mr. Gutto an area variance,
at their April 10th meeting, which allows the existing driveway cut
onto Division Street to be the only road frontage for the parcel to be created
with the existing house. The Public
Hearing was held July 16th and deliberation continues.
2)
Nigriny/Durst (247-1-50.12)
At
the February meeting, Dean Durst came before the Planning Board for a
pre-application conference to discuss the concept plan for a 2 lot subdivision
of a parcel on the corner of Jenkins Road and Sweetman Road. The prior attempt to subdivide this parcel
failed when the ZBA denied an area variance for the 25 feet needed to meet the
40 foot setback from the pond. A
preliminary application for this subdivision was submitted and discussed at the
March meeting, and revised for the April meeting. A Public Hearing was held on May 21st and continued at
the June 18th, meeting, during which the Public Hearing was
closed. An on-site Special Public
Meeting was held June 26th for the purpose of walking the
property. After continued deliberation,
resolution 2007-10 was made to deny the subdivision.
3)
Markham
(236-1-122) Owner Stephen
Markham has applied to the Planning Board for a 2 lot subdivision of a 19+ acre
parcel on Cook Road. A couple of years
ago, before a lot line change, this land existed as 2 separate parcels. Wetland issues are still being addressed and
deliberation continues. The Public
Hearing was scheduled for August 20th at 7:45 PM.
4)
Heflin/Durst (255-1-40.1,41, 43.1,
43.2, 43.3) . . . In June, 2005, Dean Durst came before the Planning Board to
discuss his preliminary application for a 23 lot subdivision on Swaggertown
Road. At the request of the applicant,
the application was placed on hold in March, 2006 while issues regarding the
extension of the water district were addressed as well as allowing time to
prepare the detailed engineering required by the Planning Board. At the April 16th meeting, the
new maps received on 04/09/2007 were distributed. The project will be placed back in active status when the
requested escrow funding has been paid.
ZONING

CONSTABLES
Councilman Gardner reported that
during the month of July the Constables had 27 Patrols, 3 Complaints, 9 911
calls drove 1918 miles, issued 11 tickets, 2 accidents, 0 I.E.D. and 0 EMT
calls/Fire District Assistance.
JUSTICES
Councilman
Lippiello gave the report for Justice Bascom.
During the month of July 2007,
Justice Bascom adjudicated 27 cases totaling $1190 in fines, $20 in Fees and $620
in Surcharges. Sent to the State Comptroller $1830.
HIGHWAY
Highway Forman Mike Emerich stated that in addition to his
written report he is asking the Town Board to amend the budget to appropriate
the sale of the dump truck, a $5000.00 to account DA 5130.2. Forman Emerich stated that last year he
spoke to the Town Board about the money and the need for other equipment. Forman Emerich stated that he would like to
purchase a radio for the new truck. It
currently has none.
Councilman Salisbury stated that he thought that when the Highway
Department purchased the new truck the monies from the old truck would go
towards the new one. Supervisor
Grattidge suggested that the Highway Department gather the pricing of what they
plan to do the rest of the year and present it to the Town Board. Supervisor Grattidge stated that he does not
recall what was going to be done with the monies from the sold truck.
Forman Emerich stated that he is currently looking into applying
for a shared Highway grant for a new grinder.
The Town of Ballston would go in with the Town of Charlton on the
grant. Forman Emerich stated that he
will also contact the Town of Malta.

WATER
Councilman Lippiello stated that Water Superintendent John
Morgan would be meeting with Jim Mitchell of EDP Engineering to discuss items
that will be budgeted for next year, such as the painting of the water
tower.
Councilman Lippiello stated that Superintendent Morgan has one
last hydrant to be replaced located on Vines Road.
Supervisor Grattidge requested that Superintendent Morgan and
Mr. Mitchell come to the next Town Board Agenda Meeting and give a report of
options going forward with the 2008 budget.
HISTORIAN
Historian Laura Linder stated that the Town of Charlton has a
family who raises alpacas. Historian
Linder stated that their product is fibers.
They currently live in the home which was owned by the Crane family and
interesting enough there name also is Crane.
It is being researched where or not there is any connection.
Historian Linder stated that the NYS Archives will be
celebrating archives week as archives month.
The Town of Charlton Records Advisory Board will be displaying records
during the month of October.

REPORTS
Councilman Verola stated that she would like to

involved with the Hazardous Waste Program.
A Thank you also goes to Highway Forman for paving the roads.
Councilman Lippiello thanked Marv Schorr and the ECC for
the help with the Hazardous Waste Program.
The town appreciates it.
Councilman Salisbury stated that he had spoken with
someone from the Time Warner Cable Company and they will be changing a lot of
the cable lines. It seems that the
squirrels have been damaging the lines.
If residents are without cable, telephone or internet service that may
be the reason why.
PRIVLAGE OF THE FLOOR
Resident Sue Breault stated that she
has spoken to Councilman Gardner and Supervisor Grattidge with issues with an
illegal repair shop on Waite Road which has been going on for the last two
years. The gentleman has created a junk
yard. He has over 15 unlicensed vehicles.
Mrs. Breault stated that she has spoken to the Zoning Officer on
Numerous occasions. The Zoning Office
did issue a stop order permit, building continued. Mrs. Breault stated that she was told that nothing was going on,
on the property and it is still going on.
Mrs. Breault stated that when she bought her property on Westline Road
the taxes were less than $1600.00 and paid $4000.00 last year. Mrs. Breault stated that she wouldn’t of put
$100,000.00 into the house if she new that there was going to be a junk yard
next door. Mrs. Breault stated that she
bought the towns Zoning Ordinance Book and there is nothing on Junk Yards in
the zoning. There is also burning of
tires, waste and construction debris on the property. The gentleman put a driveway on someone else’s property. It is now going through legalities to get
the gentleman off the property. Now a
building sits three feet off Dr. Hecklers property. Mrs. Breault asked the Town Board where she goes from here. Mrs. Breault stated that she has
investigated the licensed repair shop number and it is a repair shop located in
Schenectady. Mrs. Breault stated if the
gentleman is running an illegal repair shop he shouldn’t be able to continue it. Mrs. Breault stated that if the town tells
her that it is okay for the gentleman to run a repair shop show where it states
this. Mrs. Breault stated that she had
to get a permit for all improvements that were done to her house. Mrs. Breault stated that she feels that Mr.
Barns should not be allowed to run a repair shop with out proper licenses.
Supervisor Grattidge stated that the
Zoning Officer and Building Inspector are well a where of the activity that is
occurring. Supervisor Grattidge stated
that he believes one of the land owners was in the Zoning Office and they are
working on clarifying where the property is.
Supervisor Grattidge stated that the Zoning Officer is a where of the
situation and is working on it.
Councilman Gardner stated that he had spoken with the Zoning
Officer. The issue is with the real
land owner. The person who owns the
land is the person in trouble not the person who is using it.
Attorney VanVranken stated that there
are two issues here. One the land owner
who is responsible for any building permits.
Based on the description heard tonight, there are no permits to run a
junk yard in Charlton. Attorney
VanVranken stated that he has heard nothing tonight that is in compliance with
the Zoning Ordinance. How ever, his
suggestion is to pair out the facts and act.
If the allegations bare out, there are appropriate actions. Attorney VanVranken advises encouraging the
process through the Zoning Enforcement Officer. Mrs. Beault thanked the Town Board for listening to her concerns.
Resident Craig Kominoski stated that
he has concerns with the towns issue on investigation Assessor options. The town had an informational meeting and
after that the town was supposed to have a discussion of all the options that
took place. Mr. Kimonoski stated that
he was not sure if that meeting was postponed or not going to happen. Mr. Kominoski stated that he has deep
concerns with that, not only as a resident, he has 32 ½ years in Assessment and
Appraisel experience. Mr. Kominoski
stated that he has spoken to several Assessors from other towns and has deep
concerns with the towns assessing not being professional. The Town of Charlton is currently worth on
taxable property 439 million dollars in taxable value. The Assessors are the manor of the property. They have to distribute the tax levy’s for
the school districts to the county throughout all the property of the town and
must do it on a uniform basis. If under
these circumstances if any one has that kind of wealth in real estate, they would
you hire a professional to manage that property. Or would you hire someone in hopes in time they might be able to
do the job. The current Assessor system
requirements are to hold an oath of office and to be 18 years old. Mr. Kominoski stated that it isn’t fair to
the residents of Charlton. Mr.
Kominoski stated that he is hoping to have this open discussion meeting to talk
about this.
Supervisor Grattidge stated that at
the first informational meeting the town was at a crossroad with the
resignation of the head Assessor. The
meeting was held and then the following month a consensus of the Town Board was
to stay with the three elected Assessors.
Supervisor Grattidge stated that he hasn’t scheduled anything at this
time. Grattidge stated that he believes
it may be an issue going forward. Mr. Kominioskistated that do you think this
is fair. The town had people from the
county and states attend the initial meeting.
Supervisor Grattidge stated that the Town Board chosen the path which
they would like to go down now.
Councilman Gardner stated that he started a lot of the dialog to get the
message out to the people. The most of
the people in town want to continue with the three elected Assessors. Councilman Gardner stated that it is a
touchy subject. Councilman Gardner gave
his opinion. The NYS Senate is looking
at changing the entire real property system.
Mr. Kominoski stated that he doesn’t see that the system is going to
change.
Supervisor Grattidge stated that the
head of the Assessment Board of Review thinks that the town should look at a
Sole Assessor and look into a revalue. Supervisor Grattidge stated that for now
the discussion was made to stay with the current system. It doesn’t mean that we wouldn’t bring it
back again. Marv Schorr stated that
there was a vote on the issue and the residents voted to continue with the
current system. Councilman Verola
stated that the public vote was taken two times and it was voted down. Mr. Schorr stated that he doesn’t see the
public changing in the immediate future.
Everyone was given a chance to speak
who wished.
A motion was made by Councilman
Verola seconded by Councilman Lippiello to enter into an executive session to
discuss potential litigation of contractual issues with the New Town Hall
Project.

The Town Board reconvened
from Executive Session at 9:45 p.m. A
discussion occurred regarding the new Town Hall Architect’s recommendation that
testing be completed as soon as possible with respect to the presence of mold
within the structure as it exists in order to determine whether or not any
treatment needs to be applied in order to address this issue.
Upon motion of Councilwoman
Verola, seconded by Councilman Lippiello, the Board authorized the Supervisor
to contact Architect Vosburgh for purposes of authorizing the recommended
testing at a cost not to exceed $3,500.00, with the further condition that the
Architect confirm that this testing is for both inside and outside of the
existing structure. This resolution was
unanimously approved.

TOWN OF CHARLTON PROCLAMATION
IN HONOR OF MAURICE B. SUITS
WHEREAS, Maurice “Moe” B. Suits was born
on September 16, 1923 in the West Charlton section of the Town of Charlton,
Saratoga County, graduated from Galway Central High School, Galway, New York,
worked as a File Clerk and on July 31, 1942, at the age of eighteen years ten
months, enlisted in the United States Army, and
WHEREAS, Maurice, completed two years,
three months and twenty-seven days of Honest and Faithful Service in the
military of the United States of America during World War II as a Truck Driver,
Heavy and Light, earning M-1 Rifle Qualifications with a Marksman Score on
August 29, 1942, and Good Conduct Medal, he received an Honorable Discharge
with a notation of Excellent Character November 29, 1944 as a Corporal, with
last duty assignment with Quartermaster Detachment, Station Compliment, Fort
Dix, New Jersey, and
WHEREAS, Maurice, returned to Saratoga
County, met and married Doris J. DeHeer, a “Porter Corners girl,” July 8, 1945
at the Baptist Episcopal Church, Saratoga Springs, and they made their home on
Route 67, West Charlton and raised their four children: Maurice Clifton, George
Leslie, Margaret Ann and Gordon Lewis Suits, and
WHEREAS, Maurice served as a correction officer for the
Saratoga County Sheriff’s Department for eighteen years, was a bus driver for
Welcome Lines, attended Spencer Business School, worked for Town of Charlton
Highway Department, was a custodian and drove a school bus for Galway Central
School District for many years, retiring in 1986, and
WHEREAS, Maurice was a longtime member
of the West Charlton Volunteer Fire Department serving as Chief, Assistant
Chief and Fire Commissioner, a dedicated member of the Sacandaga American
Legion Post 1461 in Galway where he actively participated in events such as the
Memorial Day Parade and Ceremony, was also a member of The Forty & Eight
organization, Ballston Spa Elks, Christ Episcopal Church in Ballston Spa, and
was actively involved for many years in the Charlton Republican Party where he
served as Committeeman, and
WHEREAS, Maurice died at age 81, June 8,
2005 at Saratoga Hospital, just one month shy of his 60th wedding
anniversary, and lays at rest at West Charlton Cemetery close to where he was
born and spent most of his life,

THEREFORE BE IT PROCLAIMED by the
Town Board of the Town of Charlton, on behalf of the grateful residents of
Charlton, that August 27, 2007 be dedicated to the memory of Maurice B. Suits
for his honorable service to the United States of America and to his local
community as a part of the Saratoga County Honor Our Deceased Veterans program
held this date at 9:30 AM at the County War Memorial, Saratoga County Municipal
Center, 40 McMaster Street, Ballston Spa, and

the family of Maurice B. Suits as an expression of sincerest appreciation from

RESOLUTION AUTHORIZING THE APPOINTMENT OF A
PART-TIME CLERK FOR THE BOARD
OF ASSESSORS
OF THE TOWN OF CHARLTON
WHEREAS,
the Town Board was advised by letter dated July 30, 2007 that the Assessor
Clerk for the Town of Charlton’s Assessors Office resigned effective July 30,
2007, and
WHEREAS,
the Town Board believes that it is in the best interests of the residents of
the Town of Charlton to have a functionally efficient Board of Assessors in
order to process the necessary documentation relevant to the assessment rolls
of said Town, and
WHEREAS,
the Town believes that for the Board of Assessors to be enabled to fulfill this
obligation, a part-time Clerk is necessary to assist with the Assessor’s
mission and responsibility.
NOW,
BE IT RESOLVED, that the Town Board hereby appoints Shirley Palmer as part-time
Clerk to the Board of Assessors, whose services will be determined by said
Board of Assessors on an as needed basis, and
BE
IT FURTHER RESOLVED, this part-time position will be paid at the hourly rate of
$10.73, which payments are to be made following the submission of a voucher by
the appointed Clerk setting forth the hours worked and the total fees due.

RESOLUTION AUTHORIZING THE SUPERVISOR TO ENTER
INTO AN AGREEMENT WITH PAUL G.
CARR, Ph.D.,P.E.
TO PROVIDE SERVICES TO ALL PARTIES INVOLVED WITH
THE CONSTRUCTION AND COMPLETION OF THE
NEW TOWN HALL
WHEREAS,
on June 25, 2007, the Town Board did direct the Town Attorney to contact
Selective Insurance Company of America with respect to certain issues related
to the Agreement between the Town and Schmidt & Schmidt, Inc., and
WHEREAS,
on June 26, 2007, the Town Attorney did so notify Selective Insurance Company
of America, as required by paragraph 3.1 of Performance Bond No. B-1022793,
requesting a conference within 15 calendar days of the receipt of such
communication, and
WHEREAS,
on July 9, 2007, representative from Selective Insurance Company of America did
meet with representatives of the Town of Charlton and Schmidt & Schmidt
regarding this matter, and
WHEREAS,
a recommendation was provided by the Bond company representative that a
potential solution to certain issues involving the Town of Charlton/Schmidt
& Schmidt contracts would be the use of and contracting with a person to
provide services having the generic title Project Neutral, and
WHEREAS,
the Town Board, through the Town Attorney, did seek information regarding
possible persons to serve in the role of Project Neutral, one of which was Paul
G. Carr, Ph.D., P.E., who provided through the Town Attorney a resume and
proposed contract for services to be rendered by Dr. Carr and his associates in
the role as Project Neutral, and
WHEREAS,
Dr. Carr has met with all of the parties involved with the construction of the
new Town Hall, has received and analyzed documentation from the project
Architect, Town Representative and all prime contractors concerning this
matter, and
WHEREAS,
the Town Board has indicated in its meeting minutes of August 2, 2007, that it
is in the best interest of the residents of the Town of Charlton and with
respect to the timely and effective completion of the new Town Hall to employ
the services of Dr. Carr as a Project Neutral in this matter, in which role Dr.
Carr will assist with, coordinate, advise and counsel the parties at such times
as may be necessary to complete the construction of the new Town Hall.
NOW,
THEREFORE BE IT RESOLVED, that the Supervisor is hereby authorized to enter
into an agreement with Dr. Paul G. Carr for services to be provided by himself
and his associates in the role of Project Neutral of the new Town Hall
construction project, the terms and conditions of which shall be those as set
forth in Dr. Carr’s proposed Agreement of prior date, but with specifications
as to service rates assigned to any associates of Dr. Carr and Dr. Carr himself
as relates to Project Neutral activities.

A RESOLUTION AUTHORIZING THE SUPERVISOR TO CONTACT ARCHITECT
VOSBURGH FOR PURPOSES OF AUTHORIZING RECOMMENDED MOLD TESTING FOR NEW TOWN HALL BUILDING
WHEREAS,
the Town Board reconvened from Executive Session at the Regular Town Board
Meeting held on August 13, 2007 a discussion occurred regarding the new Town
Hall Architect’s recommendation that testing be complete as soon as possible
with respect to the presence of mold within the structure as it exists in order to determine whether or not any treatment
needs to be applied in order to address this issue.
BE
IT RESOLVED, that the Supervisor is authorized to contact Architect Vosburgh for purposes
of authorizing the recommended testing at a cost not to exceed $3,500.00, with
the further condition that the Architect confirm that this testing is for both
inside and outside of the existing structure.
