The Regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Lippiello, Councilman Salisbury, Councilman Verola, Supervisor Grattidge and Kim Caron

 

Absent:  Town Clerk Heather Scribner

 

Supervisor Grattidge lead the pledge of Allegiance.

 

Supervisor Grattidge announced that Kim Caron is filling in for Town Clerk Heather Scribner.

 

The meeting began by opening sealed bids for a 1989 International Dump Truck.  A legal noticed was placed in the Daily Gazette the official newspaper for the Town of Charlton.  An addition to the Legal Notice an Ad was placed in the Saratogian Newspapers and the Daily Gazette.  The Legal Notice read:

                                      A 1989 INTERNATIONAL 2674 DUMP TRUCK 

 

            The Town Highway Department is currently the owner of a certain International 2674 dump truck, which has been used by the Town Highway Department in its services to the residents of the Town of Charlton.

The Town of Charlton will receive sealed bids which must be received by the Town Clerk no later than July 9, 2007 at 1:00 p.m. at the Charlton Town Hall, 784 Charlton Road, Charlton, New York for the purchase of one 1989 International dump truck  only. 

The bids will be opened by the Town Board at 7:30 p.m. on July 9, 2007 at the Charlton Town Hall.  .

The dump truck is available for inspection at the Charlton Town Highway Garage, 4008 Jockey Street.  If you wish to test operate this vehicle, please contact Ron Gavin, Highway Superintendent at 399-3425.

            The Town Board reserves the right to reject any and all bids and to waive all formal bid requirements as may be determined by the Town Board with respect to the best interests of the residents of the Town of Charlton.

            All bids must include that the terms of sale shall be in cash, certified check or bank cashiers check paid to the Town on or before July 16, 2007, and that it shall be the responsibility of any prospective bidder to inspect and determine the condition of the tractor and mowers prior to the date of bidding.

            The sale of the dump truck shall be “as is” with absolutely no warranties of any kind offered by the Town to any prospective purchaser.

Supervisor Grattidge stated that the Town Clerk will provide copies of the bids for the Highway Superintendent to review.  The award will be given at the next meeting of the Town Board.

SUPERVISORS REPORT

 

Supervisors Report read for July 2007:

 

For the month of June I attended 6 Town meetings and 8 County meetings.

Some of the highlights of the month:

-         Gave opening remarks for the 5-K Race and Party in the Park events for Founders Day.

-         Marched in the Founders Day Parade and presented a Town Resolution to Ralph Rudolph and the Sons and Daughters of Liberty Ancient Fifes and Drum Marching Band for their service to the Town.

-         Attended a public hearing concerning the Galway Public Library

-         Marched in the Town of Ballston’s Flag Day Parade

-         Attended Sundae on the Farm in the Town of Saratoga

-         Attended the ground breaking for the YMCA fitness addition

-         Attended the Ballston Community Library Annual Dinner Meeting

 

Supervisor Grattidge stated that he would be speaking to the Ballston Spa National Bank regards to providing direct deposit for the towns employees.  Supervisor Grattidge will provide the Town Board with more information.

 

Supervisor Grattidge announced that a review letter regarding the MS4 Legislation (Storm water Management) from the Saratoga County coordinator.

 

Supervisor Grattidge announced that there was an article in the Daily Gazette from Steve Williams concerning the spreading of manure on the Western Part of Town.  Supervisor Grattidge stated that he had received calls from residents regarding the strong odor which occurs while the spreading of manure.  Article:

 

Supervisor Grattidge stated that the town received a flag donated by Mrs. Holloway.  Town Clerk Heather Scribner placed the flag in the safe.  Supervisor Grattidge stated that it will be presented at the next Town Board meeting.  It was greatly appreciated.

 

SUPERVISORS ANNOUNCEMENTS

 

Supervisor Grattidge announced that the Town Clerk received the Final Tax Roll.  The roll is available for public inspection at the Town Clerks Office.  A Legal notice was placed in the Daily Gazette.

 

A meeting of the Town Board will be held at 2:00 pm on July 26, 2007 to discuss a six month review of the budget.

 

Supervisor Grattidge stated that the town received a letter from the County Waste regarding the towns Bulk Item Pick Up.  The County waste reduced their bill to the town to a significant amount of money.  The County Waste is concerned with how much scrap metal is being picked up on the side of the road before they are able to pick it up.  Supervisor Grattidge stated that the program allows the town to receive revenues back from the scrap metal.  It would then help cover the cost of the household items that are picked up.  County Waste suggested that the Town Board pass legislation giving a penalty to those who pile pick.  Supervisor Grattidge stated that there is a safety concern as well.  Supervisor Grattidge suggests working with Highway Department on a strategy to pick up the scrap metal early on.  Along with educating the public on when they should place their items out.  Supervisor Grattidge stated that the program may need to be limited if the cost continues to exceed the way it had this year.  Councilman Gardner stated that once the public puts out their scrap metal they usually don’t have much the following year.  Supervisor Grattidge stated it is a program that the Town Board will need to discuss at its budget deliberations.

Report to the Town Board

July, 2007

The Town of Charlton Planning Board last met on Monday, June 18, 2007 at Town Hall.   There was a continuation of the May Public Hearing, two subdivisions and one lot line change were discussed, and resolution 2007-09 was made to accept changes to the previously approved Cuchelo Subdivision

 

1)     Markham  (236-1-122)    Owner Stephen Markham has applied to the Planning Board for a 2 lot subdivision of a 19+ acre parcel on Cook Road.  A couple of years ago, before a lot line change, this land existed as 2 separate parcels.  Wetland issues are still being addressed and there was no deliberation at the June meeting.

2)     Nigriny/Durst  (247-1-50.12)     At the February meeting, Dean Durst came before the Planning Board for a pre-application conference to discuss the concept plan for a 2 lot subdivision of a parcel on the corner of Jenkins Road and Sweetman Road.   The prior attempt to subdivide this parcel failed when the ZBA denied an area variance for the 25 feet needed to meet the 40 foot setback from the pond.  A preliminary application for this subdivision was submitted and discussed at the March meeting, and revised for the April meeting.  A Public Hearing was held on May 21st at 7:45 PM and continued at the June 18th, meeting, during which the Public Hearing was closed.  An on-site Special Public Meeting was held June 26th for the purpose of walking the property.

3)     Gutto  (225-1-66.1)   At the March 19th meeting, Carmen Gutto came before the Planning Board for a pre-application conference to discuss a 2 lot subdivision of Kathryne Gutto’s 54 acre parcel which borders Division Street and Route 67.  The plan did not provide for adequate road frontage on Route 67 and Mr. Gutto was referred to the ZBA to apply for an area variance.  The ZBA granted Mr. Gutto an area variance, at their April 10th meeting, which allows the existing driveway cut onto Division Street to be the only road frontage for the parcel to be created with the existing house.  Survey maps and a revised application were received and deliberation continued before the Planning Board.  The Public Hearing was scheduled for July 16th at 7:45 PM

4)     Heflin/Durst (255-1-40.1,41, 43.1, 43.2, 43.3) . . . In June, 2005, Dean Durst came before the Planning Board to discuss his preliminary application for a 23 lot subdivision on Swaggertown Road.  At the request of the applicant, the application was placed on hold in March, 2006 while issues regarding the extension of the water district were addressed as well as allowing time to prepare the detailed engineering required by the Planning Board.  At the April 16th meeting, the new maps received on 04/09/2007 were distributed.  The project will be placed back in active status when the requested escrow funding has been paid.

5)     Cuchelo  (235-1-33.1)   Resolution 2007-09  was passed to modify resolution 2007-02 for changes in the driveway cuts on Route 147.

6)     Bliss  (247-2-3)   Phyllis Bliss came before the Planning Board for a pre-application conference for a proposed lot line change to add north side setback to her parcel, located on Stage Road.

 

 

ZONING

CONSTABLES

 

Councilman Gardner reported that during the month of June the Constables had 21 Patrols, 5 911 calls drove 2024 miles, issued 14 tickets, 3 accidents, 0 I.E.D. and 1 EMT calls/Fire District Assistance.

 

JUSTICES

 

Councilman Lippiello gave the report for Justice Bascom.  During the month of June 2007, Justice Bascom adjudicated 41 cases totaling $3225 in fines, $115 in Fees and $840 in Surcharges.  Sent to the State Comptroller $4180

 

Councilman Lippiello stated that Justice Bascom was in the process of replacing a printer.  Justice Bascom found a much less expensive one for $99.00.

 

HIGHWAY

 

Foreman Mike Emerich stated that the Highway Department is almost complete with the first stage of the paving project.  Shadick Road, Old Route 67 and Root Road have been paved.  They will be sealed later on.  The Highway Department continues to chip brush and patching holes in roads.  The roads sides and parks are being mowed. Maintenance was done on a few trucks .Foreman Emerich stated that he attended the Highway Superintendent School during the month of June.  Next year he will receive a five year certificate for attending.

PARKS

 

Chairman George Eggleston stated that he received a complaint regarding the drinking fountain not put in at Elmer Smith Park.  Chairman Eggleston spoke to the Highway Department asking them to put the fountains in.

 

Chairman Eggleston stated that Park Committee discussed the Warming Shelter located at Elmer Smith Park. The Park Committee decided to pull the fireplace out and expand the existing Shelter.  The roof will need to be replaced with new tin.  Chairman Eggleston will provide the Town Board with a quote of what would need to be done at the Warming Shelter.

 

 

HISTORIC DISTRICT COMMISSION

 

Chairman James Poirier distributed a revised Application for Opinion of Approval form.   Chairman Poirier stated that the Historic District Commission researched other Districts forms and streamlined the current form used by the Historic District.  Supervisor Grattidge suggested having the Zoning Administrator and Building Inspector review the form before making any decisions.  Councilman Verola stated that the form did not change.  It is more user friendly by reformatting.  The Town Board comments were that it looks very nice.

 

Chairman James Poirier stated that the Historic District had concern with the shutter selection for the Town Hall Project.  Chairman Poirier stated that it is the Historic District’s to advise on the characteristics in the Hamlet.  The Historic District voiced concerns with the fleur-de-lis pattern in the shutters.  Supervisor Grattidge stated that the Town Board can forward it to the Architect.  The Historic District recommends a louvered shutter.

 

Chairman Poirier distributed a proposal from Kate Johns a Historic Architect.  The Historic District Commission is asking for guidance from a professional resource to direct them with advice when a resident would like to do a renovation to their home.  Chairman Poirier stated that the Historic District would like to approach this as a two part approach.  When Hamlet residents are thinking about making modifications to their home the Historic District could use Ms. Johns to help the Commission steer residents in the proper direction.  The other approach would be when an Application for Opinion of Approval   is submitted beyond the Commission’s scope it would be beneficial to have a professional resource help review the application.  Chairman Poirier stated that Ms Johns would not be attending the Historic District Commission meetings.  Ms Johns would be called in on an as needed basis.  The Commission receives approximately two or three a year applications.  Chairman Poirier stated that Ms. Johns had quoted the Historic District Commission as one hour for an Application for Opinion of Approval and two hours for a sketch plan if needed.  Chairman Poirier stated that not all applicants would need to go through a professional resource.  Supervisor Grattidge stated that the Town Board will review the proposal.

 

HISTORIAN

 

Historian Laura Linder stated that she does not have much to report.  Deputy Historian Dorothy Mitchell is working on a proclamation honoring deceased veterans.  Ms. Mitchell is working with the Town Clerk Heather Scribner and Supervisor Grattidge.

 

EMERGENCY PLANNING

 

Councilman Gardner stated that the Town Clerk Heather Scribner helped with securing an Emergency Plan from Hamilton County, Town of Lake Pleasant.  The Town of Lake Pleasant hired a consultant to write the plan.  Councilman Gardner will review the plan and give comments to the Town Board at a later time.

COUNCILMAN REPORTS

 

Councilman Verola stated that she and Councilman Lippiello are researching policy and procedures for the use of the current Town Hall and the New Town Hall.  Town Clerk Heather Scribner has forward policy and procedures from other towns.  Councilman Verola stated that recommendations will be presented to the board.

 

Councilman Gardner announced that there was an article in the paper on the person who is making noise from a dirt bike over on Western Ave. The person finished second at the 250 open amateur class.  Councilman Gardner stated that his practice is paying off.

 

Councilman Lippiello suggested while taking a look at the usages of the current Town Hall the New Town Hall should be looked at as well.

 

Councilman Salisbury stated that he received information from Troy Banks Audit regarding the review of the National Grid bills. Included is an application form.  Councilman Salisbury stated that a copy was given to the Town Attorney for review.  The Town Board will review the information at the Agenda meeting.

 

 

 

PRIVLAGE OF THE FLOOR

 

 

Resident Terry Ostrander referred to the complaint residents made against him regarding noise of an off road bike on his property.  Mr. Ostrander stated that he would keep the Town Board appraised on how long and how many practices his grandchildren are riding.  In the last few weeks practice consisted of 1 hour and 35 minutes.  The rider came in 2nd at Frozen Ocean.  Mr. Ostrander stated that the closest person who signed the complaint is 3/10’s of a mile from his home, which is quite a distance, with the exception of the Stolls.  Mr. Ostrander stated that he spoke with all the other neighbors and they said if it comes down to it they would come in and speak with the Town Board and tell you its fine.  Mr. Ostrander stated that he was not sure where he is supposed to go from here.  He will leave it up to the Town Board.  Thank you.

 

A motion was made by Councilman Verola seconded by Councilman Lippiello to enter into an executive session at 8:25pm to discuss potential litigation of contractual issues with the New Town Hall Project.

                                      A RESOLUTION TO APPOINT LEWIS MORRIS

               AS A MEMBER OF THE TOWN OF CHARLTON BOARD OF ASSESSORS.

 

            WHEREAS, the Town Board of the Town of Charlton did at its organizational meeting on January 8, 2007 by Resolution No. 30 appoint Victoria Hayner as Chairman of the Charlton Board of Assessors for a period commencing January 1, 2007 and termination on December 31, 2007, and

 

            WHEREAS, by letter dated February 28, 2007, Victoria Hayner did notify the Town Clerk for the Town of Charlton that she would resign her position of Assessor for the Town of Charlton effective April 1, 2007, and

 

            WHEREAS, the effect of the resignation of Assessor Hayner was to reduce the number of assessors for the Town of Charlton from three to two, an undesirable situation based on the current work load of the Assessor’s Office, and

 

            WHEREAS, the Town Board of the Town of Charlton desires to restore the number of assessors to three and to appoint a third assessor in order to assist with the proper functioning and responsibilities of the assessors to the residents of the Town of Charlton.

 

            NOW BE IT RESOLVED, that the Town Board hereby appoints Lewis Morris as an assessor for the Town of Charlton and which appointment will take effect as of the date of this resolution and terminate December 31, 2007, and

 

            BE IT FURTHER RESOLVED, that the salary for Assessor Lewis Morris shall be at the rate of $6,000.00 per year, pro-rated from July 9 until December 31, 2007.

            WHEREAS, the Town Clerk and the Town of Charlton has accepted an LGRMIF for the purpose of managing Town records, and

 

            WHEREAS, the Town Records Advisory Board has recommend the purchase of two (2) map cabinets and as set forth on the attached proposals from Dataflow, Inc.

 

            NOW BE IT RESOLVED, that the Town Board hereby authorizes the purchase of two (2) map cabinets as set forth on the attached Dataflow, Inc. proposal for the sum of $9,271.00 and for purposes of implementing the LGRMIF grant, and

 

            BE IT FURTHER RESOLVED, that such payment of $9,271.00 shall be made from the Records Management Account A-1460.2.

            WHEREAS, the Town Board of the Town of Charlton is desirous of appropriately planned growth in the Town of Charlton; and

 

            WHEREAS, a Comprehensive Plan is a statutorily recognized instrument under Town Law §272-a for the immediate and long-range protection, enhancement, growth and development in a Town; and

 

            WHEREAS, a properly crafted comprehensive plan assists with the regulation of land use and protects the health, safety and general welfare of the citizens of the Town; and

 

            WHEREAS, the Town of Charlton Town Board identified that a comprehensive plan was needed to properly plan growth and development, protect agricultural land, the environment and enhance the health, safety and welfare of the community and residents; and

 

            WHEREAS, the Town of Charlton appointed a Comprehensive Plan Steering Committee to study the Town, collect data and prepare a draft comprehensive plan; and

 

            WHEREAS, the Town of Charlton retained the services of a professional planning consultant, namely, Nan Stolzenburg, Consultant, Community Planning & Environmental Associates of Berne, NY, to assist with and prepare a Town of Charlton Comprehensive Plan; and

 

            WHEREAS, the Comprehensive Plan Steering Committee engaged in an extensive effort to solicit public and community input into the comprehensive planning process; and

 

            WHEREAS, the committee with the assistance of its professional planner, Nan Stolzenburg, completed the requested tasks; and

 

            WHEREAS, as a result of public input and the efforts of the Comprehensive Plan Steering Committee, a Draft Town of Charlton Comprehensive Plan was prepared and submitted for Town Board on March 26, 2007; and

 

            WHEREAS, a public hearing was held by the Comprehensive Plan Steering Committee and the Town Board on June 11, 2007 to solicit input from the community as per Town Law §272-a; and

           


            WHEREAS, the Town Board of the Town of Charlton has caused to be prepared a Long Environmental Assessment Form (EAF) pursuant to the mandates of the State Environmental Quality Review Act (ECL Article 8 and 6 NYCRR Part 617); and

 

            WHEREAS, the Town Board has duly considered the contents of the EAF and completed Parts thereof; and

 

            WHEREAS, the Town Board has identified the relevant areas of environmental inquiry; and

 

            WHEREAS, the Town Board has issued a negative declaration under SEQRA by resolution dated July 9, 2007, thereby complying with the mandates of the State Environmental Quality Review Act; and

 

            WHEREAS, the Town Board has completed the requirements of NYS General Municipal Law 239-m by forwarding a copy of the draft plan to the Saratoga County Planning Department and waiting 30 days for their response.

                                                           

            NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Charlton hereby determines that the Comprehensive Plan as attached hereto and made a part hereof is hereby adopted as the Comprehensive Plan of the Town of Charlton.

NEGATIVE DECLARATION           - TYPE I ACTION

 

RESOLUTION 113

 

Date:  July  9, 2007 

 

 

WHEREAS, the Town Board of the Town of Charlton (“Town Board”) duly appointed a Comprehensive Plan Steering Committee to develop a draft Town comprehensive plan; and

 

WHEREAS, the Comprehensive Plan Steering Committee conducted a study of the Town of Charlton that included a full inventory of physical, natural and cultural resources; and

 

WHEREAS, the Comprehensive Plan Steering Committee solicited and utilized the input of the public through a written survey, visioning workshops, news articles, public meetings, and public hearings to formulate the plan; and

 

WHEREAS, this Plan includes the long-term vision, goals, objectives and strategies to guide the orderly growth of the Town; and

 

WHEREAS, the Plan also includes studies of past and present land uses, demographic statistics, public opinions, and recommendations for the Town to use and/or implement in order to reach the stated goals and objectives of the Town; and

 

WHEREAS, the Town Board submitted the Draft Comprehensive Plan to the Saratoga County Planning Board as required by NYS General Municipal Law 239-m and the proposed action does not require any other permits or approvals from other State and Federal agencies prior to adoption; and

 

WHEREAS, the Town Board declared itself Lead Agency by resolution dated May 29, 2007, a copy of which is attached hereto and made a part hereof, and further conducted an environmental assessment according to SEQRA, 6 NYCRR Part 617; and

 

WHEREAS, the Town Board, after consideration of the Full Environmental Assessment Form Part I and Part II, a copy of which is attached hereto and made a part hereof, finds that

 

Implementation of plan will positively assist Charlton in reaching goals of maintaining open space, rural landscapes, and the environment.

 

The plan recognizes natural features, prime soils, sensitive environmental areas that need protection in the future.

 

The plan makes recommendations on ways the Town can maintain its agricultural land, historic, aesthetic character and rural landscapes.

 

The plan includes an inventory of agricultural land, historic resources and offers methods to protect these important resources.

 

The plan recommends implementation of a variety of tools such as site plan review, subdivision and zoning methods and amendments to protect critical resources.

 

The plan offers recommendations on how Charlton can maintain its current and desired neighborhood character, and to control growth in a manner which will meet the goals of the community.

 

            NOW THEREFORE BE IT RESOLVED, that the Town of Charlton Town Board hereby declares that adoption of the Town of Charlton Comprehensive Plan described herein, will not have any significant negative environmental impacts; and

 

            BE IT FURTHER RESOLVED, that the Town Board hereby authorizes filing of a negative declaration (attached hereto), according to SEQRA, 6 NYCRR Part 617; and

 

            BE IT FURTHER RESOLVED, that the Town Supervisor is authorized to execute the Environmental Assessment Form.
