The Special meeting of the
Town Board of Charlton, Saratoga County, New York held at 7:30pm at Town Hall
784 Charlton Road, Charlton, NY 12019 called to order by Supervisor Grattidge.
Present: Supervisor Grattidge Councilman Lippiello,
Councilman Salisbury, Councilman Verola and Town Clerk Heather Scribner
Absent: Councilman Gardner
Supervisor Grattidge stated
the purpose of this meeting is to award the bid for the Water District
Projects.
The Town Clerk Heather Scribner read the announcement
of the meeting:
The Town Board Town of Charlton will meet on Monday,
April 23, 2007 at 7:30pm at Town Hall,
784 Charlton, N.Y. 12019. At the said time the Town Board will award the bid
for the Water District Projects, Pumping Station By-Pass Reconstruction and
Beechwood Drive Valve Replacement.

Water
Superintendent John Morgan stated that Shultz Construction would contact Jim
Mitchell to proceed with the proper paperwork.
Once the town receives the contract Town Clerk Heather Scribner said
that she would need to file the contract in the Town Clerks Office.

the Special Meeting of the Town Board Town of Charlton.

RESOLUTION AWARDING TOWN WATER DISTRICT
PUMPING
STATION BY-PASS RESCONSTRUCTION
AND
BEECHWOOD DRIVE VALUE REPLACEMENT
CONTRACT TO THE LOWEST
RESPONSIBLE BIDDER
WHEREAS,
the Town Board authorized the Town Engineer, Environmental Design Partnership,
to prepare bid specifications for pumping station by-pass reconstruction and
Beechwood Drive valve replacement in order to properly service and maintain the
Town’s water district infrastructure, which authorization was granted by
resolution dated March 12, 2007, and
WHEREAS,
on March 15, 2007, the Town Clerk for the Town of Charlton did publish a Notice
to Bidders in the Daily Gazette, indicating that bids would be received for
such water district infrastructure maintenance and repair, and
WHEREAS,
the Town Board did on April 9, 2007, open all received bids for such pumping
station by-pass reconstruction and Beechwood Drive valve replacement, and
WHEREAS,
James E. Mitchell, P.E., of Environmental Design Partnership and John P.
Morgan, Town Water Department Superintendent, have analyzed such bids and James
E. Mitchell has made a written recommendation to the Town Board as to the
lowest responsible bidder for such water district infrastructure maintenance
and repair, a copy of which letter of recommendation is attached to this
resolution and made a part hereof.
NOW
BE IT RESOLVED, that the Town Board hereby accepts the recommendation of the
Town Engineer and does hereby accept Carver Construction, Inc.’s request to
withdraw its bid and to return its bid bond, and
BE IT FURTHER
RESOLVED, that the Town Board hereby awards the construction contract for the
pumping station by-pass reconstruction and Beechwood Drive valve replacement to
W. M. Schultz Construction, Inc., of Ballston Spa, New York for the lump sum
bid of $90,740.00, and
BE IT FURTHER
RESOLVED, that the Town Engineer and the Town Supervisor are hereby authorized
to prepare, review and execute any and all documents necessary to effect the
terms and conditions of this award, and
BE IT FURTHER
RESOLVED, that the Town Supervisor is hereby authorized to approve any proposed
change orders presented during the course of construction activity relative to
this award, and which authority shall be limited to a total of but not to
exceed the sum of $5,000.00.

By-Pass Reconstruction and
Beechwood Drive
Valve Replacement
Dear Alan:
Pursuant to your request, we have completed our review of
the submitted bids for the above
referenced project.
The low bidder,
Carver Construction, Inc. has indicated that they did not inspect the site
conditions until after submitting their bid and have requested that they be
allowed to withdraw their bid.
Based on this review I recommend the following:
· Accept Carver's request to withdraw
their bid and return their bid bond.
· Consider awarding the Construction
Contract to W. M. Schultz Construction, Inc. of Ballston Spa, NY for the Lump
Sum bid of $90,740.
The next step in the process will be
for the Town Board to authorize the execution of the construction contract.
We will notify Schultz Construction, Inc. to begin
preparation of their Performance Bonds and other requirements upon
authorization from your Board.
We also recommend that the Supervisor be authorized to approve
change order expenditures not to exceed $5,000.
