The Agenda meeting of the Town Board of Charlton,
Saratoga County, New York held at 7:30 pm at the Charlton Town Hall, called to
order by Supervisor Grattidge.
Present: Councilman Gardner, Councilman
Lippiello, Councilman Salisbury, Councilman Verola, Supervisor Grattidge and
Town Attorney Robert VanVranken.
Supervisor Grattidge announced that this meeting is
to set the Agenda for the Regular Meeting of the Town Board on Monday, March
12, 2007.
The Town Board will approve the following meeting
minutes at the March 12, 2007 Town Board meeting: Town Board Meeting of February 12, 2007 and February 26, 2007.
Town Clerk Heather Scribner
presented the unaudited list of vouchers to the Town Board on February 26th. Councilman Verola, Councilman Salisbury and
Councilman Gardner audited vouchers 1149-1175.
No changes were made.
A motion was made by Councilman Verola seconded by
Councilman Salisbury authorizing the town clerk to prepare abstract 104 claims
no. 1149-1175 totaling $13,078.03 as audited by the Town Board. Approved

Supervisor
Grattidge reminded everyone of the Comprehensive Planning Steering Committee
Meeting on Wednesday, February 28th at 7:00pm at the Charlton
Freehold Church. A publication was
made in the Town Board Newsletter, Gazette Newspapers and the Glenville Weekly,
Supervisor
Grattidge announced on Monday, March 12th at 9:30am Dave Meager the
town’s insurance policy representative will meet to give an overview of the
towns insurance policies. Supervisor
Grattidge stated if any members have any questions or requests prior to the
meeting let him know he will see that they are addressed prior to the
meeting. This meeting occurs once a
year with the town board.
Supervisor
Grattidge stated that the town incurred a problem with someone taping into the
phone system making international calls to Sudan and Egypt. The town was
notified by two outside carriers of the situation. Due to the situation a few changes were made one being the change
of access codes. The international
calls will need to be disputed. These
calls were unauthorized fraudulent calls, says Supervisor Grattidge. Councilman Verola asked if the town could
get a block on international calls.
Supervisor Grattidge said, yes we can apparently the block hadn’t been
activated when the account was originally set up. The phone system is now blocked from international calls. The call forwarding option was also blocked
because that is another way someone could tap in to the system.
The
town board received a packet of information regarding the 2010 Census. Supervisor Grattidge stated that some
applications were sent out.
Supervisor
Grattidge announced that the Saratoga County Planning Department is holding an
informational Workshop on March 14th at 9am-noon at the Cornell
Cooperative Extension. The workshop
will be presented by the NYS data system, and the Capital District Regional
Planning Commission.
Supervisor
Grattidge stated last year the town reserved the Saratoga County Veterans Float
for the Founder’s Day Parade. The town
board agreed to reserve the float for this year. Supervisor Grattidge will submit the application to the county.
The
Village of Ballston Spa is celebrating its Bicentennial with a parade on Saturday,
August 18th. The town was
asked to be represented in there parade.
The parade will start at noon and line up if anyone is interested is at
11:00am. A family fun day will follow
along with fireworks at the Fair Grounds.
Supervisor Grattidge stated he took the liberty to ask Ralph Rudolf of
the Sons and daughters of Liberty- Ancient Fifes & Drum to march along with
Charlton. Supervisor Grattidge
suggested to have a float representing Charlton carrying the Fifes & Drum
Corp along with those wanting to march.
Councilman Verola stated that it would be a good idea. Supervisor Grattidge will submit an
application.
Supervisor
Grattidge sent a letter to the NYS Legislature requesting a member item grant
for a generator for the Town Hall. An
application was sent to Congresswomen Gilibrand as well. A response came back from Assemblyman
Tedisco for further information. The
Town Clerk Heather Scribner will make copies for the Town Board Members. The town received a letter from the Saratoga
County Office of Emergency Services endorsing the emergency generator.
The
Town Board received an annual report from the Charlton Water Department. Supervisor Grattidge stated that the report
will be attached to the March 12, 2007 meeting under department reports. Councilman Lippiello stated that the report
gives an overview of the water department for 2006. Water Superintendent John Morgan stated that he is working with the
engineer on the 3 water projects. The
draft plan is not finalized yet. A
reconfiguration of the pump house is being created for the bypass system. A few changes will need to be made such as
the fence in the front of the pump house and a drain around the entire building
to help drain the water. The fence on the south side will be extended so that
no one can use a ladder and get on to the roof. The fence will eventually be coming down. When the project goes out to bid it will be
specified for one contractual bid for the 3 projects. Councilman Gardner asked what the time frame would be for the
start of the project. Superintendent
John Morgan stated that he would like to start this spring. It all depends on when the engineer gets the
paper work ready. Councilman Gardner
asked if there would be any water interruptions. Superintendent Morgan stated that we would have to transfer water
and that’s why we need one contractor.
The
Town Board received the towns Annual Financial Report. The report was filed with the Town Clerk.
The
town board received a memorandum from the Town Clerk and the Highway Department
describing software they are interested in.
They are looking to purchasing software from the Williamson Law Book
Company. Supervisor Grattidge stated
that both departments have budgeted for the software. Councilman Gardner stated before we proceed with an authorization
would it be possible to entertain the accounting part at this time. If the town were to purchase the accounting
package could we get a discounted price rather than wait until a later date. Supervisor Grattidge said from his
understanding when the Town Board looked at the general accounting program it
was substantially more money.
Councilman Gardner asked if a phone call could be made. Supervisor Grattidge stated that he did not
ask for a quote for the general accounting program. It wasn’t budgeted for this year. The thought was the town will continue with the current software
this year and as we move into the new town hall. Councilman Gardner suggested the possibility to purchase it now
where we could save on the cost and wait to use it. Councilman Salisbury stated that we need to be careful because
you could end up paying a maintenance contract. I don’t know if it will be beneficial unless we were going to use
it right away. Councilman Gardner
stated that what if the software costs $7000.00 and Williamson Law was to give
it to us for $5000.00. Councilman
Verola stated that she thinks Councilman Gardner is trying to say we may be a
head of the game. Councilman Salisbury
stated that we don’t want to be paying two maintenance agreements. Councilman Gardner stated that the
Williamson Law Book Company came down $1100.00 on the Town Clerk program
because we were combining the Highway software. Supervisor Grattidge stated that he is inclined to get the two
departments going on the software.
Councilman Gardner stated all I am asking for is a phone call to check
on it. Councilman Salisbury stated I
know what you’re trying to say.
Councilman Gardner stated that he is following up on Keith Fitzgeralds
letter that the town should be thinking of this a year to come and a year has
gone by. His recommendation was that
the town should be looking to replace its current software. Supervisor Grattidge stated that when the
evaluation was done of the software it was working adequate. It wasn’t as
antiquated as some people thought it was.
Having our consultant Bob Fisher who is familiar with the software would
be able to get the data that we want.
At least get us through this year.
I would say get us to the new town hall and see what our equipment is
first. Councilman Gardner stated out of
consideration we should make a phone call.
Supervisor Grattidge stated that we can post pone the Town Clerk and
Highway software. Councilman Verola
stated that the town board should move forward with the Highway and Town Clerk software. Councilman Salisbury stated that the Highway
would need a transfer of funds to cover the amount of the software. Councilman Gardner suggested taking the cost
of the software out of the .2 account equipment and the other cost out of
mileage etc. account .4. Supervisor
Grattidge stated okay then we don’t need a transfer,

motion was made by Supervisor Grattidge seconded by Councilman Verola that

The
following Resolutions will be set on the Agenda at the March 12, 2007 meeting:
Appointment
to the Board of Ethics, Councilman Verola stated that Clarence Linder and Nilda
Burke have agreed to serve on the Board of Ethics. Councilman Salisbury stated that Nilda Burke currently serves on
the Zoning Board of Appeals which is a town official.
Supervisor
Grattidge stated that the town board will need to place someone on the Zoning
Board of Appeals as an alternate member.
It won’t be acted on at the March 12th meeting.
Appointing
Estella VanDerzee as the Custodian of Records to the Veterans Board. Supervisor Grattidge stated that the appointment
usually occurs at the Organizational Meeting and some how it got left out.
Property
Tax Reform, the Town Board received several resolutions from other towns on
property Tax Reform. Supervisor
Grattidge stated that he wanted to emphasis that school property tax has gone
up and the other tax has not gone up.
Emergency
Planning, 2 resolutions to be presented one is to adopt the NIMS program as a
starting point. Supervisor Grattidge
stated that the other resolution would enter into an agreement with the
Saratoga County for the mutual aid for assistance and other related
emergencies. Councilman Gardner stated
that the town only has a mutual aid agreement with the county. The way the
agreement works is in the event of an emergency and aid is needed the town
would go to the county and the county would coordinate with other towns for
resources.
Highway
Agreement, Foreman Mike Emerich stated he should have the agreement before the
next meeting.
Local
Law Adopting the NYS Building Codes, Town Attorney Robert VanVranken
distributed three documents regarding the proposed Building Codes. Town
Attorney VanVranken stated first take note of the effective date January 1,
2007 we will get there. This document
is an amendment to the building code. (A copy is available at the town clerks
office) The second document is the
proposed Local Law it self, third the notice of public hearing. The bottom line is that this is the new
building code effective date January 1, 2007.
What we are doing here is basically asking for an amendment of the
existing Law so that the town is now in compliance with the new building code
which has been in fact implied to the town since January 1st.
A
Local Law on the MS4 Storm Water Management will be presented at a later
date. Town Attorney VanVranken stated
that the town board has time. It is not due until March 2008.
Supervisor
Grattidge stated that the Town Board would meet in an executive session this
evening to discuss litigation regarding the Town Hall Project.
Councilman
Verola stated that she was viewing the town’s web site. As she entered the opening page all updates
seemed to be made although as you enter into the links updates have not been
made. She spoke with John Kelley
regarding some of the changes she saw. Councilman
Verola raised the question, who is responsible for updating the site? Supervisor Grattidge stated as the Town
Clerk Heather Scribner sees things she updates it. If Councilman Lippiello or I see items that need updating we
contact John Kelly. It’s a work in
progress. Councilman Verola stated that
we need a procedure, may be some one from each board/department should be
responsible for checking the web site.
The town board agreed that a letter should be sent to each department to
check their information. Councilman
Verola and the Town Clerk Heather Scribner will prepare a letter from the town
board.
Councilman
Gardner stated that the town board received a letter from the Town Clerk
Heather Scribner regarding return check fees. The current fee is at $15.00, should
we be reviewing this fee? Councilman
Verola suggested increasing the fee to $25.00.
There is a lot of book work involved in the process. Supervisor Grattidge suggested contacting
other towns and banks to see what the going charge is. Town Clerk Heather Scribner stated that the
banks do not charge the town although they charge us then reimburse us and it
becomes time and book work.
Foreman
Mike Emerich stated that the five year contract for municipal sharing was
reviewed and no changes are recommended.
Councilman
Salisbury stated that he noticed the sales tax revenue has gone down 2.2%. If we go at this pace we could be up at
least $10,000.00. Supervisor Grattidge
stated that the Saratoga County Treasurer had estimated 5% from last year,
that’s the estimate we used. Councilman
Salisbury stated that the sales tax will need to be watched closely. Supervisor Grattidge agreed.
Councilman
Salisbury stated that he had asked to have on the last Agenda the need for a
time clock. It never was put on. Supervisor Grattidge stated after the last
meeting with the towns financial consultant talked about the reports for the
retirement reporting, when Mr. Fisher comes back into town that is one of the
topics he would like to work on. He is expected back on April 1st.
Councilman
Gardner asked for an update regarding the online banking. Supervisor Grattidge stated that he does not
have an update at this time.
Councilman
Gardner asked where the town is on the furnace repair situation. Supervisor Grattidge stated that he put two
calls in and has not received a call back.
He will continue to call.
For
informational purposes, Supervisor Grattidge stated that he had heard X-tra
Mart is closing on Route 67.
Park
Chairman George Eggleston stated that he received a Park Permit Application for
Gideon Hawley Park. The question was
raised if the town has any restrictions on the use of Gideon Hawley Park during
the Town Hall Project? Supervisor Grattidge
stated that there is a possibility that the job trailers could still be there
in June. The town hall completion is
July and that is questionable right now. The applicant needs to understand that
a third of the Park is still being used.
A motion was made by
Councilman Verola, seconded by Councilman Gardner that the Public Meeting of
the Town Board convened in Executive Session for the purpose of discussing litigation
involving the Town Hall Project, the Town Attorney Robert VanVranken, was asked
to participate in the Executive Session.
No
action was taken in Executive Session.

WHEREAS, the Town Board of the Town of
Charlton proposes a local law providing for the administration and enforcement
of the NYS Uniform Fire Prevention and Building Code, and other provisions of
the Code of the Town of Charlton, all as set forth in the proposed local law
annexed hereto.
RESOLVED, that the Town Board of the
Town of Charlton designates itself lead agency for purposes of administration
of the State Environmental Quality Review Act, and it is further
RESOLVED, that the proposed local law
hereby is referred to the Town Planning Board of the Town of Charlton and the
County Planning Board for their review and comment, and to all other parties
entitled to notice, and it is further
RESOLVED, that the Town Board of the
Town of Charlton will hold a public hearing pertaining the proposed local law
and providing for the administration and enforcement of the NYS Uniform Fire
Prevention and Building Code and other provisions of the Code of the Town of
Charlton, which hearing shall be held on the 12th day of March, 2007
at 7:00 p.m. at the Town Hall of the Town of Charlton, 784 Charlton Road,

necessary to pay for these two quotes.
