The Regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Lippiello, Councilman Salisbury, Councilman Verola, Supervisor Grattidge, Town Clerk Heather Scribner.

 

Supervisor Grattidge lead the pledge of Allegiance.

 

APPROVAL OF MINUTES

Town Clerk Heather Scribner reported taking in $711.96 for the month of October, $160.23 was disbursed to the Supervisor and $551.73 to disbursing agencies.  A detailed copy is filed at the Town Clerks Office.

SUPERVISORS REPORT

Supervisors Report read for October 2006:

 

     I attended 8 Town meetings and 6 County meetings for the month of October. I also attended 2 job meetings for the Town Hall project. The Town Board conducted a series of Budget workshops in October and held a Public Hearing on October 30 for the budget. I also attended a Farm Tour on Saturday October 14 sponsored the Saratoga Farm Bureau.

    The Town Board is very concerned about the lack of progress at the New Town Hall. The Town Board has had a number of meetings about this project. The Town Board expects the General Contractor to build the Town Hall in the contracted time for the cost and according to the plans specifications that were approved by this Board. We will continue to keep the residents in formed about the progress of this project. 

 

SUPERVISORS ANNOUNCEMENTS

 

The Town Hall would be closed 23rd thru the 25th of November for Thanksgiving.

 

The Saratoga County Public Health released information regarding flu vaccinations clinics. More information is posted on the bulletin outside the Town Clerk’s Office.

 

The Saratoga County Department of Social Services released information regarding the HEAP program.  The program provides assistance to those in need of energy assistance this winter.  More information is posted on the bulletin outside the Town Clerk’s Office.

 

COMMUNICATIONS

 

Supervisor Grattidge received two letters from the NYS Office of Parks and Recreation regarding two grants that will not be funded for the town.

 

Supervisor Grattidge receive a letter from the Burnt Hills Ballston Lake Board of Education, he read the first two paragraphs:  The Burnt Hills Ballston Lake Board of Education is looking to the future and hopes you will join us in a new initiative to position our community to benefit from the changes that will be coming our way from the anticipated construction of the Advanced Micro Devices, Inc., (AMD) semiconductor Chip plant in Luther Forest Technology Campus in Malta.

 

We wood like to begin by meeting with Ballston, Charlton, Clifton Park and Glenville Supervisors and other town officials on November 30 to build knowledge base about the projected impact of AMD on our region and then to discuss next steps for an ongoing town/school district collaboration.

 

DEPARTMENT & COMMITTEE REPORTS

 

ANIMAL CONTROL

 

Animal Control Officer Lee Bramer reported one cat bite case, 2 reports of lost dogs, 2 deer complaints and 1 loose dog violation.  Mr. Bramer stated he is working on contacting those with over due dog licenses.  Supervisor Grattidge stated his wife found a dog on their property and contacted Mr. Bramer, he was there within the hour.  The dog was relocated with its owner.  The owner was very pleased.

 

ASSESSORS

No Report

 

CABLE

Councilman Lippiello received a request for cable from a resident on Sacandaga Road.  Councilman Lippiello stated he would contact Time Warner to see if they are running cable to that house.

 

COMPREHENSIVE PLANNING STEERING COMMITTEE (CPSC)

Member Marv Schorr reported that the consultant is working on a final draft of the Comprehensive Plan.  A Public Information meeting would be held sometime in February.  The meeting will be announced in the Town Board Newsletter.

 

CONSTABLES

Councilman Gardner read the Constables report for October.  There were 28 patrols, 11 911 calls, drove 2263 miles, issued 17 tickets, investigated 3 Accidents.

 

ENVIRONMENTAL CONSERVATION COMMISSION (ECC)

Chairman Marv Schorr reported that there was no meeting in October.  Chairman Schorr is working towards a hazardous waste collection day.  At this point it looks like the Town of Ballston, Town of Galway and the Town of Milton will be working together toward a Hazardous Waste Collection. 

 

E-GOVERNMENT

Councilman Lippiello stated the committee met in October.  They are working with the Town Historian to put together a fresh page of the town’s history.

 

EMERGENCY PLANNING

Councilman Gardner stated he has submitted to the town attorney the Saratoga County’s Emergency Plan for review. The next step would be to adopt the NIMS Plan for Charlton.  Councilman Gardner is working on a finding an Emergency Coordinator.  He attended a lecture at Albany Law regarding municipality disaster preparedness.  Supervisor Grattidge stated the town was working on generating a list of those residents who may need additional help in the case of a disaster.

 

HIGHWAY

Supervisor Grattidge stated the Town Board met this morning to open sealed bids for a multipurpose dump body for the new Highway Truck.  Highway Foreman Mike Emerich recommends awarding the bid specifications of option #1 to T & T Sales in Latham multipurpose body for the cost of $51,446.00.

 

HISTORIAN

Historian Linder announced several activities (all activities are posted at Town Hall):

Historian Linder gave special thanks for having a deputy Historian.

Historian Linder stated that the town has 6 historic site markers. There is one at each end of the Historic District and a bronze marker at Gideon Hawley Park. During this month there have been several requests for information regarding the Conde Family.  A historic marker marked the Conde Family is placed at the entrance to the Historic District on Stage Road.  The Conde Family was one of the original settlers that owned the land at the end of the Historic District.  The last inquire was for the McWilliam Family, the house that was tore down on Route 147.  Historian Linder stated when it comes to Charlton we have an incredible history.

 

Deputy Historian Dorothy assisted Historian Linder on finishing Charlton’s Chapter, a story that was submitted to the Saratoga County Historical Society at the Brookside Museum for an insertion to be placed in a book “In Our own words the Story of Saratoga County.  A thank you goes to Dorothy Mitchell, the Comprehensive Planning Committee and Howie Eskin in putting this together.

 

Historian Linder stated she would be attending a conference researching NY at Suny Albany.

 

Historian Linder stated that the Gazebo at Gideon Hawley Park is not handicapped accessible.  There are some folks that would like to go on the Gazebo who cannot get up there.  She suggested a ramp for a wheel chair.

 

Marv Schorr stated that Historian Linder would be speaking to the Charlton Seniors on November 29th.

 

HISTORIC DISTRICT

Historian Linder reported that November 15th is the next meeting.

 

JUSTICES

Councilman Lippiello read the following report submitted by Judge Bascom:

During the Month of October 2006, I adjudicated 24 cases.

 

Fines                     $1255

Surcharges             $ 495

 

TOTAL                   $1750

 

The Office of Court Administration has announced major changes in town and village courts throughout NYS.

 

1. All Courts will be provided computer, fax, and hardware.

2. All Courts will be on universal case management software.

3. All Court proceedings shall be recorded via digital recorder (provided).

4. Complaints against judges will rely on recordings.

5. Interpreters will be available to Courts via in person or speakerphone

6. Standardized forms will be used by all Courts.

7. Court Administration will be doing security assessments of the local Courts

8. Every judicial district will have a supervising judge who will annually visit Courts.

9. New Judges will have welcome wagon assistance.

10. The Resource Center service for Judges is expanded to 24/7 365 days.

11. Basic training requirements for new Judges is doubled.

12. Advanced training for existing Judges is restructured and expanded.

13. A Judicial Institute is established for training.

14. Credit cards as fine payment will be required. Equipment provided by State.

15. Electronic transfer of money will be required.

16. Electronic filing with State Comptoller will be required.

17. Courts will be required to pull their own DMV reports and Criminal Disposition Reports.

18. Office of Court Administration will audit Court records.

19. Town and Village Courts will require more resources from Town and Village Boards.

 

This is what I know right now about these sweeping changes impacting the local Courts which are expected to be announced to the general public by 11/23/06. Chief Judge Judith Kaye has said the changes will be implemented. 

 

Councilman Lippiello read the following report submitted by Judge Ketchum:

 

September and October Report of Fine Activity,

 

A total of 39 cases were handled during September reflecting: $1920.00 in fines, 120.00 in civil fees, 915.00 in surcharges for a total of 2955.00.

 

A total of 21cases were handled during October reflecting: $1090.00 in fines and 605.00 in surcharges for a total of 1695.00.

PARKS

Chairman George Eggleston stated the committee met last month.  The committee reviewed the Park Rules & Regulations.  Chairman Eggleston thanked Laura Linder for the suggestion to the Gazebo at Gideon Hawley Park.  We are open to any ideas or suggestions.

 

PLANNING BOARD

Town of Charlton Planning Board

Report to the Town Board

November 2006

The Town of Charlton Planning Board last met on Monday, October 16, 2006.  During this meeting there was just one subdivision application to discuss.

 

1)     Cuchelo  ( 235-1-33.1 )  Michele Cuchelo owns a large parcel of land on Route 147 which she would like to divide into 4 parcels.  Her application proposed a plan that does not meet Zoning Ordinance for the fourth lot in that the proposed 133 feet of road frontage does not meet the required 200 feet.  At the October 10th meeting of the ZBA, Ms. Cuchelo was granted her area variance for the 133 feet of road frontage that allows her application to continue before the Planning Board.  At the October 16th meeting, the Planning Board scheduled a Public Hearing for November 20th at 7:45 PM and determined the application to be complete for referral to the Saratoga County Planning Board.

2)     During 2006, the size of the Planning Board has temporarily been reduced to 6 members, based upon a decision to go to 5 members from 7.  For 2007, the Town Board needs to decide to complete the reduction to a 5 member Planning Board, or return to 7 members.  A poll was taken of the Planning Board members and the majority of those present would like to recommend to the Town Board to return to a 7 member Planning Board.  Consensus will be established in the November meeting and a recommendation provided to the Town Board.

3)     Now that the Planning Board files are current, and very few people have been coming into Town Hall on Tuesday evenings to seek assistance with subdivisions, Susan York, Clerk to the Planning Board, suggested to eliminate the scheduled Tuesday evenings [2 per month] and assist people on an on-request basis.   The Planning Board agreed and passed a motion to eliminate the scheduled hours.  The Clerk has always been available to give assistance, either by phone or when convenient for all parties.  Public notice will be provided via the Town’s website and the Town Newsletter. 

 

RECORDS ADVISORY BOARD

Chairman Heather Scribner stated the Records Grants is moving forward.  The records clerk Tina Bublak met with Consultants Jettner and Sickler for training.  An inventory of inactive records is underway.  The inventory has begun with the Town Clerks records and by the first of the year will be moving into other departments.  A notebook computer was purchased for the Town Clerks Office and is being used to build an inventory list of records.

TECHNOLOGY ADVISORY BOARD

Member George Eggleston stated he has worked with the Town Clerk Heather Scribner with conducting an inventory of equipment located in the storage area.

She will be putting a list together to incorporate in the equipment inventory.

 

TOWN CLERK         

Town Clerk Heather Scribner stated that she is working with the Technology Committee regarding a laser printer.  She has asked the Technology Committee to review software quotes for a program for the Town Clerks Office.  The software would not be purchased until 2007.

 

Town Clerk Heather Scribner stated that the office has sent out delinquent dog licenses.  She would like to get them in before the end of the year.

 

WATER DISTRICTS

Councilman Lippiello stated the Superintendent of Water is working on winterizing and working on the pump house.  The hydrant work is complete.  Supervisor Grattidge suggested to work on the project for 2007, the bypass and replacement valve.

 

ZONING ADMINISTRATOR

Zoning Administrator Dave LaFountain issued 10 permits, 4 C/O and collected $1917.00.

 

ZONING BOARD OF APPEALS (ZBA)

Councilman Gardner stated the last meeting the ZBA approved a variance for road frontage.  There will be no meeting for November.

COUNCILMAN REPORTS

 

Councilman Gardner stated that it has been a privilege to work with the board on many items that were worked on, discussions, frustrations and joy.  It has been a great year.

 

Councilman Lippiello stated the board has been working on the Employee Manual for sometime.  This board has been working on this for six months.  Sometimes it takes time to get through things.  We got through it and I believe we have a good Employee Manual.  Councilman Lippiello thanked Robert Killeen and all the people who worked the polls on Election Day.  Supervisor Grattidge stated that the Charlton Heights Elementary School has asked to have the polling place changed from the school to another location.  It is because a number of reasons one being new security procedures. We are looking at relocating to the New Town Hall by next year.

 

Councilman Salisbury thanked everyone involved with the budget process.  Councilman Salisbury stated that he believes we have a good budget and will improve every year.

 

Councilman Verola announced the Town Board Newsletter article submission cut off date is January 10th.

 

Supervisor Grattidge thanked Laura Linder and Dorothy Mitchell for gathering the information for the Proclamation Honoring the Vern and Alice Pashley.  A ceremony will be held at the Saratoga County Board of Supervisors on December 19th at 2:30pm.

 

PRIVLAGE OF THE FLOOR

 

The Charlton Snowmobile club is asking permission to run the snowmobile route on town property.  He understands the concern with the Town Hall Construction. The trail will need to be changed.  Town Clerk Heather Scribner received the liability Insurance from the Snowmobile Club.  The town board granted permission.

 

Mark Chowkoski- Asked who does the Employee Handbook Cover?  Supervisor Grattidge stated everyone.  It is defined in the handbook the classifications of employees.  Included is electronic protocol for computers and sexual harassment.  Mr. Chowkoski also inquired about the polling site change.  He said he was around when district 4 was moved to Harmony Corners Firehouse.  Back then wasn’t there an issue regarding how many people and how close the polling places could be together.  I think the town should look into it.  I think if you have 3 districts voting at the town hall it would be pretty jammed.  Councilman Grattidge stated there is also a possibility voting at the Charlton Girls School.  The reason for district 4 to move to Harmony Corners Firehouse was to address the parking issue.  We will look into another of sources before we move the polling place.  Dorothy Mitchell stated that once the new town hall is built the old town hall would be available.

Marv Schorr stated that the Saratoga County Green Infrastructure Plan draft is available on the county web site.  Supervisor Grattidge stated he would secure a copy for Town Hall if anyone is interested.

 

Supervisor Grattidge stated that he would not be attending the November 27, 2006 Town Board Agenda Meeting.

 

A motion was made by Councilman Verola seconded by Councilman Lippiello to enter into an executive session to discuss a personnel issue.

 

The town board convened, no action was taken by the Town Board in executive session.

 

Supervisor Grattidge adjourned the meeting of the Town Board at 10:30pm.
