The Regular meeting of the Town Board of Charlton, Saratoga
County, New York held at 7:30pm at the Charlton Town Hall, called to order by
Supervisor Grattidge.
Present: Councilman Gardner, Councilman Lippiello,
Councilman Verola, Supervisor Grattidge, Town Clerk Heather Scribner and Town
Attorney Robert VanVranken.
Absent: Councilman Salisbury
Supervisor Grattidge stated after the pledge of Allegiance there
would be a moment of silence in remembrance of 9-11.
A motion made by Councilman Lippiello seconded by Councilman
Verola, to accept the meeting minutes of the Town Board Meeting held on August
14, 2006.

Planning Board Chairman Raymond
Black shared with the town board a situation that occurred with a Planning
Board Applicant. It was indicated to
the applicant they could meet Zoning Ordinance if they had 200 feet of road frontage
for a new lot even though it is not continuous. The direction should have been that the lot would need to be
continuous. Chairman Black apologized.

TOWN CLERK REPORT
Town Clerk Heather Scribner reported taking in $930.88 for the
month of August, $142.84 was disbursed to the Supervisor and $788.04 to
disbursing agencies. A detailed copy is filed at the Town Clerks Office.

during the month of August is:

SUPERVISORS REPORT
Supervisor Grattidge reported attending 5 Town meetings and 6 County meetings for the month of
August. He spent a great deal of time working on the contracts and bonding
agreement in regards to the General Contractor for the Town Hall project. The
Town Board held workshops with the Finance Committee and the consultant working
on the Employee Handbook. The Board also met with the Town Engineer Jim
Mitchell and Water Superintendent John Morgan to discuss future water district
repair projects.
SUPERVISORS ANNOUNCEMENTS
Supervisor Grattidge announced the following:
Primary Day is September 12, 2006 the hours for voting is
12:00pm – 9:00pm.
The Town Board will be conducting Budget Work Shop Meetings
during the Month of October. The time
will be announced.
The Zoning Board of Appeals will hold a Public Hearing on
September 12, 2006 at 7:45pm at the Historical Society School House.
The Saratoga County Planning Board is conducting a training
class called Making a Good Record, minutes, findings, discussions and
documents.
COMMUNICATIONS
Supervisor Grattidge stated the town received correspondence
from the Attorneys representing the town’s insurance company in the matter of
Thomas Miller VS Town of Charlton, Dream Ponies. The cover letter read:
I am employed as an attorney for the capital region staff
council Selective Insurance and have been assigned to represent the town of
Charlton in the above matter. The
appropriate legal steps have been taken to protect the town’s interest
including the service of an answering of appropriate disclosure demand. A copy is enclosed for your files. (A copy is filed at the Town Clerks
Office) Supervisor Grattidge stated he
would continue to keep everyone informed.
Supervisor Grattidge stated the town received a letter from the
office of Tabner, Ryan & Keniry.
The letter read: On August 17, 2006
I received materials from Donald Zee attorney for Bordeau Builders in
connection with the Water District Extension relative to the approval of
reality subdivision lands pertaining of Capitol Reality on Crooked Street in
the Town of Charlton. The material has
not been reviewed they were delivered to the town designated engineer who will
review the papers on behave of the town.
The review is not expected to occur until the developer funds an escrow
account intended to cover professional fees for reviewing the submission. On September 8, 2006 I sent the developer
attorney a letter to that affect.
DEPARTMENT & COMMITTEE REPORTS
ANIMAL CONTROL
Animal Control Officer Lee Bramer reported 1 deer pick up, 2
calls regarding fox around the Aplaus Creek area, 1 raccoon call and 2 loose
dog calls. Mr. Bramer stated one of the
loose dog calls was taken care and the other is being monitored. Mr. Bramer reported he received 3 complaints
and a dog bite case has been reported that resulted in a dangerous dog to be filed. Mr. Bramer reported 1 wild life case
regarding a red squirrel.
Mr. Bramer stated he had met with Councilman Gardner to discuss
the town’s dog ordinance.
Mr. Bramer stated he would target areas for the dog
enumeration. Town Clerk Heather
Scribner stated the Town Clerks Office calls residents who are delinquent with
there dog licenses. There has been some
confusion with the dog license renewals because of the change of due date.
ASSESSORS
Chairman Victoria Hayner stated that school taxes have been
issued and residents are confused when they received their tax bill and it
states Assessed value and Full market value.
That is due to the 84% equalization rate. There have been a few corrections. The Assessors Office posted on the door of the Assessors office
the STAR rebate and all school tax rates.
The Assessors will evaluate whether or not to do a revalve this year or
to wait one more year. Houses are still
selling for a lot more than what they are assessed.
CABLE
Councilman Lippiello stated a few residents on Route 147 have
asked to be included in the cable extension.
All of the homes who had an inquiry are to be included. One resident will have to dig his own ditch
to be included. Supervisor Grattidge
stated he received an inquiry from a resident on upper Jockey Street
unfortunately Time Warner quoted him $4000.00.
The resident was not happy.
COMPREHENSIVE PLANNING STEERING COMMITTEE (CPSC)
Member Marv Schorr stated the Comprehensive Planning Steering
Committee received its first draft from the consultant. The draft will be released to the Town
Board, Planning Board, Zoning Board of Appeals and the town’s web site. The CPSC is currently reviewing the draft
for any major errors or admissions. The CPSC meets the first Monday of each
month.
CONSTABLES
Councilman Gardner read the Constables report. There were
28 patrols, 7 911 calls, drove 2453 miles, issued 24 tickets, 2 Accidents and
received 8 complaints.
ENVIRONMENTAL CONSERVATION COMMISSION (ECC)
Chairman Marv Schorr stated that the ECC reviewed a variance
application from the Zoning Board of Appeals.
Chairman Schorr stated that there has been a lot of interest
regarding hazardous waste disposal. He
had spoken with a supervisor from another town who expressed interest of the
program. Therefore, it is possible that the town may have a collection next
year. In the mean time a few articles
would be in the town’s newsletter on how to dispose some items. Supervisor Grattidge suggested meeting this
fall with some of the towns who are interested in the hazardous waste program
and start putting together some type of out line. Chairman Schorr stated the program worked well during the
fall. There is a 50% state reimbursement
on any funding the town spends on the program.
E-GOVERNMENT
Councilman Lippiello stated that the E-Government Board is not
requesting any funds for the 2007 Budget.
EMERGENCY PLANNING
Councilman Gardner stated the committee is still in recess. The town board and the town clerk are
schedule to attend a NIMS training class on September 14th.

Miscellaneous Items
The Towns of Ballston, Greenfield
and Malta have agreed to sell us sand. At the same price as last year. This was
a dollar per ton.
We also need to start buying new
street signs for 2008.
Highway Foreman Mike Emerich stated the town would need to
replace all the street signs to a 6inch lettering before the year 2008. There are approximately 130 street signs to
be replaced and anticipating replacing half this year. The town could add the town’s logo for an
additional fee of $1.00 per a sign.
Supervisor Grattidge stated the town is responsible for the county and
state road cross over signs.
Superintendent of Highways Ron Gavin stated the highway
department is coming along well with the paved roads from the CHIPS program. The CHIPS fund has $4,646.00 left and the
General Repair fund still has enough funds for a culvert on Division Street and
work on Root Road.
Superintendent of Highways Ron Gavin requested a transfer of
$8,800.00 out of an escrow account to double seal to Saddlebrook Lane. Additional costs would come out of general
repairs. Supervisor Grattidge stated
the town board would take care of it at the next meeting.
HISTORIAN
Historian Laura Linder stated it had been 5 years since
9-11. She has a slide show documentary
of the Town from 9-11 that did not cooperate and is hoping to present the
documentary on another way such as Power Point in the future.
Historian Linder announced several activities (all activities
are posted at Town Hall):
Capital Region Archives Dinner at the Governors Mansion October
4th. The Historian and Deputy Historian
would be attending.
Records Advisory Board will display town records at the October
10th Town Board Meeting for Archives Week.
In Celebration of NYS Archives Week the Charlton Historical
Society will hold its monthly meeting on October 11th at the Ellms
Family Farm 448 Charlton Road 7:30PM.
At the farm open house the Ellms Family will tell the story of their
farm and its changing variety of crops and industries, and of their research
and use of historical resources to develop the theme and educational program of
their annual corn maze. Their
introduction to The Erie Canal Days Corn maze will be followed by an optional
moonlight hayride.
The Town Directory feature cover will be the Charlton’s Sons
& Daughters of Liberty Fife and drum Corp.
On October 15th the Harmony Hall will hold its pie
festival.
HISTORIC DISTRICT
Historian Laura Linder reported the Historic District is working
on a giving out a better presentation.
They will be putting together a folder that could be handed out to all
the residences to the district.
JUSTICES
During the month of August Judge Bascom adjudicated 55
cases. Submitted to the State Comptroller $2610.00 in Fines, $105.00 in
Fees and $1315.00 State Charges.
During the month of August Judge Ketchum reported 34 traffic
cases submitted to the State Comptroller $3,606.00 in fines and 43 notices of
license suspensions were sent to the Department of Motor Vehicles for motorist
not responding to court appearances or failure to pay a fine.
LIBRARY

PARKS
Chairman George Eggleston stated the Park Committee is working
on cleaning and painting the bleachers and staining the new pavilion at Elmer
Smith Park.
PLANNING BOARD

The
Town of Charlton Planning Board last met on Monday, July 17, 2006. During this
meeting there were no Public Hearings.
Two subdivision applications were reviewed and one ZBA referral
discussed.
1)
Cuchelo ( 235-1-33.1
) Michele Cuchelo owns a large parcel
of land on Route 147 which she would like to divide into 4 parcels. Her application proposed a plan that does
not meet Zoning Ordinance for one of the four lots in that the required 200+
feet of road frontage is not continuous.
Ms. Cuchelo was referred by the Planning Board to the ZBA to pursue a
variance or ordinance ruling unless she was willing to request only three lots. Ms. Cuchelo has applied to the ZBA and will
be heard in September.
2)
Casey
(237-1-17.1): The applicant came
before the Planning Board to apply for a four lot subdivision on Sweetman Road
to create three new lots to sell. The
Planning Board accepted the application as complete and scheduled the Public
Hearing for August 21st at 7:45 PM.
3)
Doman (256.10-2-22):
Mr. Doman has applied to the ZBA for an area variance to construct a
carport on his Callaghan Blvd. home.
The application was referred to the Planning Board for comments prior to
the August meeting of the ZBA, and feedback has been provided.
RECORDS ADVISORY BOARD
Town Clerk Heather Scribner reported that the board met last
month and reviewed the grant project.
TECHNOLOGY ADVISORY BOARD
Councilman Gardner stated the board is working on the
specifications for a server for the town.
Last month the board reviewed several quotes on a laptop for the Town
Clerk.
TOWN CLERK
Town Clerk Heather Scribner stated the Town Clerks Office has
been busy issuing Hunting and Fishing Licenses. The computer system was down for a few days and is now up and
running. A keyboard was replaced. All
equipment is covered through the state and is no cost to the town.
TOWN HALL
Councilman Verola stated the Town Hall Project is moving
forward. There had been a few minor
contractual items with the general contractor. With the help from the town
attorney they have been resolved.
Supervisor Grattidge stated there would be two records of
photography. The General Contractor and
the Owners Representative is responsible to turn over photographs. The current area that is marked off is the
septic. A small portion of Gideon
Hawley Park is being used to put the job trailers on because of the need to get
power and telephone hook up. A
temporary fence would be placed through the Park. During the winter snowmobiles will still be able to get
through. There was some concern from
the Historical Society regarding next year’s Memorial Day service. Supervisor Grattidge stated the town would
have to wait until next spring to see where things are at.
WATER DISTRICTS
Councilman Lippiello stated he had met with Superintendent of
Water John Morgan and Jim Mitchell from Environmental Design Partnership. The week of the 20th is when Mr.
Morgan was looking to have the new hydrants in. Mr. Morgan has been busy with meter replacements along with 2 new
hook ups on Lake Hill Road.
ZONING ADMINISTRATOR

Administrator Dave LaFountain stated he issued 15 permits; 9 Certificate of
Occupancy’s and collected $2,111.00.

scheduled for September 12th.

COUNCILMAN REPORTS
Councilman Gardner thanked Councilman Lippiello, Jim Mitchell
and Superintendent of Water John Morgan for the water district
presentation. Thanked Lee Bramer Animal
Control Officer for meeting and discussing the dog ordinance.
Councilman Lippiello stated he is glad to see the Town Hall
moving forward.
Councilman Verola stated she arranged to have a meeting with Bob
Martinson the towns bookkeeping software provider on September 27th,
7:00pm at Town Hall.
PRIVLAGE OF THE FLOOR
Assessor Vicky Hayner stated she had passed her notary
exam. She is now able to notarize
documents.
After everyone had a chance to speak who wished Supervisor
Grattidge adjourned the meeting at 8:32 pm.
