The Regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Salisbury, Councilman Verola, Supervisor Grattidge and Town Attorney Robert VanVranken.

 

Absent:  Councilman Lippiello

 

A motion made by Councilman Gardner seconded by Councilman Verola, to accept the meeting minutes of the Town Board Agenda Meeting held on May 30, 2006.

ABSTRACT OF CLAIMS

 

A motion made by Councilman Verola seconded by Councilman Salisbury to accept General Fund Claims No. 1422-1545 in the amount of $92,486.27 as set fourth in the abstract No.106.

 

There were three vouchers and checks voided due to the services not rendered on account A-7550.4 Celebrations.  The following vouchers are Voucher #1435 to Larry Rundle for the amount of $300.00, Voucher # 1532 to Dream Ponies for the amount of #200.00 and Voucher #1542 to Bert Wilson for the amount of $100.00.

TOWN CLERK REPORT

 

Town Clerk Heather Scribner reported taking in $3,072.13 for the month of May, $2,829.61 was disbursed to the supervisor and $242.52 disbursing agencies.  A detailed copy is filed at the Town Clerks Office.

SUPERVISORS REPORT

 

Supervisor Grattidge reported he attended 8 town related meetings and 7 Saratoga County meetings.  The town board met with a resident who is interested in creating a memorial park.  The town board met with AMTEK PS to gather information about an employee handbook.  The town board met with the Town Attorney and Architect to discuss the new town hall project.

 

Supervisor Grattidge gave thanks to all the volunteers who helped with the Founders Day Weekend.  Supervisor Grattidge thanked the Superintendent of Highways Ron Gavin and his men.  He thanked Senior Constable Tom Parks and his men who helped with the traffic control. Also thanking the Historical Society for all their hard work.  Supervisor Grattidge stated it was a great event even with the bad weather.  Supervisor Grattidge stated the 5k race was run in the rain with well over 100 racers.

 

Supervisor Grattidge stated he had authorized the purchase of a computer virus update for the bookkeeper’s offices from HELPCO, it was less than $200.00.

 

Supervisor Grattidge stated the town board had approved funds last month for a Highway computer the purchase totaled $949.34 which includes a laser printer.  There were two other quotes from vendors one at $1120.00 and the other was $1339.00.

 

Supervisor Grattidge received a notice from Senator George Winter the NYS Legislative Commissioner on Rural Resources.  The noticed stated that the state has passed a volunteer Firefighter and Ambulance worker tax credit.  The state legislature included a $200.00 state income tax credit for 2006-07 state budgets.  Beginning in 2007 a resident tax payer who serves as an active Volunteer Firefighter or Volunteer Ambulance worker will be allowed the credit.

 

Supervisor Grattidge stated he has signed an agreement with AMTEK for professional services to put together an employee handbook.  Supervisor Grattidge stated he has forward to AMTEK the towns Organizational Resolutions and other town policies.  Mr. Travers, AMTEK Representative will present a draft to the town board after July 4th.

 

ANNOUNCEMENTS

 

Supervisor Grattidge announced that Sundae on the Farm will be held on June 18th.  The event is hosted by the Smith Bros. Dairy and Orchard Bake Shop located on Jockey Street.  There will be tours of a working dairy farm and Orchard and Bake Shop.

 

Supervisor Grattidge stated that Saratoga County Clerk Kathy Marchione has announced that the DMV is now taking appointments.  Anyone wishing to schedule an appointment can do so by calling the DMV locations.  The DMV locations for Saratoga County are Wilton Mall, Clifton Park Center and Ballston Spa 885-2227.  Flyers are available at the Town Clerks Office.

 

Supervisor Grattidge stated that Community Human Services (CHS) will hold a meeting on Thursday June 22nd at 7:00pm located at 533 Saratoga Road, Glenville.

Supervisor Grattidge announced on June 27th at 1:00pm Little Troy Park will hold a celebration for their 50th year.  A resolution will follow congratulating Little Troy Park.

 

Supervisor Grattidge announced that the Town Hall will be closed for the Holiday on Tuesday July 4th

 

Supervisor Grattidge announced the Assessor’s Office will be closed on Saturdays.  Chairman Vicky Hayner stated the Assessor’s Office will begin opening on Saturdays starting in January.  The Assessors open hours are Tuesday 9am-12:00pm, Tuesday evening from 7:00pm-9:00pm and Thursday 9:00am-12:00pm.

 

COMMUNICATIONS

 

Supervisor Grattidge stated he received a letter from a resident.  The letter read:

Alan, I want to thank you and compliment you and the town on a successful picking up the trash program, I know it helps me keep my yard, barn and free from the clutter that appears out of know where, especially large cardboard boxes and almost everything that arrives these days.  I tell colleagues about the program and always hear envious comments.  The visual beauty of our town is enhanced by the program and I would suggest that it may even serve to reduce the likelihood of fires.  P.S. Any thought to expand the program to household waste items such as solvents paints and brushes.  Supervisor Grattidge stated we had a program on Hazardous Waste and it was successful.  It was with the Town of Milton and the Town of Ballston, unfortunately some of the funding we were receiving with other towns is not available.  Supervisor Grattidge stated a Hazardous Waste program would continuously be looked into.

 

Supervisor Grattidge stated he received a letter from the State Board of Real Property.  Supervisor Grattidge read a portion of the letter that read.  On May 15, 2006 the State Board of Real Property Services established a tentative 2006 state equalization rate of 84% for your municipality.  This equalization rate was computed using data from your municipal tentative assessed roll.  If final assessed roll data produces a significantly different rate we will recompute the equalization rate and notify you.    Supervisor Grattidge stated the equalization rate did not come up at 100% as anticipated.

 

Supervisor Grattidge stated the town board has received a letter from the Environmental Conservation Commission regarding the towns Open Burning Ordinance.  The town board will discuss the Burning Ordinance at a future Agenda meeting and decide weather or not to amend the Local Law.

 

DEPARTMENT REPORTS

 

Water Superintendent John Morgan stated he has had telephone calls in regards to the people who pay for water in the Town of Charlton.  They are only the people who are in the boundaries of the water districts.  Not the whole town.  District #1 has 7 extensions and there is a district #2, which is on Acorn Drive.  The only thing done in district 2 is maintaining the materials that are in the ground.  The water surface from the curb box from the house is all done by the Town of Ballston and is billed by the Town of Ballston.

 

Water Superintendent John Morgan stated the water tower was inspected last week and the extreme of it (do not have the report back yet) if it is completely refurbished it would cost $323,400.00.  Rebuilding the fire hydrants you are talking $7000.00 a piece and there are 4 of them to do.  Mr. Morgan stated the other item on his list is the repair at the pump station and the repair at the intersection of Beechwood Drive and Stage Road.  They are two projects that are going to be extensive. Right now he is trying to set up with a contractor to meet with the engineer to get a basic idea how to approach these projects.

 

Mr. Morgan stated if nothing is done with the water tower then he thinks the town should seriously consider getting quotes on getting the water tower pressure washed to get the rid of the mildew, if you don’t it will ruin the paint.

 

Mr. Morgan stated the results of the water tower inspection will be sometime in August.  The other item on the list is the engineering progress of chlorination.  Mr. Morgan stated at this point it is a dead issue, due to the fact for the extensions in the water district.

 

Mr. Morgan stated he has been notified that there is a 6 inch gas main in front of the Pump Station, it has a leak.  It will be dug up in front of the Pumphouse.  If anyone sees activity there, it is not for water it’s for natural gas.

 

Mr. Morgan stated on Friday Ross Valve will change over electrical services in the Pumphouse, they will replace both valves, the only thing we can contribute it to is so many drops in power.  The valves were put in; in 1989 the usefulness is at trails end at this point.    Mr. Morgan stated he has not got any prices because it is a job that has to be done.  The reason it is not being done instantly, it’s being run on a 240 service and no one has 240 relays in stock, they had to be ordered. 

 

Mr. Morgan stated he would be meeting with a Contractor and Jim Mitchell the Engineer for the Water Districts to discuss how both projects will be done.  It is a difficult situation simply because we get our water from the Town of Glenville and if it were to be picked apart we have no way of getting water to the residents of the Town of Charlton.  The same problem is at the intersection of Beechwood Drive because it is on the transmission line.  Supervisor Grattidge asked Superintendent of Water John Morgan to keep the town board posted.

 

ANIMAL CONTROL

 

Councilman Gardner stated the Animal Control Officer has had a busy month.  There was one dog bite in the town and a dangerous dog case was issued.  The case went in front of the Justices and is being worked through.  At the wild life end there were two foxes underneath a porch and at another home there were coy dog puppies underneath a porch.  A raccoon was found acting strange although it came back negative for rabies.  Finally, there were 3 lost dogs this month.  Councilman Verola stated were the lost dogs put on the town’s website.  Councilman Gardner said he would find out.

 

ASSEMENT REVIEW BOARD

 

Town Clerk Heather Scribner stated she had received a copy of the Grievances from the Chairman of the Assessment Review Board Eva Bulter.  Assessor Chairman Vicky Hayner stated there were 3 Grievances this year and 2 stipulations.

 

ASSESSORS

 

Chairman Vicky Hayner stated Grievance Day went very well.  The Assessors Office is now moving ahead on the 2007 roll.  Chairman Hayner stated the final roll for 2006 will be out on July 1st

 

Chairman Hayner stated this summer you will see the two other Assessors Robert Cromie and Weasley Weaver out taking photos of homes to ensure all the Assessors files have photos, we are trying to keep the files update as far as photos.

 

Marv Schorr asked if there was any discussion made on reassessments because

84% equalization rate is not too good.  Assessor Chairman Hayner stated the Assessors are going to look ahead this fall to see if we should go to 100%.  The real estate has seemed to be going down, although there are a bunch of sales to post, this should give a good indication on what has happened in the last couple months.  The Assessors will review over the summer and into the fall.  Chairman Hayner stated 84% isn’t horrible in fact a lot of towns in the county who have always done annual assessments and kept their rate at 100% decided not too, they found it a very awarding experience.  It is much easer to stay at 100% because people understand it.  When the Assessors raise residents at 100% they think they are getting double, they think their assessments are going up and their taxes are going up.  Chairman Hayner stated the job of the Assessor is to keep an equitable roll.  Your tax rate will be higher this year due to the School levy.  It is not due to the town board or government.

 

CABLE

 

Supervisor Grattidge stated he is checking with Time Warner on their progress with this year additions.  A section of Jockey Street is wired and no sight of other areas. 

 

COMPREHENSIVE STEERING COMMITTEE

 

Member Marv Schorr stated the board has reached a point where they have sent out the final goals and strategies to the consultant to write the text of the Comprehensive Plan.  Mr. Schorr stated he did not know how long it would take.  A tentative meeting is scheduled is for June 26th in case the text is received if not July 17th will be the next meeting.  Once the text is received by the Comprehensive Plan Steering Committee they will reviewed it, have a public hearing and present it to the town board.

 

CONSTABLES

 

Councilman Gardner read the Constables report.  There were 26 patrols, 8 911 calls, drove 1993 miles, issued 34 tickets and received 9 complaints.

 

 

Environmental Conservation Commission (ECC)

 

Chairman Marv Schorr stated the ECC submitted a letter of recommendation to the Town Board on the Open Burning Law. 

 

Chairman Schorr thanked the town board for the continuing support with the Roadside Cleanup and the Tree Giveaway.  The tree giveaway is extremely popular and the roadside clean is fun for family’s and organizations.  Chairman Schorr thanked the Highway Department it couldn’t be done with out them.  Chairman Schorr gave thanks for the coffee that was donated by the Charlton General Store, also to Smith Bros. Farm Bakery for donating donuts.

 

Supervisor Grattidge stated there is a problem with people depositing tires on rural stretches of roads.  Within the last month the Highway Department reported 3 tire dumps.  The constables were notified and if anyone sees someone doing something along these lines please notify the town immediately.

 

Chairman Schorr stated the Tree Giveaway has gotten to the point where all the trees are given out within 20 minutes.  The ECC is considering expanding the Tree Giveaway; there has been more money in the budget than the ECC is spending.  Based upon the past 2 years the trees have been given out so fast by 12:30pm when residents come they are disappointed that they are all gone.

 

Chairman Schorr stated he received a complaint from a resident regarding the Bulk Item Pickup.  It was noticed when County Waste was picking up the bulk items such as refrigerators they were thrown into their trucks then crushed.  That is contrary to federal law, the refrigerant must be drained even whether or not it is Freon you can not just crush them.  By the time the ECC found out what the federal law was the Bulk Item Pickup was done.  Chairman Schorr stated that County Waste needs to be notified for next year’s collection.  Supervisor Grattidge requested that ECC forward a copy of the law to him and then he would forward it to County Waste.  Supervisor Grattidge the Bulk Item Pickup was very successful.

EMERGENCY PLANNING

 

Councilman Gardner stated the board met last month at Harmony Corners.  Fire Chief Dean DeCapria presented an over view of what had been done with the Emergency Plan in prior years.  Councilman Gardner stated at the request of the county the board will break from meeting until the Saratoga County Plan has been complete.

 

Councilman Gardner stated that the Saratoga Emergency Planning has offered a training course called NIMS 700. It is a course that will be required for the town board members and others.  It is at no cost to the town and last about 2 hours.  Councilman Gardner stated the Highway Department and Constables could also take the course.  Councilman Gardner stated the town can not go forward with an Emergency Plan procedure without taking the course.

HISTORIAN

 

Historian Laura Linder thanked everyone who volunteered on Memorial Day.  There were 60 people who came out to help decorate the graves.  Attended was Howard Baxter who started this event over 15 years ago.  He shared stories and spoke about how important it is to share this day.  A youngster attended her 9th time to the Memorial Day event, she had started attending when she was in the Middle school and now is graduated in Public History.  Ms. Linder thanked Dorothy Mitchell, Dan Steadman, Judy Curtis and the Smith Family children with completing the Memorial Day project.

 

Historian Linder stated there was a press release done on Founders Day by Bill Huel, at the end of the article he talked about the Mohawk Indians and how they came and done the massacre way back when around the Gonzalez Family time.

Historian Linder stated there were old fashion games done at the Part in the Park by the Burnthills Rotary. It was a huge success and a lot of fun.

 

Historian Linder shared how difficult is to get a color guard for the Founders Day Parade. A veteran from the Sacandaga American Legion carried a flag during the parade. Rick Renyolds was dressed in a colonial costume and someone playing the part of ancestor carried another flag.  Jim Shults the Superintendent of Schools for BHBL and Tim Sinneburg Principal of Charlton Heights marched in the Founders Day Parade as the color guards.  There were 15 students carrying the Town Banner.

 

Historian Linder stated she spoke to the Charlton Seniors on Charlton’s 10 one room schools.  She also gave an annual presentation to the 4th graders at Charlton Heights known as Picture Show Day.

 

Historian Laura Linder and Deputy Historian Dorothy Mitchell attended 2 conferences one was at the Columbia University in NYC for the State Association of Public Historian in conjunction with 27th NYS History Conference.  The other conference was at the NYS Institute in Albany.

 

Historian Linder stated the Historians office was asked to gather photos for Sundae on the Farm and to ride on a wagon giving history tours.

 

Historian Linder stated she received from Senator Hugh Farley two publications on Historic Sites.

 

HISTORIC DISTRICT

JUSTICES

 

Supervisor Grattidge read the following report submitted by Judge Bascom.

During the month of May he adjudicated 34 cases.  Submitted to the State Comptroller $1715.00 in Fines, $35.00 in Fees and $990 State Charges for a total of $2,740.00.

 

Supervisor Grattidge stated that Judge Ketchum has received his laptop computer, all software is loaded on to the computer.  He is now able to bring it to court.

 

LIBRARIES

 

Present was Toni Olsen a Board Trustee for the Town of Ballston Community Library.  Ms. Olsen stated the library now offers computer workshops.  The library has several work stations for public to use.  One of the workshops offered is basic internet skills.  Ms. Olsen shared that the library is starting the summer reading program for school age children.  Ms. Olsen reported for the Town of Charlton there were 959 card holders from the Southern Adirondack Data base.  She said there are errors with the data resulting from the 12019 zip code. It is due to the zip code being in several different areas.  The library is working on getting an accurate number.

 

PARKS

 

Chairman George Eggleston stated after June 16th the construction of the pavilion at Elmer Smith Park will start.  A grant is in progress for the Bridge at Elmer Smith Park.

 

PLANNING BOARD

Councilman Verola read the following report:

 

Town of Charlton Planning Board

Report to the Town Board

May 2006

The Town of Charlton Planning Board last met on Monday, April 17, 2006. During this meeting, no  public hearings were held, three open subdivision applications were discussed, a lot line change was finalized, and a pre-application conference was held.  In addition, one referral from the Town of Galway Planning Board and one referral from the ZBA were discussed.

 

1)     Heflin/Durst (255-1-40.1,41, 43.1, 43.2, 43.3): Twenty three lot subdivision of 87 acres owned by Gary Heflin and Dean Durst on Swaggertown Road. The subdivision application was accepted by the Planning Board in June, 2005.  Per agreement reached in April, this application will be suspended from the Planning Board agenda until the applicant, or his legal council, specifically request reinstatement on the agenda.

2)     DeNooyer/Van Guilder (235-1-44 & 235-1-67.2):   The applicant desires a two lot subdivision of 80+ acres on route 147. Concerns regarding acceptable soil and water conditions for adequate perc, raised in January’s public hearing, led to a request for perc tests on the subject parcel.  Perc tests were completed, but the Planning Board has requested that perc test locations and results be added to the survey map, along with the exact location of the well and DEC wetland delineations.

3)     Kenyon/Van Guilder  (223-1-11.11):   This four lot subdivision application was new for March.  The applicants own 22.92 acres on Rocky Ridge Road and Jersey Hill Road, and request to create 3 new building lots.   Planning Board has scheduled a Public Hearing for May 15th at 7:45 PM, and has requested additional information regarding septic system design and location be presented at the May meeting.

4)     Fitzgerald  (246-3-92):   This lot line change application was new in April.  It transfers a small amount of land to follow natural contours and stone wall locations on Saddlebrook Lane and was accepted by the Planning Board.  Resolution 2006-06  was passed.

5)     Cuchelo  (235-1-33.1)   This pre-application conference was requested to discuss tentative plans for the division of a large parcel on Route 147 into 4 building lots.  The Planning Board was able to offer the owner a variety of helpful suggestions.

6)     Lent  (213-1-51)   Town of Galway referral of an application for a special use permit for a horse-boarding operation, located on Featherbed Lane, on land in both Charlton and Galway.  Planning Board Attorney William Keniry has written to the Town of Galway Planning Board, in advance of their Lent Public Hearing on April 25th, and Chairman Raymond Black attended the public hearing.  No further action will be needed regarding the portion of land in Charlton.

7)     Barnes  (236-1-4.2)   ZBA referral of an area variance on Division Street for which the Planning Board has “no comment”.

 

 

RECORDS ADVISORY BOARD

 

Chairman Heather Scribner stated the Records Advisory Board is meeting on June 19th at 7:30pm.  Chairman Scribner received a regret response to a records grant submitted last year.   The Records Advisory Board is still awaiting another grant that was submitted on active records.

 

TECNOLOGY ADVISORY BOARD

 

Councilman Gardner stated the board met last month.  The board reviewed the cost purchase for a Highway Computer.  A computer has been purchased from DELL for $939.34. 

 

Supervisor Grattidge will find out if the anti- virus protection software that was purchased for the bookkeeper is for more than one user.   Board Member George Eggleston stated you can receive the anti-virus update through the internet.  It is the responsibility of the department using the computer to make sure the software is updated, unless you are on a network.  Once everyone is in the new town hall and we have a network, there should be a blanket contract for all computers.

 

Councilman Gardner stated that members of the Technology Board are attending a Cyber Security Conference.

 

TOWN CLERK

 

Town Clerk Heather Scribner stated the Town Clerks Office has completed the issuance of bid specifications to bidders for the new town hall project.  The Clerks Office has organized its handicap parking permit to a data spread sheet.  This is to help search for renewals and expired permits.  The issuing of fishing licenses has picked up during the last month.  Councilman Verola stated when you purchase hunting or fishing license you can now donate a $1.00 towards feed the hunger program.  Brochures and information are available at the Town Clerks Office.

 

TOWN HALL

 

Councilman Verola stated that the town board is ready to award the bids to the contractors.  Supervisor Grattidge stated that Ground Breaking for the new town hall on June 26, 2006 as to schedule.

 

ZONING

 

Zoning Administrator Dave LaFountain stated he issued 16 permits, 4 Certificate of Occupancy’s and collected $3,313.00.

 

 

ZBA

 

Town Attorney Robert VanVranken stated that the Zoning Board of Appeals is meeting on June 13th.  The board will hear two applications at 8:00pm and 8:30pm for a temporary certificate of occupancy based upon the recent fire losses.

 

PARTY IN THE PARK

 

Supervisor Grattidge stated with the way the weather he was very happy the way it went.  Supervisor Grattidge gave thanks to the Rotary group, Laura Linder and Sandy Kominoski, they did a fantastic job with the old fashion games.  Supervisor Grattidge stated the Party in the Park Committee will meet once again to discuss how it all went and ideas for next year.

 

SENIORS

 

Marv Schorr stated the seniors have had some interesting speakers in the last year, the Town Historian spoke on the one room school houses and the history of education.  It was a very interesting discussion.

 

President Midge Dube stated the Charlton Seniors are interest in having a senior picnic at Elmer Smith Park.

COUNCILMAN REPORTS

 

Councilman Gardner stated a lot is going on and he is finding it rewarding.  He would like to thank everyone for the knowledge and help with getting up to speed.  Councilman Gardner stated he was impressed with all the people who attended the Party in the Park.

 

Councilman Salisbury stated he is impressed with the Party in the Park event.  The fireworks were excellent.

 

Councilman Verola stated the Party in the Park was successful.  The firemen sold all their food.  The Ernie Williams and the Wild Cats band were fantastic.  She thanked the Highway Department, Constables and the Park Committee for preparing the Party in the Park event.

 

PRIVLAGE OF THE FLOOR

 

Laura Linder encouraged citizens to support their local farms.  There are a few family owned farms that have had to sell their dairy cows.

 

Laura Linder stated a meeting was held regarding the Saratoga County Green Infrastructure.  If you had missed the meeting they will be meeting in the Town of Galway.

 

Supervisor Grattidge adjourned the meeting at 9:10pm.
