The Regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Gardner, Councilman Lippiello, Supervisor Grattidge and Town Attorney Robert VanVranken.

 

Absent:  Councilman Salisbury and Councilman Verola

 

A motion made by Councilman Gardner seconded by Councilman Lippiello, to accept the meeting minutes of the Town Board held on April 10, 2006.

A motion made by Councilman Gardner seconded by Councilman Lippiello, to accept the minutes of the Town Board Agenda meeting held on April 24, 2006.

ABSTRACT OF CLAIMS

 

A motion made by Councilman Gardner seconded by Councilman Lippiello to accept General Fund Claims No. 1332-1421 in the amount of $46,695.93 as set fourth in the abstract No.105.

 

A correction was made to Voucher #1441 account DA-5110.4 General Repairs $3,464.18 was corrected to $2,050.42 and DA-5112.2 Chips fund amount $5,605.31 was corrected to $7,019.07.  The description of work for account DA-5110.4 General Repairs is for Sweetman Rd and Vines Road.  The description of work for account DA-5112.2 Chips is for Waite Rd, Old Stage Rd, Oak Lane, Crawford Dr. and Meadowbrook Lane.

TOWN CLERK REPORT

 

Town Clerk Heather Scribner reported taking in $2,983.47 for the month of April, $2,875.52 was disbursed to the supervisor and $107.95 disbursed to agency’s.

Supervisor Grattidge stated there were no disbursements for the New Town Hall Project.

SUPERVISORS REPORT

 

Supervisor Grattidge reported for the month of April he attended 6 town meetings and 5 county meetings.  He also attended the installation of officers for the Harmony Fire District.  He had a number of meetings concerning the New Town Hall Project.  The project is now out to bid and the bid opening will be May 16, 2006.

 

ANNOUNCEMENTS

 

  • Saratoga County Board of Supervisors is sponsoring a Vietnam Memorial Moving Wall,  June 8th – June 12th at the Shenantaha Park on Eastline Road in the Town of Malta.
  • Town Wide Bulk Item Pick-up: May 8 – May 12 .  County Waste started today and will only make one pass thru town.
  • The Saratoga County Department of Public Works and the Charlton Highway Dept replaced a major culvert on Vines Road and avoided a major flooding problem from the last rainstorm.  Thank you for the help and cooperation on this project.
  • A public meeting will be held Thursday, June 1 at 6:30 p.m. at the Charlton Freehold Presbyterian Church presenting the work that has been done on the Green Infrastructure Plan for Saratoga County.  Behan Planning Consultants will present vision maps and ideas to preserve and protect farmland and open space in Saratoga County.
  • Historical Society Memorial Day Celebration on  Monday, May 29 at 2:00 p.m. at Gideon Hawley Park.
  • Founders Day Weekend - June 3rd and 4th.  Saturday, June 3 – The Heritage Run and Walk, Art Show and Party in the Park.  Sunday, June 4  – 8th Annual Founders Day Parade at 2:00 p.m..
  • I have reserved the Saratoga County Veterans Float for the Founders Day Parade June 4th.   Any Veterans that would like to ride on the float – please contact  Dick Lupi.
  • Town Board will hold a workshop on Wednesday, May 24 at 4:00 p.m. with Ronni Travers from Amtek Management Service Corp. for information about writing an Employee Handbook.
  • Town Hall will be closed May 29, 2006 for Memorial Day.

 

 

DEPARTMENT & COMMITTEE REPORTS

 

ANIMAL CONTROL

 

Dog Control Officer Lee Bramer reported 3 calls of complaints and 1 case was investigated.  Mr. Bramer stated if two dogs fight there is no quarantined.  Mr. Bramer received a Press Release from the Saratoga County Public Health stating that Saratoga County has had in the past 14 rabies cases.  As of this year they reported 9 cases of rabies.  A copy of the Press Release would be available at the Town Clerk Office and on the town website.

 

 

ASSESSMENT BOARD OF REVIEW

 

Supervisor Grattidge read the following Legal Notice:

The Town of Charlton 2006 Tentative Roll has been completed and filed with the Town Clerk.  It will be available be public inspection on Monday May 1, 2006.

 

The Assessors will be in attendance with the Tentative Assessment Roll at Town Hall on Tuesday and Thursday mornings form 7:00pm until 9:00pm and on Saturdays from 9:00am until noon.  A publication entitled, “How to file a Complaint on Your Assessment”, and a complaint form is available from your Assessors.

 

The Town of Charlton Board of Assessment Review will meet Tuesday, May 23, 2006 between the hours of 1:00pm and 4:00pm and 6:00pm until 8:00pm to hear Complaints.

Legal Noticed was placed on the Town Hall Bulletin Board and the Daily Gazette on April 29, 2006.

 

CABLE

 

Supervisor Grattidge stated cable wire has been run on Jockey Street.  Councilman Lippiello stated there has been no new update.

 

COMPREHENSIVE PLAN

 

Supervisor Grattidge stated the Comprehensive Plan Steering Committee is preparing a draft working towards public workshops.

 

CONSTABLES

 

Constables reported for the month of April, 28 Patrols, 8 911 calls, covered 2,116 miles, issued 18 tickets and 2 Accidents.

 

ENVIRONMENTAL CONSERVATION COMMISSION

 

Supervisor Grattidge stated the ECC had a successful Roadside Cleanup and Tree Give away.

 

E-GOVERNMENT

 

Councilman Lippiello stated E-Government board is working on reorganizing the website to be more convenient.

 

EMERGENCY PLANNING

 

Councilman Gardner stated they met on April 27th currently there are 11 members.  Paul Lent from Saratoga County office of Emergency Services gave an overview of where the County is at.

HISTORIAN

 

Historian Laura Linder reported she and Deputy Historian Dorothy Mitchell attended the Region 5 Association of Public Historians of NYS meeting.  They were instructed on Deed searching.

 

Ms. Linder announced the following events:

 

May 20th – Memorial Day Marking of Veterans Graves

June 3rd – Party in the Park

June 4th – 38th Founders Day Parade

June 8th-10th The Vietnam Memorial Moving Wall

June 18th Sundae on the Farm at Smith Broths Farm Jockey Street

 

All announcements are posted on the bulletin at the Town Clerks Office.

 

Ms. Linder stated there are Crane Drawings located at the Historical Society Museum.  Currently were the drawing originated the new owners last name is Crane.

 

HISTORIC DISTRICT

 

The Historic District met at the Brookside Museum a guest speaker spoke on older homes and preservation.  The Historic District meets the third Wednesday of each month.

 

JUSTICES

 

Town Justice Larry Bascom reported for the month of April he adjudicated 31 cases, 3 was for Penal Law and 28 in Vehicle and Traffic Laws.  Fines totally $1,775, Fees $40.00, Surcharges $645 a total of $2,460 submitted to the State Comptroller.

 

Judge Bascom submitted a completed Grant Application to the Town Board for Court associated equipment for the new town hall.

 

 

LIBRARY

 

Supervisor Grattidge stated the Town of Ballston Community Library would possibly attend the June Town Board Meeting.

 

PARKS

 

Chairman George Eggleston stated the Park Committee met at Mill Pond and appears to be in good condition.  Supervisor Grattidge stated no horses are allowed over the bridge.  Mr. Eggleston stated that no signs are posted.  The tennis nets are up at Elmer Smith Park.  A contract has been signed to start the construction on the Pavilion at Elmer Smith Park.

 

PLANNING BOARD

 

Town of Charlton Planning Board

Report to the Town Board

The Town of Charlton Planning Board last met on Monday, April 17, 2006. During this meeting, no public hearings were held, three open subdivision applications were discussed, a lot line change was finalized, and a pre-application conference was held.  In addition, one referral from the Town of Galway Planning Board and one referral from the ZBA were discussed.

 

1)     Heflin/Durst (255-1-40.1,41, 43.1, 43.2, 43.3): Twenty three lot subdivision of 87 acres owned by Gary Heflin and Dean Durst on Swaggertown Road. The subdivision application was accepted by the Planning Board in June, 2005.  Per agreement reached in April, this application will be suspended from the Planning Board agenda until the applicant, or his legal council, specifically request reinstatement on the agenda.

2)     DeNooyer/Van Guilder (235-1-44 & 235-1-67.2):   The applicant desires a two lot subdivision of 80+ acres on route 147. Concerns regarding acceptable soil and water conditions for adequate perc, raised in January’s public hearing, led to a request for perc tests on the subject parcel.  Perc tests were completed, but the Planning Board has requested that perc test locations and results be added to the survey map, along with the exact location of the well and DEC wetland delineations.

3)     Kenyon/Van Guilder  (223-1-11.11):   This four lot subdivision application was new for March.  The applicants own 22.92 acres on Rocky Ridge Road and Jersey Hill Road, and request to create 3 new building lots.   Planning Board has scheduled a Public Hearing for May 15th at 7:45 PM, and has requested additional information regarding septic system design and location be presented at the May meeting.

4)     Fitzgerald  (246-3-92):   This lot line change application was new in April.  It transfers a small amount of land to follow natural contours and stone wall locations on Saddlebrook Lane and was accepted by the Planning Board.  Resolution 2006-06 was passed.

5)     Cuchelo  (235-1-33.1)   This pre-application conference was requested to discuss tentative plans for the division of a large parcel on Route 147 into 4 building lots.  The Planning Board was able to offer the owner a variety of helpful suggestions.

6)     Lent  (213-1-51)   Town of Galway referral of an application for a special use permit for a horse-boarding operation, located on Featherbed Lane, on land in both Charlton and Galway.  Planning Board Attorney William Keniry has written to the Town of Galway Planning Board, in advance of their Lent Public Hearing on April 25th, and Chairman Raymond Black attended the public hearing.  No further action will be needed regarding the portion of land in Charlton.

7)     Barnes  (236-1-4.2)   ZBA referral of an area variance on Division Street for which the Planning Board has “no comment”.

 

Town Clerk Heather Scribner announced a Public Hearing on May 15, 2006 at 7:45pm Kenyon subdivision on Rocky Ridge and Jersey Hill Road.  The legal notice was published in the Daily Gazette and placed on the Town Hall Bulletin board.

 

RECORDS ADVISORY BOARD

 

Chairman Heather Scribner stated the Records Advisory Board is awaiting a grant application on active records.  Awards will be given out in June.

 

TECHNOLOGY ADVISORY BOARD

 

Councilman Gardner received a list of all current computer software and hardware for the town.  The board also received a report from John Kelley on Rotors and Server options for the new town hall project.  Mr. Eggleston stated they discussed the preliminary step for getting the town hall on a network.  Councilman Gardner reported that the Technology Advisory Board discussed computers for the Highway and Town Justices and the possibly using the old laptop from the Justices for the Constables.  The Saratoga County GSI system was looked into.  It is a year behind.

 

TOWN CLERK

 

Town Clerk Heather Scribner stated as of today the Town Clerks office disbursed 53 sets of bid documents.  On April 24th and 25th   Town Clerk Heather Scribner, Councilman Verola and Deputy Town Clerk Tina Bublak attended the Town Clerk Association Conference.  She also attended a workshop on Managing E-Mail

 

TOWN HALL

 

Supervisor Grattidge stated the bid specifications and prints went out for review.  A prebid meeting with contractors is on May 2, 2006.

 

WATER

 

Councilman Lippiello stated the water district sent out meter reading cards with a preaddressed return card.  A fee was associated with late recording.  Water Superintendent John Morgan has been working on a water extension of 4 homes on Lake Hill Road.

 

A motion was made by Councilman Lippiello seconded by Councilman Gardner for the Water Superintendent to hire Jim Cunningham a part time Independent to be paid at $13.00 per hour a maximum of 20 hours a week.

ZONING

 

Zoning Administrator Dave LaFountain reported issuing 13 permits for a total of $3,700.00.

 

ZONING BOARD OF APPEALS

 

Councilman Gardner stated the Zoning Board of Appeals has scheduled a Public Hearing on May 9, 2006 at 8:00pm for a Area Variance on Harmon Road.

 

PARTY IN THE PARK

 

Supervisor Grattidge stated the next scheduled meeting is on May 18th at the Historical Society School House at 7:30pm.

COUNCILMAN REPORTS

 

Councilman Gardner stated he attended 5 meetings and met with a sales representative on highway software.  Councilman Gardner reviewed the storm water run off issues. He thanked County Waste for the Bulk Item Pick Up.

 

Councilman Lippiello stated he is looking forward to opening the bids for the new town hall project.

 

PRIVLAGE OF THE FLOOR

 

Wally Hughes, Redwood Drive- Mr. Hughes commented on the Bulk Item pickup.  Mr. Hughes stated he was surprised to see his refrigerator compacted loaded with Freon that went immediately into the atmosphere.  It doesn’t seem environmentally correct exposing Freon that way.

 

Mr. Hughes stated Mr. Blu Niles from Cooperative Extension the Storm Water Management Coordinator would be looking at the creek behind his house. This summer he would be testing ecoli and phosphate to see if anything is down there.  Mr. Hughes gave appreciation to town representatives who came to see the stream and his concerns.  Mr. Hughes asked if there could be any temporary help to get the stream to flow, possibly from the highway department.  Supervisor Grattidge stated it is impossible to get any machinery back there.  We are still on discussion of the proper course of action.  The town board would let Mr. Hughes know.  Mr. Hughes stated there are 4 or 5 trees that have depleted its leaves because of the high level of water.  If the extent of high levels of water continues all of the trees will be gone.

 

Laura Linder, Route 67 stated an exhibit booth is available at the Saratoga County “Sundae on the Farm”.

 

Lee Bramer, Westline Rd gave thanks to the Saratoga County Highway Department for the help they gave to the Town of Charlton Highway Department with the culvert replacement on Vines Road.  Councilman Lippiello suggested a letter of thanks would be appropriate.

 

The Town Board Agenda meeting is scheduled for May 30, 2006.

 

A motion was made by Councilman Lippiello seconded by Councilman Gardner to enter in an executive session at 8:53pm to discussion a personnel matter.
