The Regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Councilman Lippiello, Councilman Salisbury, Councilman Verola, Supervisor Grattidge and Town Attorney Robert VanVranken.

 

Absent:  Councilman Gardner

 

Supervisor Grattidge led the pledge of Allegiance.

 

Supervisor called the meeting to order at 7:36pm.

TOWN CLERK REPORT

 

Town Clerk Heather Scribner read the Town Clerks report.  She reported taking in $178.80 for the month of February $96.68 was disbursed to the supervisor.

Supervisor Grattidge stated there were no expenditures for the New Town Hall project.

 

WEB SITE ACTIVITY

SUPERVISORS REPORT

 

Attended eight (8) different Town meetings including the regular Board meeting and the Comprehensive Plan meeting and met with the Town Architect, Town Attorney and Town Board concerning planning the New Town Hall.

 

Attended the four (4) day Association of Towns annual meeting in N.Y.C. where attended numerous training and informational classes.

 

Attended seven (7) different committee and board meetings at Saratoga County.

 

Logged 204 miles for Town and County purposes.

 

On Friday, Feb. 17, 2006 at approximately 10:00am., the majority of the Town of Charlton’s residents lost their power in the region, 2 of 6 main transmission lines were knocked out and 1000 crews were called into the area for repairs.  At 8:00 a.m. on Saturday, Feb. 18, approximately 60-70 percent of the Town was back on line.  Unfortunately for some of the remaining residents, it was the following Monday before power was fully restored.

 

The Supervisor and the Town Board would like to thank the three Fire Departments for all their service thru this event.  Many residents appreciated having a warm place to come and food to eat.  The Fire Departments also spent a lot of time with road closures and detours.  Overnight Emergency Shelters were not needed, thank goodness.

 

Thank you also to Ron Gavin, Mike Emerich and the Highway Department for manning the traffic light at the Scotch Church intersection and helping with all the downed trees and the debris cleanup.

 

This event pointed out how important it is for the Town to have good communication between agencies and for our residents to have back-up generators.

 

The Town will also help to compile a list of special needs families and a list of seniors that might need additional help in emergencies such as this one.

 

I thank everyone that helped out and take great pride in how our residents look after one another in times of crisis.

 

Supervisor Grattidge shared photos of damages from the power outage taken by Highway Foreman Mike Emerich.

 

ANNOUNCEMENTS

 

Supervisor Grattidge stated there is a conference on Planning a Future for Farms in Rensselaer, Saratoga & Washington Counties on March 22, 2006 in the Town of Easton.  For further information a hand out was provided.

 

On April 26, 2006 the NYS Canal Corporation & NYS Department of State will hold a Quality Canals for Quality Communities Conference.  Hear about the new Erie Canal “Greenway” proposal learn about state grants and find out how your community can maximize its potential.

 

Supervisor Grattidge received a letter from Time Warner Cable, beginning April 1st; the rate for Basic with Standard service will change from $45.35 to $48.25.  The rate for Basic service will remain unchanged at $11.00.  Customers with package pricing for multiple services are not affected by this change.

 

Supervisor Grattidge received a legal notice from the Saratoga County Planning Board; Read as follows:

 

Please take notice that pursuant to Agriculture and Markets Law, Article 25-AA The Saratoga County Consolidated Agriculture District #2 is subject to a required 8-year review.  Consolidated Agriculture District #2 contains 52,196 acres, is located within the Towns of Ballston, Charlton, Clifton Park, Galway, Malta and the City of Saratoga Springs.

 

The Consolidated Agricultural District #2 map is on file and open to public inspection for 30 days beginning March 1, 2006 in the Office of the County Clerk, located at 40 McMaster St. and the County Planning Department, 50 West High St., Ballston Spa, NY.

 

Any municipality or landowner within the district may propose a modification of the district by filing such proposal the Saratoga County Clerk within thirty days after the publication of this notice.

 

Upon termination of the aforesaid thirty day period, the proposal and proposed modifications, if any, will be submitted to the county planning board and the county agricultural and farmland protection board and that thereafter a public hearing will be held on proposal, proposed modifications, if any, and recommendations of the planning board and county agriculture and farmland protection board.  by Barbara Plummer, Clerk Saratoga County Board of Supervisors.

 

Supervisor Grattidge received a Legal Notice from the Town of Milton Zoning Board of Appeals.  Read as follows:

 

Please take notice, the Zoning Board of Appeals of the Town of Milton, NY, will hold a public hearing pursuant to the Town Zoning Ordinance on the following proposition:  For the purpose of installing a cell tower n the R2 zone a Use Variance is being requested by Independent Towers, LLC.  The location of the property is 907 Goode Road (northwest corner of Goode Road and NYS Route 67 in the Town of Milton.  Said hearing will take place on the 23rd of March 2006 beginning at 7:10pm at the Town Hall located at 503 Geyser Road.  Susan Talmadge Milton Zoning Board Secretary

 

Supervisor Grattidge read from an article by the Association of Towns, Volunteer Fire and Emergency Medical Services Systems in Crisis.  The impetus for this study emanated from the direct concern of the Association’s Executive Director, G. Jeffery Haber.  This was reinforced by statements of concern from our membership as our staff raised the issue while traveling the State on lobbying and training missions.  Many town officials feel that the state of volunteer emergency services in their respective areas of the Ste is in crisis and that the level of protection is dropping drastically because of a shortage of volunteers in fire and ambulance.  More importantly, they feel that (due to the threat to the volunteer services) a dramatic increase in real property taxes (town government’s only locally-generated revenue) is looming.

 

Supervisor Grattidge announced on April 11, 2006 there is a workshop class on Managing E-Mail Effectively.

 

COMMUNICATIONS

 

Supervisor Grattidge stated he received a letter from the Town of Galway thanking the Town for their contribution.

 

Supervisor Grattidge received a letter from a resident, who would like to donate their land to create a memorial garden/park.  The town board will discuss this at a future date.

 

A letter from the Charlton Snowmobile Club was read.  Thanking the landowners for giving the Charlton Snowmobile Club the opportunity and permission to use a portion of land for their snowmobile trail.

 

ANIMAL CONTROL

 

Dog Control Officer Lee Bramer reported he had 3 pickups this month, 4 calls of complaints and 2 wild life calls. 

 

The 2006 Rabies Clinics will be held at the 4-H Training Center, Middleline Road, Ballston Spa are on April 18, May 16, June 13, July 18, August 18, September 19, October 17; Cats 7pm-8pm and Dogs 8pm-9pm Free to the public.

 

ASSESSORS

 

Chairman Vicky Hayner reported all exemptions are in progress to work on the rolls.  A reminder that the Volunteer Firefighter and Ambulance exemption, in order to receive an exemption you must own land in town and serve in the town.  It must be the last 5 consecutive services in the Town of Charlton.

 

CABLE

 

Councilman Lippiello stated Time Warner Cable Company will hold a public information meeting on Wednesday March 22, 2006 at 7:00pm.  Time Warner said they would go over this seasons build out for cable service.

 

COMPREHENSIVE PLAN

 

Member Marv Schorr stated they discussed preserving open space and is working on changes that are necessary before presenting a draft to the Town Board.  The Comprehensive Plan Committee meets the first Monday at 7:00pm of each month.

 

 

CONSTABLES

 

Constables reported 29 Patrols, 911 Calls, covered 2344 miles, issued 26 tickets and 2 accidents.  During the power outage 2/17-2/18 they received 18 calls regarding trees, wires down etc.

 

E-GOVERNMENT

 

Councilman Lippiello stated the E-Government board is updating forms and applications for the Charlton web site.

 

HIGHWAY

 

Highway Foreman Mike Emerich stated the month of February started out slow, patching potholes, working on a ditch on Crane Street, replaced tires on one of the trucks and painting of a truck.  Used approximately 300 tons of sand and 125 tons of salt.  During the power outage the highway department put in 259.5 hours.

 

HISTORIAN

 

Councilman Verola announced A Memorial Flag for the Grave of Each Veteran would be held on May 20, 2006.  For further information contact Historian Laura Linder.

 

LIBRARY

 

Present were two representatives from the Town of Ballston Community Library, Larry Rodgers and Treasure Tom Shawman.  Mr. Rodgers stated a representative from the library would attend Charlton’s town board meeting on a quarterly basis.  The purpose is to let the public know what services they have to offer to residents of Charlton.  Mr. Shawman stated the library now offers wireless Internet access for those who bring in a laptop and currently has 8 computers for public use.  The library offers many programs such as a series of Multicultural Programs for Children and Families and Einstein’s Legacy Program Series.  (A schedule of time and events is posted at the Town Clerks Office)

 

PARKS

 

Chairman George Eggleston stated they are working on a contract for the pavilion and repairing the warming shelter.  They are in the process of reviewing the application for using the town’s parks.  Councilman Lippiello stated himself and Member Dave Pohl walked the property behind Elmer Smith Park.  It seemed someone was cutting through the cemetery and was dumping garbage.  They located who it was (not a town resident) and the problem was resolved.  Councilman Lippiello suggested placing a sign PLEASE RESPECT.

 

PLANNING BOARD

Report to the Town Board

The Town of Charlton Planning Board last met on Monday, February 20, 2006. During this meeting, one public hearing was held and six subdivision applications were discussed.

 

1)     Vincent/Van Guilder (226-1-20.111): On February 20th, the Public Hearing was held for this 2 lot subdivision on Sweetman Road.  The Planning Board granted the applicant the subdivision to create a new 7+ acre parcel with the existing house, out of the 94 acre parcel. There are presently no plans for the remaining 86 acres.  Resolution 2006-03 was made.

2)     Heflin/Durst (255-1-40.1,41, 43.1, 43.2, 43.3): Twenty three lot subdivision of 87 acres owned by Gary Heflin and Dean Durst on Swaggertown Road. The subdivision application was accepted by the Planning Board in June, 2005 and is in the preliminary review phase working on engineering details. The application stipulates town water for all lots therefore requiring extension of the Town water district.  The review process is continuing on the evaluation of a conservation design layout.

3)     Muscanell (256.10 – 1-9):  The applicants desired to subdivide their existing parcel on Crooked Street, in the Residential zoning district.  The applicant was referred to the ZBA after first appearing before the Planning Board in a pre-application conference as insufficient frontage and acreage were available. The ZBA approved the area variance in October, after which a subdivision application was submitted to the Planning Board.  In February, the Muscanell subdivision was approved.  Resolution 2006-04 was made.

4)     DeNooyer/Van Guilder (235-1-44 & 235-1-67.2):   The applicant desires a two lot subdivision of 80+ acres on route 147. Concerns regarding acceptable soil and water conditions for adequate perc led to a request for perc tests on the subject parcel. The applicant has contacted Planning Board legal council (letter from Van Guilder Associates) requesting that action by the Planning Board be put on hold until May when perc and soil tests can be conducted.

5)     Banker Trust (224-1-4.1):  Four lot subdivision of 100 acres owned by Judy Rae Banker on Route 147. Public hearing held at 7:45. Subdivision approved - resolution 2005-16. The Planning Board was subsequently verbally notified that the subdivision will not be filed by the applicant as the 100 acre parcel has been sold intact. Nothing in writing was received from the applicant to finalize the withdrawal.  At the February meeting, at the advice of council, the Planning Board passed a revision to resolution 2005-16, stating that the subdivision application is terminated. The revised resolution was sent to the applicant via registered mail with an acknowledgement request. 

6)     Nigriny (247-1-50.12): Two lot subdivision of 5.3 acres owned by John and Regina Nigriny on the corner of Sweetman and Jenkins Roads.  The requested subdivision does not meet Charlton’s zoning ordinance setback requirements and was referred to the ZBA for area variance. The ZBA denied the area variance in January at which time, the Planning Board sent a letter to the applicants requesting either submittal of new subdivision plans which meet zoning requirements or formally withdraw their application.  No response has been received to date.  In February, at the advice of council, the Planning Board sent, via registered mail, a second letter requesting the same and stating that if nothing is heard from the applicant, the Planning Board will move to deny the subdivision application at the March meeting.  No reply has yet been received to date.

7)     On March 1st the Planning Board conducted a workshop to draft input to the Comprehensive Plan Committee. The drafted input will be discussed/refined at the March meeting and forwarded to the Comprehensive Plan Committee.

 

 

RECORDS ADVISORY BOARD

 

Chairman Heather Scribner stated the Records Advisory board met on February 22nd at 7:30pm.  They discussed policies and procedures for records destruction.  Its purpose is to follow the requirements by the NYS MU-1 retention schedule.  A training class is offered by the NYS Archives on Managing Maps and Plans. 

 

TECHNOLOGY ADVISORY

 

Chairman John Tasse stated they are working on inventory of the town’s software.  They had reviewed the networking design for the new town hall project and are please with the lasted version.

 

TOWN HALL

 

Supervisor Grattidge stated the town board would meet on March 20th at 4:00pm to review proposals for the RFP.

 

WATER

 

A motion made by Councilman Lippiello seconded by Councilman Verola to authorize the Town Engineer EDP to review preliminary engineering on the proposed projects for 2006.

Councilman Salisbury asked if anyone knew the estimated cost for Environment Partner Design, EDP to review the engineering.  Councilman Lippiello stated no.

 

A motion made by Councilman Lippiello seconded by Councilman Salisbury to enter into an agreement for a water tank inspection at the cost of $2900.00.

PRIVLAGE OF THE FLOOR

 

Suzanne Voight Co-Chairman to the Garden Club is concerned with people putting signs at the triangle on Stage Road and Charlton Road.  Every year the garden club plants signs in that area and is asking for consideration to the Garden Club.  Ms. Voight suggests banning people from putting signs in that area.

 

Supervisor Grattidge adjourned the meeting at 9:48pm.
