Agenda Meeting

The Agenda meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30 pm at the Charlton Town Hall, called to order by Supervisor Grattidge.

 

Present:  Supervisor Grattidge, Councilman Gardner, Councilman Lippiello, Councilman Salisbury and Councilman Verola

 

Others Present:  Deputy Town Clerk Susan York and Town Attorney Robert VanVranken.

 

Supervisor Grattidge announced this meeting is to set the Agenda for the Regular Meeting of the Town Board on August 14, 2006.

 

The Town Board will approve the following meeting minutes on the August 14, 2006 Town Board meeting:

Councilman Gardner requested a balance of each escrow account.  Councilman Gardner stated he would like to verify the funds for these accounts.

 

A motion made by Councilman Verola seconded by Councilman Lippiello authorizing the town clerk to prepare the abstract of claims.  Approved

Supervisor Grattidge stated at this time he has no announcements.

 

Supervisor Grattidge stated that there are two communication items.

 

Supervisor Grattidge received a letter from the Galway Public Library.  The Galway Library would like to set up its own district.  This would require a future referendum vote possibly next spring.  Supervisor Grattidge distributed to the town board members all information regarding the proposed district.  Supervisor Grattidge requested from the Galway Library a written article which could be placed in Charlton’s Town Board Newsletter.  Supervisor Grattidge stated that currently the Town of Charlton contributes to the Galway Library on an annual basis.  The proposed district would be funded by a tax if approved.

 

Supervisor Grattidge received a letter from the Harmony Corners Fire Department.  The Harmony Corners Fire Department would like to enter into an agreement with Time Warner Cable to receive internet cable at no cost.  Supervisor Grattidge stated he would forward the letter to Time Warner Cable.  The decision would be made by Time Warner Cable as to whether the Fire Department receives free internet access.

 

Supervisor Grattidge received a memo from the Highway Department regarding a reoccurring drainage problem on Newman Road.  The wash outs caused by a seasonal stream have been identified.  It is not on the town’s property, it is on private property.  The town has obtained permission from the property owners to put an additional pipe which would redirect the stream away from the road.  The flow would run under Swaggertown Road.  Supervisor Grattidge stated he and the Superintendent of Highways have worked with the four (4) landowners on granting the permission for this project.  On the July 27th the project was surveyed by Supervisor Grattidge, Superintendent of Highways Ron Gavin and Highway Foreman Mike Emerich. Mr. Gavin and Mr. Emerich have priced the materials for the project.  Supervisor Grattidge recommends doing the project by next month while the weather is relatively dry. Supervisor Grattidge stated that there are permission slips in process to the landowners.  The town will need to go on approximately 80 feet of private property. There will be a 3 foot diameter pipe, 80 feet long to be laid down.  Supervisor Grattidge stated he would like the Town Attorney to work on an agreement indicating if there were possible problems in the future the town may have permission to go on the private properties.  Town Attorney Robert VanVranken stated it would be a license agreement.  It would not be an easement. It could be revoked by the land owner.  Supervisor Grattidge stated the funds would come out of the Highway construction/road and repair. The amount would be $3319.00 for the materials.  If further funds are needed in the road program a transfer can be done at a later date.  The town board agreed to move forward with the Newman Road project.

 

Supervisor Grattidge received the BHBL Summer Recreation Program Application from Brian Bold, Program director.  A meeting is held in the fall regarding the program.  Supervisor Grattidge stated the town board will be notified.

 

Supervisor Grattidge received a notice from the Commissioners of Elections stating that their will be a primary election on September 12th from 12:00pm thru 9:00pm.

 

Supervisor Grattidge stated the Town Clerks Office has received the West Charlton Fire District’s end of year report.  Town Clerk Heather Scribner is waiting for the two other fire district reports.

 

Supervisor Grattidge stated a proclamation on Constitution Week is in progress.  The proclamation is done every year by the Town of Charlton.  The town board agreed to put on the agenda for the August 14th meeting.

 

Supervisor Grattidge received a letter from the Saratoga County Planning Board.  The letter announced the new Director of Planning Jason Kempler.

 

Supervisor Grattidge stated a transfer would be needed to the town board account to cover the cost of the upcoming town board newsletter.  The current balance is $195.00.  The lengthy legal notices drew the account low.   A resolution will be prepared for the August 14th meeting.

 

Supervisor Grattidge announced the Zoning Board of Appeals will hold a public hearing on August 8th at 7:45pm.  The ZBA will hear a request of an area variance for a 10’x24’ carport of the property of Bruce Dorman.

 

Supervisor Grattidge announced the Planning Board will hold a public hearing on August 21st at 7:45pm for the purpose of subdividing the lands of Casey on Sweetman Road.

 

Supervisor Grattidge announced the Saratoga County Animal Shelter’s web site has been down due to lightening crashing the computer system.

 

Supervisor Grattidge received notice from the Town Clerk Heather Scribner that a demonstration for Town Clerk software has been scheduled with Business Automation Services on August 28th at 10:00am.  Also, announced was a seminar on Inactive records in Niskayuna on August 29th.

 

RESOLUTIONS

 

A motion made by Councilman Lippiello seconded by Councilman Verola that Resolution No. 113 A RESOLUTION TO ADVERTISE FOR SALE BY SEALED BID A JOHN DEERE 310 AD TRACTOR WITH ATTACHMENTS be approved:

A motion made by Councilman Lippiello seconded by Councilman Verola that Resolution No. 114 A RESOLUTION AUTHORIZING THE PURCHASE OF A TRACTOR FOR THE TOWN OF HIGHWAY DEPARTMENT be approved:

 

Discussion; Councilman Salisbury will resolve the correct model # with the Superintendent of Highways Ron Gavin.

A motion made by Councilman Verola seconded by Councilman Lippiello that Resolution No. 115 A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS NECESSARY TO EFFECT PAYMENT TO THE TOWN ATTORNEY TO PAY FOR SERVICES RELATED TO THE NEW TOWN HALL be approved:

 

Discussion:  Town Attorney Robert VanVranken stated the town board had made the resolution as a motion last month from his opinion a motion is a resolution as long as the minutes are okay.

COUNCILMAN REPORTS

 

Councilman Verola stated the Highway Department is requesting access to Road Runner in their office.  More information will follow along with the cost.

 

Councilman Verola received a call from a resident Mr. Wally Hughes approximately a month ago regarding his storm water management situation.  Councilman Verola stated she had viewed allergy growing on the property.  Supervisor Grattidge stated the Highway department was going to remove some of the material by hand when time was permitting.  No one from the town board has spoken with County Coordinator Blue Neils.  The last communication Supervisor Grattidge had was Mr. Neils was going to put together an outreach for the landowners.  Councilman Verola stated last year a letter was written for a handout and it never got handed out.  Councilman Verola will give copies to the town board for review.  Councilman Verola stated she would contact Blue Neils.

 

Councilman Salisbury presented the town board with information regarding a new vehicle truck for the Highway Department at a cost of $151,952.00.  Superintendent of Highway Ron Gavin was also looking into a used vehicle with low mileage, no cost was mentioned.  Councilman Salisbury stated the Highway Superintendent Ron Gavin suggested for the town board to look at the proposed vehicle.  Supervisor Grattidge suggested that the town board should look at the vehicle that the Highway Department would be replacing.  Furthermore, it should be looked into what further use the current truck has.  At $151,000.00 that would be 2 times our annual machinery budget.  Supervisor Grattidge stated the town has invested $60,000.00 per a year into an equipment fund.  The balance from last year went into a reserve.  The idea for this year was the purchase of a new tractor and what ever funds left would continue into the reserve.  Councilman Salisbury stated the vehicle the Highway Department has is approximately 27 years old.  The town board will look into more information.

 

Councilman Lippiello stated the pavilion at Elmer Smith Park is underway.  Supervisor Grattidge stated he seen that he trusses are up on the construction.

 

Councilman Lippiello stated he has tried to contact Jim Mitchell from Environmental Design Partnership regarding the various work for the capital improvements to the Water District.  It is appears that Mr. Mitchell has been on vacation.  Councilman Lippiello will contact Environmental Design Partnership.

 

Councilman Lippiello stated that Time Warner Cable is on schedule for their build out for this year.  Supervisor Grattidge stated that Sweetman Road and Jockey Street build out is complete.  Councilman Lippiello stated that the last communication with Time Warner Cable was they just received permission to get an outside company to prep the poles.

 

Supervisor Grattidge received a request for Time Warner Cable on upper Jockey Street north of Smiths property.  The resident was quoted $4000.00 for the installation of cable.

 

Councilman Salisbury stated the town board should have separate meetings on the Water District.  Supervisor Grattidge stated that the town board can discuss having separate meetings for the Water District at a workshop.  Councilman Salisbury stated he would like it on the Agenda.

 

Supervisor Grattidge stated the town board will receive a 2nd draft of the Employee Handbook.  When it is ready the Town Clerk Heather Scribner will forward it to the members of the board.

 

Open Discussion Items

 

Updating Park Rules & Regulations

 

Supervisor Grattidge stated the town board is waiting for the Park Committee to correspond back on the Park Rules and Regulations.

 

Open Burning Ordinance

Supervisor Grattidge stated the town board is on hold with the Open Burning Ordinance.

 

Cell Tower Zoning

Supervisor Grattidge stated the Zoning Board of Appeals is reviewing.

 

Wind Generators & Permanent Storage Containers

            Supervisor Grattidge stated that there is no action.

 

Local Dog Ordinance Law

            The town board is waiting for input from the Animal Control Officer.

 

Clerk to the Supervisor

            Supervisor Grattidge received a resume and would forward a copy to the town board members.

 

Town Management Software

            Councilman Salisbury stated the Finance Committee has scheduled a meeting on August 10th at 7:00pm. 

 

Councilman Gardner distributed a list of open discussion items.

 

Highway Tractor

Supervisor Grattidge stated the Highway Tractor is complete.

 

Retirement Monthly Reports        

            Supervisor Grattidge stated the town board will receive copies of the NYS Retirement Report after August 15th.

 

Escrow Account Funds

            The listed item:  Research of escrow accounts due to applicants.  Councilman Verola stated is complete.

 

Town Yearly Fiscal Budget

            Supervisor Grattidge will prepare a schedule of the budget process within the next month.

 

Retirement Elected & Appointed Officials Resolution

            Supervisor Grattidge stated information is noted in the Employee Handbook.

 

Owners Representative Town Hall Project

            The listed item:  Any decisions making and actions regarding the Town Hall project will involve the town board members.  Supervisor Grattidge stated the discussion item is resolved.  Supervisor Grattidge spoke with Owners Representative regarding corresponding through email.

 

Contracts for all Donations from the town

            Councilman Verola stated she would check with the Town Clerk Heather Scribner for a list.

 

Town Wide Brush Pick

            Councilman Verola stated that the Highway Department would be picking up brush two times a year.  An article will be placed in the Town Board Newsletter notifying residents.

 

Councilman Salisbury received positive comments on Councilman Gardner’s list of discussion items.

 

Supervisor Grattidge adjourned the meeting at 8:20pm.
