Policies and Procedures

According to NYS law, there can only be one residential structure on anyone residential tax parcel of land. If a landowner/applicant desires to divide a larger parcel of land to create one or more additional building lots, they need to apply to the Planning Board for a subdivision. The Planning Board also handles applications for lot line changes and site plan reviews. The Planning Board cannot approve a subdivision or lot line change, that results in the creation of a building lot that does not meet the Town of Charlton’s Zoning Ordinance. The only exception would be when the Zoning Board of Appeals approves variance for the project. The goal of the Planning Board is to assist the owners and applicants in achieving the best possible results while protecting current and future Town residents.

Applications and requests for pre-application conferences must be submitted at least two weeks prior to the Planning Board meeting. This allows for adequate time in which to distribute the materials to Planning Board members in order for them to prepare prior to the meeting.

Please note that all applications for a subdivision, or lot line change, require copies of survey maps prepared by a professional land surveyor. Sketches are adequate only for pre-application conferences.

Approved subdivisions and lot line changes are filed along with survey maps at the Real Property Tax Service Office of Saratoga County, located at 35 West High Street in Ballston Spa.
