After the pledge to the flag, the invocation was given by Town Clerk Gail Hanchar.
At the regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30 P.M. at the Charlton Town Hall, called to order by Supervisor Acunto, there were present:

ABSTRACT OF CLAIMS:
The correct total for the January Abstract of Claims was $44,885.00. The total Abstract of Claims for February is $89,096.17. Motion made by Councilman Grattidge, seconded by Councilman Mitchell. PASSED UNANIMOUSLY.
Vouchers for the month were #1060 - #1188.
TOWN CLERK’S REPORT:
Gail Hanchar read the Town Clerk’s Report. She reported taking in $202.06. Motion made by Councilman Grattidge, seconded by Councilman Mitchell. PASSED UNANIMOUSLY.

The Town Hall will be closed for President’s Day on February 16.
The internal audit by the Town Board was done two weeks ago. Everything was found in order with a minor recommendation that a column be added to the Zoning Administrator’s books to show receipt numbers.
Operation Adopt a Soldier is continuing. Results have been very good.
There will be a workshop with the ECC, the Town Attorney and the Town Board regarding the Getty Station Report. We will meet on February 24 at 7:00 P.M. at the Town Hall.
We received a bid for the salt shed roof. It was in excess of $11,000.00. Motion was made by Councilman Grattidge, seconded by Councilman Lippiello, A Motion to reject the bid received from Near-Rychcik, Inc. of Scotia, New York, be approved:

Motion made by Councilman Grattidge, seconded by Councilman Verola, A Motion authorizing the Highway Superintendent to advertise for sealed bids for labor for the installation of a roof on the salt shed at the highway garage to be opened at the March 8, 2004 meeting, be approved:

We have had two incidents on Stage Road dealing with sun glare. It was decided that the Superintendent of Schools would submit a letter to Joe Ritchey, Saratoga County Highway Superintendent. He wrote the necessary letter asking for a warning signal or sign on upper Stage Road. Mr. Ritchey responded saying he shared our concerns "but Article 44 of the Vehicle and Traffic Law does not allow the installation of any traffic control device or sign that does not conform to the Manual of Uniform Traffic Control Devices. There are no devices in the manual relating to sun glare. Bill Logan of NYS Department of Transportation and Regional Traffic Engineer confirmed it would be illegal for us to make and install such a sign". The Superintendent of School has been asked to write another letter to ask for the possibility of erecting "School Bus Stop" signs. The matter is still under investigation.
We received a letter from Round Lake Insurance regarding our renewal. There will be a 12% increase over our expiring premium. Dave Meager, our representative, would like a meeting with us to discuss our coverage. We will meet on Wednesday, March 3
We have again been served with Article 78 papers from the representatives of Capital Realty. Water Attorney John Tabner will discuss that with us in executive session tonight.
There will be a workshop on Saturday morning, March 6. Everyone is invited. There will be a presentation by the consultant that has been hired.
CONSTABLES:
For the month of January there were 28 patrols, 14 911 calls, covered 2,l56 miles, issued 22 tickets, investigated 2 accidents and had 15 car in ditch reports.
ECC:
The Annual Roadside Clean Up will be held on Saturday morning, May 1 from 8 AM until Noon. The Tree Give Away will be that day from Noon until 1 P.M.
HIGHWAY:
They have been salting and sanding the roads.
HISTORIAN:
Laura attended the Farm Life Stories on January 18. The Comprehensive Plan people also attended.
HISTORIC DISTRICT COMMISSION:
Doris stated that the Maloney’s have completed a perfect restoration of the building on Charlton Road. It is as it stood in the 19th century. The Commission is working with them on a sign that will be in keeping with the building and adhere to the zoning.
She read the following report:
TOWN HALL:
Councilman Verola reported that a workshop was held at the Town Hall this week with an architect, project manager and a general contractor. We are in the process of getting more information about prices of designs. Councilman Grattidge said we are still gathering information and trying to decide what direction to go. Councilman Lippiello said he had taken a ride to Greenfield Center to look at their new building. They have a lift rather than an elevator. It was very nice.
Supervisor Acunto said he has received an email from Torben Aabo asking about the workshop and minutes. It should be made clear that we are not obligated to take minutes at workshops. There are no minutes of workshops. The meetings are open to the public. If anyone wants to attend they can certainly attend but there are no minutes.
WATER:
Councilman Lippiello said that hopefully we will proceed with the Application for Inclusion later on tonight and go ahead with the SEQRA Determination for District #5. Supervisor Acunto stated that we are not going to do anything on the adoption of Water District #5. We are going to reserve decision on Water District #5 Extension until March 8 at our normal Town Board Meeting. The advice of counsel is that we have to specifically pick a date because if we don’t do it publicly, we are subject to another public hearing. We will be ready on the 8th to make a decision but at this point there is some other information that had come forth that we want to have an opportunity to think about and process.
ZBA:
They have a hearing tomorrow night at 7:30 P.M.
ZONING ADMINISTRATOR:
Issued two building permits.
ZORC:
They had their first meeting of the year the last Wednesday in January. The next meeting is February 25. The Town Attorney will be attending to discuss some legal questions.

COUNCILMAN REPORTS:
Councilman Grattidge - The first Party In The Park Organizational Meeting will be Wednesday, February 11 at 7:30 P.M. at the Town Hall.
Councilman Mitchell – The newsletter should be out next week. Dot urged everyone to attend the workshop for the Comprehensive Plan.
Councilman Lippiello – Thanked Ron and the highway crew for their hard work last week with the accident. There is a picture in the Saratoga County Soil & Water Conservation Publication showing trees being planted in Elmer Smith Park.
Councilman Verola – Nothing at this time.
PRIVILEGE OF THE FLOOR:
John Tasse – I understand you have to meet with the attorney but could you explain what Capital Realty has requested in the suit?
John Tabner (Water Attorney) – Basically they are renewing the same type of a motion as before. It is returnable on February 27. We have to have our papers in on February 22.
John Tasse – Are they suing for the water district or the whole subdivision?
John Tabner – They are suing for the extension. They want the court to direct the Town Board to approve that because they say they filled the requirements under the Town Law. If they were successful, the Town Board would be directed to approve the extension. Basically what the court decided before was that the Town Board had considered two reports which were submitted after the other hearing and we should have a supplemental public hearing, which we have already had, and then have an opportunity to have those reports submitted, which they were submitted. (Could not understand) It will be in front of Judge Nolan, the same as it was before. We don’t know what his decision will be this time. We feel that in all likelihood he will sustain the Town Board.
John Tasse – Are there any dollar penalties adjudicated in favor of the plaintiff (could not understand)
John Tabner – No. The only penalties would be statutory costs of $700.00 for the prevailing party, assuming the court awards costs. They don’t always award costs. That is at the discretion of the court. (could not understand) They have posted a $500.00 bond in case they don’t prevail and the court awards costs.
Marv Schorr – Thanked the highway crew for the fine job they did during the last snowfall.
Laura Linder – Thanked the Drapala family for giving us the weathervane from the Sweetman Barns. The Village of Scotia kicked off their Centennial Year Celebration with a Victorian Ball. The Charlton Historical Society will be honoring Rick Reynolds this year for his achievement of being named American History Teacher of the Year by the DAR. He will be the Grand Marshall on Founder’s Day.
The next Agenda Meeting will be February 23 at 7:30 P.M. at the Town Hall. Councilman Lippiello will not be present.
