After the pledge to the flag, the invocation was given by Town Clerk Gail Hanchar.

At the regular meeting of the Town Board of Charlton, Saratoga County, New York held at 7:30 P.M. at the Charlton Town Hall, called to order by Supervisor Acunto, there were present:

Motion made by Councilman Lippiello, seconded by Councilman Grattidge that the minutes of the minutes of August 11 Town Board Meeting, the August 25 Agenda Meeting and the August 25 Workshop Meeting be accepted as received:

Councilman Lippiello asked that the number of the resolution passed at the August 25 Agenda Meeting be included in the minutes. Gail will make that correction.

Gail Hanchar read the Town Clerk’s Report. She reported taking in $186.60. Motion made by Councilman Schroeder, seconded by Councilman Grattidge. PASSED UNANIMOUSLY.

SUPERVISOR’S REPORT AND ANNOUNCEMENTS:

August review of revenue and expenditures:
General Fund – Expenditures of $32,029.48. Revenue of $83,844.98.
Highway Fund – Expenditures of $32,319.20. No revenue.
Water District #1 – Expenditures of $4,346.65. Revenue of $14,733.45.
Water District #2 – Expenditures of $161.50. No revenue.

Major expenditures:
General Fund – Justice Equipment of $2,427.95 (lap top computer replacement for Judge Bascom), Clerk Equipment of $l,402.39 (computer for Town Clerk), Buildings Equipment of $2,224.31 (materials for salt shed), Safety Inspections Contractual of $4,889.00 and Joint Youth Programs Contractual of $3,000.00.
Highway Fund – Maintenance of Roads Contractual of $6,437.49 (stone and patch) and Machinery Contractual of $2,345.46.
Water Fund – Personal Services

Major revenue:
General Fund – Sales Tax Distribution of $79,962.00 and Safety Inspections Fees of $3,603.00

Supervisor Acunto reported that last week a dead crow tested positive for West Niles Virus in the Komar Park area. Two other crows have been submitted for testing – one in the Komar Park area and one on Swaggertown Road. If we have a positive test, Saratoga County will contact the County Health Department and the Health Department will contact the town supervisor. Dr. Phelps, Town Health Officer, has suggested residents use insect repellants and remove stagnant water. Symptoms are flu-like in the early stages and then progress to disorientation, dizziness and confusion.

Children’s ID Kits are available at the Town Hall.

The Comprehensive Plan Information Meeting will be held Wednesday at 7:30 P.M. at Charlton Academy.

We have heard nothing regarding the Article 78 proceeding.

A Budget Workshop will be held on October 15. Public Hearing on the proposed budget will be October 27 at 7:00 P.M. prior to the Agenda Meeting. Adopting of the 2003-2004 Budget will be on November 10.

COMMUNICATIONS:

We received a letter from Attorney Pentkowski who represents Garry Heflin asking for the status of the water extension that Mr. Heflin requested on Swaggertown Road. Mr. Tabner, Town Water Attorney, will be responding to Mr. Pentkowski telling Mr. Pentkowski that certain things have to be done before the town can take any action. Mr. Tabner has suggested that John Morgan and Jim Mitchell have discussions with Mr. Pentkowski on the engineering requirements on the map and plan. Supervisor Acunto suggested we have an escrow account. The Board agreed. We will request $5,000.00 be put in an account. Councilman Lippiello will contact Mr. Tabner and tell him no discussions will be held until the escrow account is set up.

We have received another application for water at 13 Old Stage Road. They are on the transmission line. The Board decided to hold the application for discussion at the next Agenda Meeting.

COMPREHENSIVE PLAN:

They will be meeting Wednesday night.

ENVIRONMENTAL CONSERVATION COMMISSION:

They have been asked to look at the Getty Gas Station on Stage Road and examine it from an environmental standpoint. The Town Board would like the Park Committee involved at the same time. Supervisor Acunto said that the Town is nowhere near thinking about purchasing the property. We need to find out what is there and what is Getty’s obligation.

HIGHWAY:

There is a resolution regarding MS4 Funding Assistance. Councilman Grattidge said MS4 relates to the Storm Water Management Program DEC is working on. Saratoga County is trying to get some smaller towns together as a group to qualify for some grant money. The grant money would be a $1000,000.00 matching grant. The impact on our town could be $5,000.00 to $7,000.00.

HISTORIAN:

Laura reported that next month is Archives Month. The 8th Annual Capital Region Archives Dinner will be held at RPI on October 1st. Saratoga County is participating heavily in this. Our County Clerk has put together a brochure of Saratoga County’s museums and historic sites. In Charlton a special program will be held at the Historical Society presented by Laura on Charlton’s one-room schools.
Laura has been working with Joyce Riedinger this month on illustrations for the new Charlton Directory.
Laura has been working with Schenectady County to hire a new County Historian for Schenectady.
There is a new Schenectady Archeology Group. They are looking for volunteers. The Stockade Walkabout will be held this month.
Local Radio and Television History is now on exhibit at the Schenectady Museum.
Following tonight’s Town Board Meeting Laura will be giving a musical slide presentation on Charlton response to 9/11.

HISTORIC DISTRICT:

The two new signs for the District are almost ready to be put up at the east and west entrances.

PARK COMMITTEE:

They have received a request to use the gazebo for an October wedding
They will be working with the ECC on the Getty Station.

PLANNING BOARD:

The Planning Board Meeting for next Monday night has been cancelled because no applications were received.

RECORDS ADVISORY BOARD:

The second book to be preserved this year was sent to Brown’s River and has been completed and returned. It will be on exhibit at the October Town Board Meeting with other records that have been preserved in celebration of Archives Week. WATER DISTRICTS AND LIBRARY:

John and Dennis are getting things ready for winter. John is waiting for a report back from the company that took a look at the tower. He is looking at someone to do some paving around the pump station.

ZONING BOARD OF APPEALS:

They have a meeting Wednesday night. They will be hearing two cases. Ray Black will be presiding over the second case because it has to do with an application by Maggie Schmidt.
In October there will be three cases before the Board. Wednesday night they will take one last look at the cell tower ordinance.

ZONING ORDINANCE REVIEW COMMITTEE:

They did not meet in July and August because there were not enough members to participate. They will be meeting on September 24 and are making very good progress through the list of potential changes.

ZONING ADMINISTRATOR:

For the month of July building fees collected were $2,663.00. Zoning fees were $50.00. Five CO’s were issued. For the month of August building fees collected were $790.00. Zoning fees were $100.00. Three CO’s were issued.

Councilman Grattidge – The Highway Department is in the middle of their paving program. They have done West Line Road and Cook Road. The seal coating will be finished on Packer Road. They are working on the new salt shed. The old one will be removed.

Councilman Mitchell – This Friday is the deadline for the newsletter articles. JoAnn Gelston and Dot attended a traffic-calming seminar last Friday in Saratoga. It was very interesting. Dot received information from Mr. Tabner about adopting the Main Street Improvement Plan. Board members have a copy. It will be discussed further at the Agenda Meeting.

Councilman Lippiello - Jim Mitchell, John Morgan and Bob will be meeting on September 24 to begin developing the application process for residents applying to the water district which will require more than just a tap.

Councilman Schroeder – A few months ago a resident asked for more information on cases that will be hear by the ZBA. The ZBA will hear a case this month from Rathburger on DeGraff for constructing a 31 x 24 addition to a garage. The other case is from Maggie and Walt Schmidt for a temporary CO for living space. Bernie thanked Laura for the slide show she will show in remembrance of 9/11. The Vietnam War Memorial Replica will be in Cohoes this month in Lansing Park from September 18 – 22. It is ½ scale of the Vietnam Memorial. There will be a contingency from the 348th General Hospital Unit staffed with nurses, counselors and therapists for emotional support.

PRIVILEGE OF THE FLOOR:

Maggie Schmidt expressed concern over a fraudulent postcard that was mailed last week with names on the front, one of which was her husband, and a message of the back. There has been a history of anonymous letters, etc. being mailed in Charlton. She stated that it is harmful, illegal and people need to be reminded of how bad it is. If anyone knows anything about who sent it or information on it, she will be very glad to prosecute. She also has an issue with the context of the postcard. It implies that Walt and Maggie are developers and they are not. They are farmers and contractors. If you sell a piece of property and that makes you a developer, then there are many developers in the town. She feels that the term has been misused and aligned with evil in the town. She feels that being a contractor and developer really isn’t such a horrible thing. No one in the town would have a home if there wasn’t a contractor or developer. The building trades are admirable trades. We need them and we need their expertise in our town affairs.

Bill Gallup questioned whether the NIMO project in town is finished. There is a pond near the back end of his property that wasn’t there prior to the project. Alan will contact NIMO and set up with a meeting with the NIMO and the Gallups.

Dick Lupi stated that he agreed with Maggie Schmidt’s comments. It is a terrible thing to have anonymous mail circulated throughout the town. Some of it portrays developers in a totally unfair way. It portrays us as just the opposite of what we are trying to make ourselves to be.

Ann Booth asked if the cards had been town-wide. It appeared that they were not.

At this time Laura presented her musical slide presentation of Charlton’s response to 9/11.

The Agenda Meeting will be held on Monday, September 29 at 7:30 P.M. at the Town Hall.

The next Town Board Meeting will be held on Tuesday, October 14 at 7:30 P.M. at the Town Hall.

After everyone had the opportunity to speak who wished, the meeting was adjourned at 8:45 P.M.
