TOWN CLERK'S REPORT:

Gail Hanchar read the Town Clerk's Report. She reported taking in $324.50. Motion made by Councilman Schroeder, seconded by Councilman Grattidge. PASSED UNANIMOUSLY.

PRIVILEGE OF THE FLOOR (Agenda Items):

John Simoni stated that the adoption of Local Law #3 was on the agenda for tonight. Supervisor Acunto said only if the board were to entertain it. Mr. Simoni feels the proposed local law needs to be reviewed more extensively before action is taken. He especially feels the subdivision needs to be reviewed because the town board did not have a petition presented to them. The system seems flawed. Supervisor Acunto said there probably were some comments that needed to be reviewed by the board, town council and the town engineer. If the board does not want to entertain that resolution, it will be scratched.

June review of revenue and expenditures:

We appointed a Zoning Ordinance Review Committee and would like to include someone from the Historic District Commission. Doris Stauffer will be added to the Committee.

The ZBA presented a draft of the cellular tower ordinance that they have been working on. Supervisor Acunto has sent a cover letter and draft to the attorney for the town, the ECC, the Historic District Commission, board members, the town engineer, the Planning Board and Zoning Administrator for comments and concerns with the draft ordinance. Any remarks should be returned to Councilman Schroeder by September 30. We hope at that point to go forward with a public hearing.

COMMUNICATIONS:

We received a letter from the Public Service Commission granting Time Warner their fourth extension to operate in the town without a franchise agreement. The extension was given because we are continuing our negotiations. We have not heard from them in a year and they don't seem to be in any hurry to come back to the table.

We received a letter from the Charlton Food Pantry including a report for the year.

We received a letter from the Charlton Planning Board Chairman supporting the idea of a Zoning Ordinance Review Committee.

We received a letter from the Office of Real Property Tax giving us the tentative equalization rate for 2002 of 90.00. This is down from 91.64 in 2001. The towns of Ballston, Galway and Clifton Park are also down.

ANIMAL CONTROL OFFICER:

He has been busy. He is currently handling a dog bite case. He started the dog enumeration last month.

ENVIRONMENTAL CONSERVATION COMMISSION:

Supervisor Acunto and Marv Schorr have received calls about Mr. Buhrmaster using stream water to water plants planted near Dr. Phelps office and on the Shadick property. Supervisor Acunto was told it was no problem as long as he didn't drop the level of the water in the stream. Marv contacted DEC in Warrensburg. They said he needs a permit. Marv will call John Farrell because he has concerns.

The Hazardous Waste Collection will take place on September 28 at the Saratoga County Fair Grounds from 9-3. It will include the towns of Charlton, Milton and Ballston. The Town Clerks will have an information letter and registration forms for residents by the middle of July. A press release will be in local papers.

HIGHWAY:

We have been paving Valentine Road. Will be doing upper Sweetman tomorrow and then Western Avenue.

HISTORIAN:

The worn flags that were collected went to the Saratoga County National Cemetery for their flag burning ceremony.
Saratoga County is now recognizing the 225th Anniversary of the Revolutionary War. The Battles of Saratoga were 225 years ago and were the turning point of the revolution, the most important military event of the last millenium. A re-enactment of Burgoyne's surrender will be at the Saratoga County Fair sponsored by the Saratoga County Board of Supervisors.
On September 28 and 29, there will be hundreds of people re-enacting the Battles of Saratoga. In October there will be a parade and fireworks. Re-enactments are going on all across New England this summer.
Laura received a letter from two gentlemen doing research on a general store that was in Charlton in the 1850's, located where the Charlton Village Shop is today. The owner of the store was purchasing ceramics from England. His invoices are on record at the Smithsonian and a museum in Delaware. These men are experts in the use of pottery and ceramics over the centuries. They are having workshops on ceramics and the ceramics from Charlton.
Laura met with the Records Advisory Board at their meeting this month. For Archives Week in October, the Records Advisory Board will be sponsoring a slide presentation of Charlton Reaction to 911.

Supervisor Acunto stated that Saratoga County will be doing a 911 program early on the morning of September 11 before county offices open with the dedication of memorial. Supervisor Acunto received an
e-mail from the county wanting the names of anyone who participated in 911. We are aware that John Steele participated. If anyone knows of anyone else who participated by going to New York City, please let Supervisor Acunto know as soon as possible.

Supervisor Acunto said he read in the paper that in Clifton Park they made arrangements to get an old mailbox and had a drop off at their town hall for anyone who wanted to dispose of an old flag. Perhaps we could do something with scouts and have a local ceremony here. Councilman Schroeder will work on that.

PLANNING BOARD:

They will be meeting July 15 at 7:30 P.M.

RECORDS ADVISORY BOARD:

They met the end of June. Lynn and Gail are halfway through the records that were in question. We have two openings on the board that we would like to get filled. We discussed the program for Archives Week.

WATER AND LIBRARY:

No water report.
The Galway Library is looking for someone to represent the Town of Charlton on a committee establishing goals for the Galway Library. It is a short-term activity. If anyone is interested, contact Councilman Lippiello.

ZONING:

They collected $986.00 in building fees for the month of June. They issued 4 CO's.

ZBA:

Councilman Schroeder commended them for the many hours they put into the proposed Cell Tower Ordinance.

RESOLUTIONS:

After a short discussion by the Board, it was decided to act on the proposed Local Law regarding a water moratorium next month.

COUNCILMAN REPORTS:

Councilman Mitchell - The requests for those who are interested in being involved with the planning for the Historic District are out and they will begin early in August making selections.
Councilman Lippiello - He will be meeting with Jim Mitchell to develop a map of the current outside users. He appreciated Connie Wood's letter. As we look at the water district for the future, the Planning Board as well as the ZORC might be sitting in with us as we talk about that.
Councilman Schroeder - Regarding the letter from the Charlton Freehold Church about the food pantry, their users have increased and the cost of the food from the Regional Food Bank has increased 25%. We will need to budget more in next year's budget. They are doing a great job.
Councilman Grattidge - Town-wise it has been quiet. He was happy to read the article about Councilman Schroeder who had been away with the reserves. Thanked him for his service.

PRIVILEGE OF THE FLOOR:

Marv Schorr spoke about the need for the newly formed ZORC. There have been changes in various state requirements that are not reflected in the current Zoning Ordinance. Marv thanked Mr. Simoni for a copy of the information he had received on built-up systems. That will be included in the zoning revisions.

Sandy Verola said the board stated the three houses that would be exempt from the moratorium were hardship cases. What constitutes hardship? Supervisor Acunto stated they were out of water and in close proximity to the district. Sandy asked if it would be typical for them to drill for a well if they were out of water. Supervisor Acunto said they were close to public water and they were probably looking at cost and by drilling they might or might not get water. People became outside users only because they wanted the assurance of public water even though they had no problem.

Chuck McLoughlin said in the past it was not a big deal if people wanted to get into the water district but he also believes that five or six years ago the state said there would be no more outside users.

Councilman Lippiello explained that outside users are people who hook up to the system and become part of the system. Outside user is a poor choice of terms. They have been paying a differing rate but that will go away. Councilman Grattidge said the board is also looking at a buy-in rate of what it costs to get into the pipes that are already in the ground and the storage, etc. to make it fair to the people that have already been in the district. We are tying to come up with an equitable solution.

Nick Verola asked how many houses the current system can handle. Councilman Grattidge said it was designed for where we are now.

Chuck McLoughlin said that no one on the town board is part of the water district. He is all for a moratorium. We should have had it a long time ago. He thinks we need to cut out all the exemption stuff. The water system belongs to the people of the water district. They paid to put it in. To see somebody now come into the system and not have to pay for what we had to pay for for years is "bs". The people in the water district have to have something to say about it. Nothing can expand without a hearing anyway.

Paul St. John asked that since the original system was built with asbestos cement pipe, have we been checking yearly the amount of asbestos fibers in the system lines? He also stated that asbestos cement pipe can collapse. We might want to start replacing pipes in the system. Marv Schorr stated that asbestos is an inhalation problem not an ingestion problem so they may not be testing for it in the water. It is not a health problem. It is an infrastructure problem. Supervisor Acunto said we will check with the town engineer and see what suggestions he has.

Dave Gant spoke regarding the poor reception of Nextel phones in our area. Ron said he has been using the phones on loan that he had approved tonight and has had no problems.

The next Agenda Meeting will be July 29 at 7:30 P.M. at the Town Hall.

After everyone had an opportunity to speak who wished the meeting was adjourned at 8:50 P.M.
